Private card games.

Defines "private low stakes card game" and provides a defense to certain gambling crimes if the gambling was a private low stakes card game. Defines "cheating" and makes cheating at gambling a Class A misdemeanor, and increases the penalty for the offense based on the gain obtained by cheating. Makes conforming amendments.

Agency oversight and rulemaking procedures.

With certain exceptions, requires an agency to repeal a rule before the agency may adopt a new rule that requires or prohibits an action on behalf of a person. Requires an agency to submit an emergency rule to the attorney general for review and approval before the emergency rule may take effect. Provides that emergency rules may not be effective for a period that exceeds 180 days. Provides that certain emergency rules expire not more than two years after the rule takes effect. Requires an agency adopting an administrative rule to submit an economic impact statement and an explanation of any penalty, fine, or other similar negative impact included in the proposed rule to the publisher of the Indiana administrative code (publisher). Requires the publisher to provide a copy of the materials concerning a proposed rule or pending readoption to the members of the appropriate standing committee. Provides that administrative rules expire on July 1 of the fourth year after the year in which the rule takes effect (instead of January 1 of the seventh year after the year in which the rule takes effect). Requires an agency intending to readopt an administrative rule to provide to the publisher, not later than January 1 of the third year after the year in which the rule most recently took effect: (1) notice of; and (2) information concerning; the pending readoption. Makes corresponding changes.

1977 pension and disability fund.

Establishes the 1977 fund defined contribution plan (plan). Provides that current employees may make contributions to the plan. Specifies rules and requirements for the plan concerning items that include member elections, member contributions, vesting, rollover distributions, and withdrawal of funds. (The introduced version of this bill was prepared by the interim study committee on pension management oversight.)

Carbon sequestration pilot project.

Changes the description of the carbon sequestration pilot project that is authorized under current law. Eliminates the requirement that the operator of the carbon sequestration pilot project be designated by the director of the department of natural resources. Defines "carbon sequestration claim" as a civil action alleging actual or potential infringement of, interference with, or damage to real or personal property rights or interests arising from: (1) the operation of the carbon sequestration pilot project; or (2) the actual or potential presence or migration in the subsurface of injectate from the carbon sequestration pilot project. Provides that a person may not maintain a carbon sequestration claim unless the person pleads and proves: (1) actual interference with the reasonable use of the person's property; or (2) direct and tangible physical damage to the person's property. Provides that a person asserting a carbon sequestration claim may not recover damages for the diminution of the value of the person's real property due solely to any perceived risk associated with the operation of the carbon sequestration pilot project.

Thirteenth check.

Provides for a thirteenth check in 2022 for certain members of the: (1) Indiana state teachers' retirement fund; (2) public employees' retirement fund; (3) state excise police, gaming agent, gaming control officer, and conservation enforcement officers' retirement plan; (4) state police pre-1987 benefit system; and (5) state police 1987 benefit system.

Climate and environmental justice task force.

Establishes the climate and environmental justice task force (task force). Provides that the task force consists of 17 members. Requires the task force to: (1) develop a climate action plan that recommends policies the state should implement to systematically mitigate climate change, facilitate adaptation to the effects of climate change in Indiana, and simultaneously enhance statewide economic development; and (2) not later than November 1, 2022, submit the climate action plan to the executive director of the legislative services agency for distribution to the members of the general assembly and the governor. Requires the utility regulatory commission, not later than June 1, 2022, to issue a report forecasting the greenhouse gas emissions that will be produced by the power generation of Indiana's investor owned utility companies in each year from 2022 to 2050, based on the investor owned utility companies' current integrated resource plans.

TANF eligibility.

Sets the income eligibility requirements for the Temporary Assistance for Needy Families (TANF) program at a specified percentage of the federal income poverty level. Requires the division of family resources (division) to amend the state TANF plan or take any other action necessary to implement the income requirements. Increases certain payment amounts under the TANF program. Requires the payments to be annually adjusted using the Social Security cost of living adjustment rate, but provides that the total adjustment in a year must be reduced to the extent the adjustment would result in the transfer to the Child Care and Development Fund grant program being less than the maximum allowable transfer under federal law. Authorizes emergency rulemaking concerning the payments. Repeals language regarding: (1) payments for a child born more than 10 months after a family qualifies for assistance; (2) the adoption of rules authorizing certain vouchers; (3) eligibility for child support enforcement services; (4) encouraging a family that receives assistance to receive family planning counseling; and (5) requiring the division to apply a percentage reduction to the total needs of TANF applicants and recipients in computing TANF benefits. Makes conforming changes.
