HEALTH Act of 2021

Helping Every American Link To Healthcare Act of 2021 or the HEALTH Act of 2021 This bill requires the Department of Health and Human Services (HHS) to continue allowing providers to use certain communication products when furnishing telehealth services after the COVID-19 emergency ends. Generally, providers must use communication products that comply with applicable federal privacy and security standards; however, HHS issued a notification stating that it would not enforce penalties against providers who, in good faith, use noncompliant communication products during the COVID-19 emergency. The bill requires HHS to revise applicable privacy and security regulations to allow providers to use noncompliant products for seven years after the COVID-19 emergency ends. HHS may elect to extend this period following a review of telehealth services furnished over those seven years.

Listing Reform Act

Listing Reform Act This bill modifies requirements concerning the review of petitions to add a species to the list of endangered or threatened species or to remove a species from the list. Specifically, the bill allows the Department of the Interior and the Department of Commerce to prioritize the consideration of petitions to list a species as endangered or threatened other than in the order in which the petitions are received. The appropriate department may not give general priority to petitions to add species to the list of endangered or threatened species over petitions to remove a species from the list. The deadline for the appropriate department to decide on whether or not a petition to list or remove a species should be granted is changed from within 12 months to as expeditiously as possible. The appropriate department is given the authority to preclude the listing of a species as threatened due to the likelihood of significant, cumulative economic effects that would result from such listing or from the likely resulting designation of critical habitat of the species. Once a petition is precluded due to those economic effects, the appropriate department may not reconsider that finding unless the department (1) determines there is endangerment of extinction of the species; or (2) receives a new petition to add the species to the list that includes an analyses concluding that alternative actions are possible other than those resulting in significant, cumulative economic effects.

School Milk Nutrition Act of 2021

School Milk Nutrition Act of 20 21 This bill revises requirements for milk provided by the National School Lunch Program of the Department of Agriculture. The bill permits schools participating in the program to offer students low-fat flavored milk.

Protecting Life on College Campus Act of 2021

Protecting Life on College Campus Act of 2021 This bill prohibits the award of federal funds to an institution of higher education (IHE) that hosts or is affiliated with a school-based service site that provides abortion drugs or abortions to its students or to employees of the IHE or the site. An IHE that hosts or is affiliated with a site must, in order to remain eligible for federal funds, annually certify that the site does not provide abortion drugs or abortions to students or employees.

LIST Act of 2021

Less Imprecision in Species Treatment Act of 2021 or the LIST Act of 2021 This bill revises the process for removing a species from the endangered or threatened species lists. A species must be removed from the endangered or threatened species lists if the Department of the Interior produces or receives substantial scientific or commercial information demonstrating that the species is recovered or that recovery goals set for the species have been met. The publication and notice of a proposed regulation to remove a species from the lists must consist solely of a notice of the removal. The bill establishes a process for removing species from the lists if they were erroneously or wrongfully listed. The bill prohibits a person from submitting a petition to list a species as a threatened or endangered species for 10 years if the person knowingly submitted a petition with information that was inaccurate beyond scientifically reasonable margins of error, fraudulent, or misrepresentative.

ENTRÉE Act

Entrepreneurs Need Timely Replenishment (for) Eating Establishments Act or the ENTRÉE Act This bill provides FY2021 supplemental appropriations for the Restaurant Revitalization Fund and modifies requirements related to administration of the fund. The fund was established in response to COVID-19 to make grants to eligible food and beverage purveyors for covering specified costs such as payroll, operational expenses, and paid sick leave. The bill correspondingly rescinds unobligated amounts previously made available for the Economic Injury Disaster Loan Program and coronavirus state and local fiscal recovery funds. Further, the bill requires the Small Business Administration (SBA) to (1) review and process grant applications in the order in which they are received; (2) impose requirements on applicants that reduce waste, fraud, and abuse; and (3) submit and report monthly on an oversight and audit plan outlining the SBA's policies, procedures, and activities with respect to these grants.

Protecting Seniors Through Immunization Act of 2021

Protecting Seniors Through Immunization Act of 2021 This bill specifies that certain deductible, coinsurance, initial coverage limit, and cost-sharing requirements that apply under the Medicare prescription drug benefit shall not apply with respect to vaccines that are recommended by the Advisory Committee on Immunization Practices of the Centers for Disease Control and Prevention. The Centers for Medicare & Medicaid Services must provide to Medicare beneficiaries specified information regarding (1) coverage of vaccines for seniors, and (2) access to recommended vaccines without cost-sharing.

Year-Round Fuel Choice Act of 2021

Year-Round Fuel Choice Act of 2021 This bill amends the Clean Air Act to address the limitations on Reid vapor pressure (a measure of gasoline's volatility) that are placed on gasoline during the summer ozone season. The bill applies the Reid vapor pressure requirements that are applicable to gasoline blended with 10% ethanol (E10) to gasoline blended with more than 10% ethanol. Thus, the waiver given to E10 gasoline, which allows an increase in the Reid Vapor Pressure volatility, is extended to gasoline blended with more than 10% ethanol.

PROTECT 340B Act of 2021

Preserving Rules Ordered for The Entities Covered Through 340B Act of 2021 or the PROTECT 340B Act of 2021 This bill prohibits pharmacy benefit managers (PBMs) and health insurance plans from discriminating against health providers participating in the 340B drug pricing program, including pharmacies contracted with such providers to dispense 340B drugs. The 340B program allows certain providers to receive covered outpatient drugs at reduced prices from manufacturers. Specifically, PBMs and insurance plans may not reimburse 340B participants at a lower rate than other entities not participating in the program; impose differing terms (such as fees, charge-backs, or audits) on 340B participants; interfere with an individual's choice to receive drugs from a 340B participant; require 340B participants to identify which drugs fall within the program; or refuse to contract with a 340B participant on the basis that they utilize the program. Violations of this bill are subject to a civil penalty of not more than $5,000 per violation per day. These prohibitions also apply to prescription drug (Part D) sponsors under Medicare. The bill also provides for a process to prevent duplicate 340B drug discounts to states under Medicaid.
