Improving Seniors' Timely Access to Care Act of 2022 This bill establishes several requirements and standards relating to prior authorization processes under Medicare Advantage (MA) plans. Specifically, MA plans must (1) establish an electronic prior authorization program that meets specified standards, including the ability to provide real-time decisions in response to requests for items and services that are routinely approved; (2) annually publish specified prior authorization information, including the percentage of requests approved and the average response time; and (3) meet other standards, as set by the Centers for Medicare & Medicaid Services, relating to the quality and timeliness of prior authorization determinations.

This resolution expresses the sense of the House of Representatives that the President should classify synthetic fentanyl-related substances as weapons of mass destruction.

Preserving Access to Home Health Act of 2022 This bill restricts the Centers for Medicare & Medicaid Services (CMS) from decreasing payments for Medicare home health services based on certain adjustments until 2026. Current law requires the CMS to make certain permanent and temporary payment adjustments under the Medicare prospective payment system for home health services based on behavioral assumptions for 2020 through 2026. The bill restricts the CMS from making adjustments that decrease payments until 2026; the CMS must also ensure that any such necessary decreases are made before 2032.

This bill permanently allows any site to serve as an originating site (i.e., the location of the beneficiary) for purposes of Medicare telehealth services, including a beneficiary's home.

Formula Act This bill provides through December 31, 2022, duty-free treatment to infant formula. During this time period, articles of infant formula shall not be subject to (1) any additional safeguard duties that may be imposed under subchapter IV of chapter 99 of the Harmonized Tariff Schedule; or (2) any other import quotas, tariff-rate quotas, additional duties, or any other duties, fees, exactions, or charges that otherwise would apply to such articles. Importers shall provide the applicable and anticipated tariff classifications for articles of infant formula on applicable customs entry documents.

Fostering Innovation and Research to Strengthen Tomorrow Act This bill doubles the rate of the tax credit for increasing research expenses and the alternative simplified research tax credit. It also increases the credit rate for taxpayers with no research expenses during a specified three-year period and the amount of the credit that certain small businesses may apply against payroll tax liabilities.

This resolution expresses condolences with respect to the collapse of the Champlain Towers South condominium building in Surfside, Florida, and supports the investigation into the causes of the collapse and efforts to prevent future high-rise building collapses.
