Border Safety and Security Act of 2022

Border Safety and Security Act of 2022 This bill requires the Department of Homeland Security (DHS) to suspend the entry of any non-U.S. nationals ( aliens under federal law) without valid entry documents during any period when DHS cannot detain such an individual or return the individual to a foreign country contiguous to the United States. A state may sue DHS to enforce this requirement. (Under current law, non-U.S. nationals who arrive at the border without entry documents are generally subject to expedited removal. However, if such an individual is found to have a credible fear of persecution, they are typically subject to detention while their asylum claim is being considered.) The bill also authorizes DHS to suspend the entry of non-U.S. nationals without entry documents at the border if DHS determines that such a suspension is necessary to achieve operational control over such a border.

Employee Rights Act

Employee Rights Act This bill makes various changes with respect to the collective bargaining process and labor relations. For example, the bill permits an employer to refuse to collectively bargain with a union within 90 days prior to the expiration of a collective bargaining agreement if the employer receives evidence that the majority of the employees in the bargaining unit do not support the union. The bill requires support from a majority of the employees in the bargaining unit (not just a majority of the employees voting) when electing union representation. The bill also requires unions to provide bargaining unit employees with the right to vote by secret ballot, including when voting whether to engage in a strike or refusal to work. Further, union dues, fees, assessments, and other contributions may be used for only collective bargaining or contract administrative functions. Additionally, the bill establishes a process for nullifying executive orders that the Office of Management and Budget determines are likely to result in an employer ordering a plant closure or mass layoff.

Border Czar Accountability Act of 2022

Border Czar Accountability Act of 2022 This bill prohibits any Cabinet member appointed by the President to lead efforts related to immigration or securing the U.S.-Mexico border from expending any federal funds if that Cabinet member fails to meet certain reporting requirements. The bill also requires that Cabinet member to visit the U.S.-Mexico border at least once every 60 days. If the report is not submitted, the Cabinet member may not obligate or expend any federal funds until the report has been delivered.
