Drain the Swamp Act of 2021 This bill repeals the requirement that all offices attached to the seat of the federal government be exercised in the District of Columbia, except as otherwise expressly provided by law. Each executive agency, by September 30, 2022, must submit a plan for the relocation of its headquarters outside of the Washington metropolitan area. Such plan shall identify a location for a new headquarters; maximize any potential cost savings associated with the relocation; provide that, upon implementation of the plan, no more than 10% of agency employees are based in the Washington metropolitan area; and consider any potential national security implications of the relocation. Each agency shall implement the plan by September 30, 2026.

Educational Opportunity and Success Act of 2021 This bill reauthorizes through FY2027 and otherwise revises TRIO programs. (These outreach and student-services programs identify and provide services to students from disadvantaged backgrounds.) Among other revisions to the programs, the bill prohibits the Department of Education (ED) from rejecting TRIO grant applications based on certain errors; requires ED to provide additional technical assistance to interested grant applicants; revises the outcome criteria for measuring the quality and effectiveness of the programs, including those programs specifically designed for veterans; allows program administrators to use a student's most recent Free Application for Federal Student Aid to determine TRIO program eligibility; and increases the maximum stipend for students participating in the Upward Bound Program or the Ronald E. McNair Postbaccalaureate Achievement Program.

Drug-Free Communities Pandemic Relief Act This bill authorizes the Drug-Free Communities Support Program, subject to certain limitations, to waive matching funds requirements applicable to certain grants for reducing substance use among youth. Before waiving these requirements, the program must determine that a grantee is unable to raise funds because of the COVID-19 emergency. Currently, the Office of National Drug Control Policy administers this program, and community coalitions that receive the grants must match a specified percentage of the federal award amount with nonfederal funds, including in-kind contributions.

CBO Show Your Work Act This bill requires the Congressional Budget Office (CBO) to make available to Congress and the public each fiscal model, policy model, and data preparation routine that the CBO uses to estimate the costs and other fiscal, social, or economic effects of legislation. For each estimate of the costs and other fiscal effects of legislation, the CBO must also disclose, in a manner sufficient to permit replication by individuals not employed by the CBO, the data, programs, models, assumptions, and other details of the computations used to prepare the estimate. For data that may not be disclosed, the CBO must make available to Congress and the public a complete list of all data variables for the data; descriptive statistics for all data variables for the data, to the extent that the descriptive statistics do not violate the rule against disclosure; a reference to the statute requiring that the data not be disclosed; and contact information for the individual or entity who has unrestricted access to the data.

Safeguarding Children's Privacy in Schools Act This bill revises the standards for parental consent with respect to the online collection, use, and disclosure of the personal information of a child. First, it revises the definition of verifiable parental consent to require websites and online services to obtain consent by a parent before collecting a child's personal information. Currently, websites and online services must make a reasonable effort to ensure that a parent authorizes the collection, use, and disclosure of such personal information before collecting it. The bill also prohibits elementary and secondary school employees from acting as the agent of a child enrolled in such school for the purpose of providing verifiable parental consent.

Drug Cartel Terrorist Designation Act This bill directs the Department of State to designate the Reynosa/Los Metros faction of the Gulf Cartel and the Cartel Del Noreste faction of Los Zetas as foreign terrorist organizations and to submit a detailed report on those drug cartels and any other cartels it may identify. Based on this report, the State Department must designate as a foreign terrorist organization any such identified cartel (or faction thereof) that meets certain criteria for designation as a foreign terrorist organization.

Competition in Professional Baseball Act This bill removes the limited exemption from the antitrust laws for professional baseball clubs. For purposes of this bill, the term antitrust laws means laws to protect against unlawful restraints and monopolies (Clayton Act) and to protect against unfair methods of competition (Federal Trade Commission Act).

Silencers Help Us Save Hearing Act or the SHUSH Act This bill modifies the treatment of silencers under federal statutes governing the sale, transfer, and possession of firearms. Specifically, it removes silencers from the list of firearms subject to regulation (i.e., registration and licensing requirements) under the National Firearms Act (NFA). Additionally, it excludes a muffler or silencer from the list of firearms subject to regulation (e.g., background check requirements) under the Gun Control Act of 1968 (GCA). Finally, the bill does the following: preempts state or local laws that tax or regulate firearm silencers, specifies that a person who lawfully acquires or possesses a silencer under provisions of the GCA meets the registration and licensing requirements of the NFA, eliminates mandatory minimum prison terms for a crime of violence or drug trafficking offense in which a defendant uses or carries a firearm equipped with a silencer or muffler, and permits active and retired law enforcement officers to carry a concealed silencer.

Prohibiting IRS Financial Surveillance Act This bill prohibits the Department of the Treasury from requiring a financial institution to report the transfers into and out of a financial account. This prohibition does not apply to laws or regulations in effect on October 1, 2021.
