Provides that a determination of cause, instead of probable cause, by the civil rights commission is exempt from agency action under the Indiana administrative orders and procedures act. Removes the requirement that a complainant sign a complaint filed under the Indiana civil rights act. Requires that a complaint under the Indiana civil rights act be received within 180 days instead of filed within 180 days of the alleged discriminatory practice. Removes the requirement that a majority of the commissioners sign a consent agreement reached by the commission. Requires that the complainant, respondent, and aggrieved person on whose behalf a complaint was filed under the Indiana fair housing act shall agree in writing to have the claims decided in court. Provides that a court or the civil rights commission may only award reasonable attorney's fees if there has been a finding that a discriminatory practice has occurred.
Prohibits an insurer that issues a policy of life insurance, disability insurance, or long term care insurance from taking certain actions with respect to the coverage of individuals who are living organ donors. Specifies that certain actions constitute an unfair and deceptive act and practice in the business of insurance when taken against a living organ donor by an insurer.
A CONCURRENT RESOLUTION concerning climate change and economic development.
A CONCURRENT RESOLUTION recognizing Judge Edward W. Najam, Jr., for his 30 years of service on the Indiana Court of Appeals.
Establishes the climate and environmental justice task force (task force). Provides that the task force consists of 17 members. Requires the task force to: (1) develop a climate action plan that recommends policies the state should implement to systematically mitigate climate change, facilitate adaptation to the effects of climate change in Indiana, and simultaneously enhance statewide economic development; and (2) not later than November 1, 2022, submit the climate action plan to the executive director of the legislative services agency for distribution to the members of the general assembly and the governor. Requires the utility regulatory commission, not later than June 1, 2022, to issue a report forecasting the greenhouse gas emissions that will be produced by the power generation of Indiana's investor owned utility companies in each year from 2022 to 2050, based on the investor owned utility companies' current integrated resource plans.
Requires an animal care facility to adopt policies and procedures that govern the return of lost or stray dogs and cats to the dog's or cat's owner. Provides animal care policies and procedures that an animal care facility may include to return lost or stray dogs and cats to the dog's or cat's owner.
Requires that each governing body must provide teachers with at least one class period each day that is free of duties and reserved for class preparation.
Provides that a member of the state teachers' retirement fund who retires after June 30, 2022, and served time in voluntary or involuntary active military service is entitled to a military service credit for the member's active military service in an amount equal to the duration of the member's active military service, if the member: (1) received an honorable discharge; and (2) has at least 10 years of in-state service credit. Provides that not more than six years of military service credit may be granted. Makes conforming amendments.
Changes the current incremental finance charge limits that apply to a small loan to a maximum annual rate. Prohibits making, or taking other actions with respect to, a small loan with a greater rate or amount of interest, or other fees and charges, than allowed under the statute governing small loans. Prohibits a credit services organization from providing certain functions with respect to a small loan and makes a violation a deceptive act.
