A CONCURRENT RESOLUTION honoring the late Governor Joe Kernan and urging the Indiana Department of Administration to place a memorial bust of Governor Kernan within the State Capitol.
Establishes a state policy favoring beneficial uses of coal combustion residuals (CCR). Provides that the rules of the environmental rules board may not allow CCR to be disposed of if, after the disposal, any of the CCR: (1) would be within a 500 year flood plain; (2) would be in contact with ground water; (3) could migrate into the uppermost aquifer; (4) would be left in an unstable area; or (5) would be in a seismic impact zone. Requires that the CCR disposal rules of the environmental rules board and the state permit program implementing the federal CCR rule be at least as protective and comprehensive as the federal CCR rule. Defines "closure in place" and prohibits the department of environmental management from approving the closure in place of a CCR surface impoundment if: (1) the CCR surface impoundment is within a 500 year flood plain; (2) any of the CCR disposed of in the CCR surface impoundment would be in contact with ground water; or (3) CCR could migrate into the uppermost aquifer after the closure in place. Makes corresponding changes and a technical correction.
Amends the definition of "wage credits". Specifies the rate for unemployment insurance benefits for initial claims filed by an individual who is totally unemployed for any week beginning after June 30, 2023. Specifies, for initial claims filed for any week beginning after June 30, 2023: (1) the maximum weekly benefit amount; and (2) an additional weekly benefit for eligible and qualified individuals with dependents.
Establishes: (1) the educational support professional grant program to provide grants to eligible school corporations to recruit and retain educational support professionals; and (2) the educational support professional grant fund (fund). Establishes a commission to identify information concerning educational support professionals in each school corporation. Requires the commission to report its findings to the general assembly. Makes an appropriation to the fund.
Provides that a juvenile commits a delinquent act if: (1) the juvenile commits an act that would be a felony if committed by an adult (under current law, a juvenile commits a delinquent act if the juvenile commits an act that would be a felony or a misdemeanor if committed by an adult); (2) the juvenile commits an offense related to unlawful carry of a firearm; or (3) the juvenile commits indecent display by a youth or an act that would be a misdemeanor if committed by an adult, and either of the following apply: (A) The child has also committed a delinquent act that would be a felony if committed by an adult. (B) The child needs care, treatment, or rehabilitation that: (i) the child is not receiving; (ii) the child is unlikely to accept voluntarily; and (iii) is unlikely to be provided or accepted without the coercive intervention of a court.
Requires an employer to grant an employee's request for a reasonable accommodation for a known limitation related to the employee's pregnancy absent undue hardship on the employer's business. Provides that an employer may not require an employee to take leave under a leave law or policy adopted by the employer if another reasonable accommodation can be provided for known limitations arising from pregnancy, childbirth, or related medical conditions. Establishes a civil action for a violation of these provisions.
Establishes the PFAS biomonitoring pilot program (pilot program) under the department of homeland security (department) to collect and analyze blood samples of individuals who were previously, or are currently, firefighters: (1) for serum PFAS levels; and (2) to determine whether there may be corresponding health implications associated with elevated serum PFAS levels. Requires the department to consult the department of environmental management and the Indiana department of health regarding the pilot program. Provides that the department shall, to the extent possible, test 1,000 firefighters. Allows the department to work with a third party to administer the pilot program and to store data collected under the pilot program. Requires the department to submit, not later than July 1, 2027, a report summarizing: (1) the results of the pilot program; and (2) recommendations of the department, the department of environmental management, and the Indiana department of health for decreasing serum PFAS levels and exposure to PFAS chemicals; to the governor and the legislative council. Establishes the PFAS biomonitoring pilot fund. Makes an appropriation.
