Expanding Access to Palliative Care Act

Expanding Access to Palliative Care Act This bill requires the Center for Medicare and Medicaid Innovation (CMMI) to test a model that provides community-based palliative care and care coordination for high-risk Medicare beneficiaries and that may replace the Medicare Care Choices Model (currently set to expire on December 31, 2021). Under the new model, multi-disciplinary teams must provide coordinated, palliative care that is available 24-7 for Medicare beneficiaries with serious illnesses or injuries, such as cancer. The CMMI must evaluate the model by comparing patients participating in the model with those outside of the model in relation to specified metrics, including the election and duration of hospice care.

Congressional Whistleblower Protection Act of 2021

Congressional Whistleblower Protection Act of 2021 This bill creates certain administrative and judicial remedies for federal employees whose right to provide information to Congress is interfered with or denied. Under current law, federal employees have the right to petition or furnish information to Congress or to individual Members of Congress, and this right may not be interfered with or denied. The bill explicitly allows employees who are aggrieved by a violation of this right to seek administrative remedies that are currently available to whistleblowers who are fired or experience other forms of retaliation. The bill also establishes a private right of action for aggrieved employees, including the option of a jury trial, if an administrative remedy is not issued within 210 days of a complaint being made. The bill applies to employees and contractors of the executive, legislative, and judicial branches of government, including members of the intelligence community.

Improving Access to Transfusion Care for Hospice Patients Act of 2021

Improving Access to Transfusion Care for Hospice Patients Act of 2021 This bill requires the Center for Medicare and Medicaid Innovation (CMMI) to test a model under which blood transfusions furnished to an individual receiving hospice care are paid separately from the hospice all-inclusive per diem payment under Medicare. The CMMI must evaluate the model by comparing patients participating in the model with those outside of the model in relation to specified metrics, such as hospital utilization and days of hospice care before the end of life.

Supreme Court Ethics Act

Supreme Court Ethics Act This bill establishes a new statutory requirement for the Judicial Conference of the United States to issue a judicial code of conduct for judges and justices of U.S. courts, including Justices of the Supreme Court. Currently, the Judicial Conference issues a code of conduct for judges of U.S. courts (but not for Justices of the Supreme Court).

Safeguard Tribal Objects of Patrimony Act of 2021

Safeguard Tribal Objects of Patrimony Act of 2021 This bill prohibits the exportation of Native American cultural items and archaeological resources that were illegally obtained; provides for the return of such items, including voluntary returns; and establishes and increases related criminal penalties. The bill requires the Department of the Interior and the Department of State to each designate a liaison to facilitate and hold trainings and workshops on the voluntary return of human remains and cultural items. Additionally, Interior must refer individuals and organizations to Indian tribes and Native Hawaiian organizations to facilitate the voluntary return of human remains and cultural items; convene an interagency working group; and convene a Native working group consisting of representatives of Indian tribes and Native Hawaiian organizations to provide advice on issues concerning the return of, and illegal trade in, human remains and cultural items. The bill also increases from 5 years to 10 years the maximum prison term for an individual convicted of selling, purchasing, using for profit, or transporting for sale or profit human remains or cultural items that were illegally obtained.

United States Cadet Nurse Corps Service Recognition Act of 2021

United States Cadet Nurse Corps Service Recognition Act of 2021 This bill recognizes service as a member of the U.S. Cadet Nurse Corps between July 1, 1943, and December 31, 1948, as active duty service. The active duty designation entitles qualifying individuals to certain benefits afforded to veterans, such as burial benefits (not including interment at Arlington National Cemetery) and honorary veteran status. Under the bill, the Department of Defense (DOD) must issue individuals who served in the corps during the specified period a discharge from their service under honorable conditions if such a discharge is warranted based on the duration and nature of the service. Such individuals are not entitled to Department of Veterans Affairs benefits aside from those related to burials and memorials. The bill also authorizes DOD to produce a service medal or other commendation, memorial plaque, or grave marker to honor the individuals.

Ensuring Survivor Benefits during COVID-19 Act of 2021

Ensuring Survivor Benefits during COVID-19 Act of 2021 This bill requires the Department of Veterans Affairs (VA) to obtain a medical opinion that determines whether a service-connected disability was the principal or contributory cause of death for a veteran who died from COVID-19. Specifically, the VA must obtain this determination before notifying a claimant for survivor benefits of the final decision regarding such benefits in any case where a dependency and indemnity compensation claim is filed in relation to a veteran with one or more service-connected disabilities who dies, the death certificate for the veteran identifies COVID-19 as the principal or contributory cause of death, the death certificate does not clearly identify any of the service-connected disabilities as the principal or contributory cause of death, the veteran's service-connected disability includes a condition more likely to cause severe illness from COVID-19, the claimant is not entitled to certain dependency and indemnity compensation benefits, and the evidence to support the claim does not result in a preliminary finding in favor of the claimant. The VA must provide information to veterans, their dependents, and veterans service organizations about applying for dependency and indemnity compensation when a veteran dies from COVID-19. Such information must be available through the VA's website and via other outreach mechanisms.

Broadcast VOICES Act

Broadcast Varied Ownership Incentives for Community Expanded Service Act or the Broadcast VOICES Act This bill requires the Federal Communications Commission (FCC) to take certain actions to increase diversity of ownership in the broadcasting industry and establishes related tax incentives. Specifically, the bill requires the FCC to report to Congress regarding (1) recommendations for increasing the total number, and the value, of broadcast stations that are owned by socially disadvantaged individuals; (2) the total number of broadcast stations that are owned by socially disadvantaged individuals; and (3) whether there is a nexus between diversity of ownership or control of broadcast stations and the diversity of the viewpoints expressed on the stations. In addition, the bill allows companies engaged in the qualifying sale of a broadcast station to receive favorable tax treatment by electing nonrecognition of the gain or loss resulting from the sale. To qualify for this treatment, the sale must result in or preserve ownership of a broadcast station by socially disadvantaged individuals. Finally, the establishes a tax credit for certain contributions toward the training of socially disadvantaged individuals in the management and operation of broadcast stations.
