John R. Lewis Voting Rights Advancement Act of 2021

John R. Lewis Voting Rights Advancement Act of 2021 This bill establishes new criteria for determining which states and political subdivisions must obtain preclearance before changes to voting practices may take effect. Preclearance is the process of receiving preapproval from the Department of Justice (DOJ) or the U.S. District Court for the District of Columbia before making legal changes that would affect voting rights. The bill also includes provisions related to federally protected activities at polling places and voting access on tribal lands. A state and all of its political subdivisions shall be subject to preclearance of voting practice changes for a 10-year period if 15 or more voting rights violations occurred in the state during the previous 25 years; or 10 or more violations occurred during the previous 25 years, at least 1 of which was committed by the state itself. A political subdivision as a separate unit shall also be subject to preclearance for a 10-year period if three or more voting rights violations occurred there during the previous 25 years. States and political subdivisions that meet certain thresholds regarding minority groups must preclear covered practices before implementation, such as changes to methods of election and redistricting. Further, states and political subdivisions must notify the public of changes to voting practices. Next, the bill authorizes DOJ to require states or political subdivisions to provide certain documents or answers to questions for enforcing voting rights. The bill also outlines factors courts must consider when hearing challenges to voting practices, such as the history of official voting discrimination in the state or political subdivision. In addition, the bill (1) includes certain protections for election workers, polling places, and election infrastructure; and (2) expands voting access on tribal lands.

Honest Census Communications Act

Honest Census Communications Act This bill prohibits certain deceptive practices in relation to a census. Specifically, the bill prohibits communicating census-related information, or producing census-related information for communication, knowing the information to be materially false and with the intent to impede or prevent another person from participating in any census. The bill sets criminal and civil penalties for violations.

Fair Day in Court for Kids Act of 2021

Fair Day in Court for Kids Act of 2021 This bill provides legal protections for a noncitizen (i.e., an individual referred to as an alien in federal law) who is detained or subject to immigration-related proceedings. The Department of Justice (DOJ), or the Department of Health and Human Services (HHS) in a case involving an unaccompanied child, may appoint or provide counsel at the government's expense to noncitizens in removal proceedings and related appeals. An unaccompanied child must be represented by counsel paid for and appointed by the government at every stage of such proceedings unless the child has obtained counsel at their own expense. If HHS fails to provide counsel to an unaccompanied child, the deadline for filing a motion to reopen a proceeding shall not apply, and the filing of such a motion shall stay the child's removal from the United States. The Department of Homeland Security (DHS) must provide a complete copy of a noncitizen's immigration file to the noncitizen (or the noncitizen's counsel) within seven days of a notice to appear for an immigration proceeding, and failure to provide the file shall result in a delay in the proceeding. DHS must provide access to counsel for all detained noncitizens. The bill authorizes HHS to enter into contacts or award grants for providing immigration-related legal services to children. The Office of Refugee Resettlement must develop model guidelines for representing noncitizen children in immigration proceedings.

AQUAA Act

Advancing the Quality and Understanding of American Aquaculture Act or the AQUAA Act This bill establishes standards for sustainable aquaculture in federal offshore waters in the exclusive economic zone and establishes related requirements. For example, it requires the National Oceanic and Atmospheric Administration (NOAA) to establish a national plan to identify and designate aquaculture opportunity areas. In addition, NOAA must establish a unified permitting and review process for aquaculture operations. NOAA must also establish a grant program for research and development to support the development of a sustainable marine aquaculture industry, such as research and services to create innovative design and engineering solutions to common obstacles within the aquaculture industry. Finally, the bill directs the Department of Commerce to create and provide resources for an Office of Aquaculture within NOAA to coordinate regulatory, scientific, outreach, and international issues related to aquaculture.

Safeguarding American Families and Expanding Social Security Act of 2021

Safeguarding American Families and Expanding Social Security Act of 2021 This bill makes various changes to Social Security benefits, including phasing out the cap on earnings subject to Social Security payroll taxes (currently $142,800 for 2021) and revising the method of calculating Social Security benefits to account for the additional earnings subject to the taxes.

Transportation, Housing and Urban Development, and Related Agencies Appropriations Act, 2022 This bill provides FY2022 appropriations to the Department of Transportation (DOT), the Department of Housing and Urban Development (HUD), and several related agencies. The bill provides appropriations to DOT for the Office of the Secretary, the Federal Aviation Administration, the Federal Highway Administration, the Federal Motor Carrier Safety Administration, the National Highway Traffic Safety Administration, the Federal Railroad Administration, the Federal Transit Administration, the Great Lakes St. Lawrence Seaway Development Corporation, the Maritime Administration, the Pipeline and Hazardous Materials Safety Administration, and the Office of Inspector General. The bill provides appropriations to HUD for Management and Administration, Public and Indian Housing, Community Planning and Development, Housing Programs, the Federal Housing Administration, the Government National Mortgage Association (Ginnie Mae), Policy Development and Research, Fair Housing and Equal Opportunity, the Office of Lead Hazard Control and Healthy Homes, the Information Technology Fund, and the Office of Inspector General. The bill also provides appropriations to several related agencies, including the Access Board, the Federal Maritime Commission, the National Railroad Passenger Corporation (Amtrak) Office of Inspector General, the National Transportation Safety Board, the Neighborhood Reinvestment Corporation, the Surface Transportation Board, and the U.S. Interagency Council on Homelessness. The bill includes several provisions that establish requirements and authorities for HUD's programs and activities related to disaster relief and recovery. Additionally, the bill sets forth requirements and restrictions for using funds provided by this and other appropriations acts.

Keeping Workers Safe Act

Keeping Workers Safe Act This bill requires the Department of Labor to notify the public about certain enforcement actions taken against an employer for safety and health violations. First, Labor must issue a notice of each enforcement action with a penalty greater than $60,000. Second, Labor must issue a notice of each enforcement action resulting from (1) multiple, serious violations, or (2) repeated violations classified as other-than-serious. Labor must issue a notice within seven days of taking the enforcement action and distribute it through regional and local newspapers in the area where the employer is located; applicable trade, industry, or labor organizations; and relevant state and local government entities.

State Justice Improvement Act

State Justice Improvement Act This bill reauthorizes through FY2027 the State Justice Institute, a nonprofit corporation established by federal law, and authorizes the institute to award grants for the development and implementation of best policies and practices for the constitutional and equitable enforcement of fines and fees. Specifically, the institute may award these grants to state and local courts, nonprofit organizations, institutions of higher education, and other specified entities. The policies and practices must incorporate guidance that courts should, among other things, consider alternatives to incarceration for defendants who are unable to pay fines.
