Prohibiting Taxpayer Funded Settlements for Illegal Immigrants Act This bill prohibits using federal funds to make settlement payments to compensate any individuals for being separated from family members while detained by U.S. Customs and Border Protection if the detention was (1) a result of the individual improperly entering (or attempting to improperly enter) the United States, and (2) in accordance with a Department of Justice memorandum that adopted a zero-tolerance policy for such improper entry into the United States.

Capital Gains Inflation Relief Act of 2021 This bill allows the adjusted basis of certain assets (including any common stock in a C corporation, any digital asset, and tangible property used in a trade or business) to be indexed for inflation for the purpose of determining the gain or loss of a taxpayer (other than a corporation) who has held the asset for more than three years. The bill sets forth rules for applying the inflation adjustment to short sales; regulated investment companies; real estate investment trusts; other pass-through entities, including partnerships, S corporations, and common trust funds; dispositions between related persons; and improvements to property or contributions of capital. The Internal Revenue Service may disallow an adjustment if any person transfers cash, debt, or any other property to another person for the principal purpose of securing or increasing the adjustment allowed by this bill.

This resolution recognizes the efforts and sacrifices of the wildland firefighters who have risked their lives to fight intense wildfires in 2021. The resolution also (1) expresses support for communities throughout the West as they focus on recovery and rebuilding areas and communities affected by wildfires, and (2) extends gratitude to the families and loved ones of wildland firefighters for supporting the wildland firefighter community.

Outpatient Surgery Quality and Access Act of 2021 This bill establishes and modifies certain requirements relating to Medicare payments for ambulatory surgical center (ASC) services. Specifically, the bill (1) requires the payment system for ASC services to feature certain positive annual adjustments equivalent to those made with respect to hospital outpatient department (OPD) services; (2) revises quality reporting requirements to permit publicly available, side-by-side comparisons of quality measures for ASCs and OPDs in the same geographic area; and (3) requires the Centers for Medicare & Medicaid Services (CMS), when excluding requested procedures from the list of those approved to be performed in ASCs, to cite specified reasons for doing so. With respect to excluding procedures from the approved list for ASCs, the CMS may not cite as a basis for exclusion that a procedure can only be reported using an unlisted surgical procedure code. (Physicians sometimes use unlisted codes when performing new procedures or services if no existing code is adequately descriptive.) The bill also limits the copayment amount for ASC services under Medicare to that of the inpatient hospital deductible.

Having Employees Return to Duty Act of 2021 or the HERD Act of 2021 This bill addresses federal employees who comply with Executive Order 14043 (requiring COVID-19 vaccination for federal employees). Specifically, the bill requires each federal agency, with respect to each agency employee who has complied with such order, to require the employee to work from that employee's duty station and to work the hours required as of February 15, 2020. If such an employee was not employed by the applicable agency as of that date, that requirement shall apply to the employee with respect to duty station and hours of the individual who occupied that position as of that date. An agency may implement different policies than, or supplemental policies to, those requirements, including by requiring social distancing at a particular work site, if the agency finds that (1) there is substantial transmission of COVID-19 within a community in which such requirements would otherwise be carried out, as determined by the Centers for Disease Control and Prevention; and (2) implementing those different or supplemental policies will not degrade the level of service that the agency provides to the public.

South China Sea and East China Sea Sanctions Act of 2021 This bill authorizes sanctions on Chinese individuals and entities that participate in certain activities related to China's territorial disputes in the South China Sea and the East China Sea. The President may impose property-blocking and visa-denial sanctions on certain Chinese individuals and entities, including those that are (1) responsible for or significantly contributing to certain large-scale projects, such as reclamation and militarization projects, in the disputed parts of the South China Sea; (2) responsible for or significantly contributing to actions that inhibit another country from protecting its sovereign rights to access resources in the South China Sea; and (3) responsible for or complicit in actions that threaten the peace, security, or stability in disputed South China Sea areas or in an East China Sea area administered by Japan or South Korea. The President may also (1) deny visas to the corporate officers and controlling shareholders of sanctioned entities, (2) subject sanctioned individuals or entities to certain export restrictions, and (3) prohibit U.S. individuals and entities from investing in sanctioned entities or individuals. The Department of State must periodically submit a report to Congress identifying countries that recognize China's claims to the contested territories.

Upholding the 1995 Jerusalem Embassy Law Act of 2021 This bill prohibits using federal funds to establish any diplomatic facility in Jerusalem other than the U.S. Embassy to Israel.

Prohibiting IRS Financial Surveillance Act This bill prohibits the Department of the Treasury from requiring a financial institution to report the balances, transactions, or the transfers into and out of a financial account. This prohibition does not apply to laws or regulations in effect on the date of enactment.

America's Revegetation and Carbon Sequestration Act of 2021 This bill addresses climate change through efforts to sequester, mitigate, or store carbon dioxide, such as salvage logging, revegetation, or reforestation efforts, on National Forest System land and other land as specified by the bill.
