Environmental Justice For All Act

Environmental Justice For All Act This bill establishes several environmental justice requirements, advisory bodies, and programs and modifies the scope of environmental review under the National Environmental Policy Act of 1969. The bill sets forth provisions to address the disproportionate adverse human health or environmental effects of federal laws or programs on communities of color, low-income communities, or tribal and indigenous communities. It also prohibits disparate impacts on the basis of race, color, or national origin as discrimination. Aggrieved persons may seek legal remedy when faced with such discrimination. In addition, the bill directs agencies to follow certain requirements concerning environmental justice. For example, agencies must prepare community impact reports that assess the potential impacts of their actions on environmental justice communities under certain circumstances. It also raises coal, oil, and gas royalty rates to create a funding source to support fossil fuel-dependent communities and displaced workers as they transition away from fossil fuel industries. Additionally, the bill creates a variety of advisory bodies and positions, such as the White House Environmental Justice Interagency Council. Among other things, the council must issue an environmental justice strategy. It also establishes requirements and programs concerning chemicals or toxic ingredients in certain products. For example, the bill (1) requires certain products (e.g., cosmetics) to include a list of ingredients or warnings; and (2) provides grants for research on designing safer alternatives to chemicals in certain consumer, cleaning, toy, or baby products that have an inherent toxicity or that are associated with chronic adverse health effects. Finally, it creates a variety of funding programs, such as a grant program to enhance access to park and recreational opportunities in urban areas.

Light Rail Transit Act

Light Rail Transit Act This bill directs the Federal Transit Administration (FTA) to establish a grant program to provide grants to state, local, and tribal governments for the design and implementation of light rail projects, including for the redesign, retrofit, renovation, update, and repair of existing light rail systems. As condition of receiving a grant, eligible entities must certify that fares for riding the light rail transit system shall not increase solely due to improvements carried out with grant funds and for any reason for at least one year after completion of a project funded by the bill. In carrying out the program, the FTA must prioritize projects located in economically disadvantaged communities.

Expanding the VOTE Act

Expanding the Voluntary Opportunities for Translations in Elections Act or the Expanding the VOTE Act This bill expands access to voting materials for individuals with limited proficiency in the English language, including by establishing incentive grants for states and political subdivisions to provide translated voting materials. Additionally, the bill directs the Government Accountability Office to study the impact of (1) reducing the threshold requirement under Section 203 of the Voting Rights Act of 1965, and (2) expanding the definition of language minorities to include native speakers of additional languages.

Empowering the U.S. Fire Administration Act

Empowering the U.S. Fire Administration Act This act authorizes the U.S. Fire Administration (USFA) to conduct on-site fire safety investigations of major fires and other fires under other specified circumstances. In the case of a major fire, the USFA may send incident investigators (e.g., safety specialists, fire protection engineers, codes and standards experts, researchers, and fire training specialists) to the site. Any such investigation shall (1) be conducted in coordination and cooperation with appropriate federal, state, local, tribal, and territorial authorities; and (2) examine the previously determined cause and origin of the fire and assess broader systematic matters. Upon concluding any such investigation, the USFA must issue a public report to federal, state, local, tribal, and territorial authorities on the findings of such investigation or collaborate with another investigating federal, state, local, tribal, or territorial agency on that agency's report. The act makes an exception where issuing a report would have a negative impact on a potential or ongoing criminal investigation. Additionally, the USFA may send fire investigators to conduct fire safety investigations at the site of any fire with unusual or remarkable context that results in losses less severe than those occurring as a result of a major fire, in coordination and cooperation with the appropriate federal, state, local, tribal, and territorial authorities.

Real Courts, Rule of Law Act of 2022

Real Courts, Rule of Law Act of 2022 This bill establishes the U.S. Immigration Courts, a system of courts to be independent of the executive branch. The bill also transfers all functions of the Executive Office for Immigration Review (EOIR) to the Immigration Courts, with some exceptions. (Currently, the EOIR, located in the Department of Justice, has authority to adjudicate immigration cases.) The trial division of the Immigration Courts shall have jurisdiction over various immigration-related matters, including (1) removal proceedings, (2) reviews of rescissions of lawful permanent resident status, and (3) reviews of credible fear determinations in applications for refugee status. The appellate division shall have jurisdiction over appeals of decisions by the trial division and certain Department of Homeland Security determinations. The bill establishes various requirements and authorities relating to the Immigration Courts, including qualifications, length of term in office, and mandatory retirement age for judges. Each appellate division judge must be appointed by the President with the advice and consent of the Senate, and the appellate division shall appoint the trial division judges.

VA Employee Fairness Act of 2021 This bill repeals provisions excluding any matter or question concerning professional conduct or competence; peer review; or the establishment, determination, or adjustment of employee compensation from the applicability of collective bargaining rights for Veterans Health Administration employees.

Respect for Marriage Act

Respect for Marriage Act This act provides statutory authority for same-sex and interracial marriages. Specifically, the act replaces provisions that define, for purposes of federal law, marriage as between a man and a woman and spouse as a person of the opposite sex with provisions that recognize any marriage between two individuals that is valid under state law. (The Supreme Court held that the current provisions were unconstitutional in United States v. Windsor in 2013.) The act also replaces provisions that do not require states to recognize same-sex marriages from other states with provisions that prohibit the denial of full faith and credit or any right or claim relating to out-of-state marriages on the basis of sex, race, ethnicity, or national origin. (The Supreme Court held that state laws barring same-sex marriages were unconstitutional in Obergefell v. Hodges in 2015; the Court held that state laws barring interracial marriages were unconstitutional in Loving v. Virginia in 1967.) The act allows the Department of Justice to bring a civil action and establishes a private right of action for violations. The act does not (1) affect religious liberties or conscience protections that are available under the Constitution or federal law, (2) require religious organizations to provide goods or services to formally recognize or celebrate a marriage, (3) affect any benefits or rights that do not arise from a marriage, or (4) recognize under federal law any marriage between more than two individuals.

WISE Act of 2022

Working for Immigrant Safety and Empowerment Act of 2022 or the WISE Act of 2022 This bill addresses immigration-related issues for victims of domestic violence and other crimes. For example, the bill (1) extends the period of admission into the United States for certain spouses or children who derive their immigration status from an individual who is abusing the spouse or child; and (2) establishes a presumption that an individual with certain pending applications, such as for a visa for a victim of human trafficking or certain other crimes, should be released from immigration detention without conditions.
