Consumer credit transactions.

Amends the Uniform Consumer Credit Code (UCCC) as follows: (1) Specifies that the UCCC applies to any consumer credit transaction entered into by a creditor and a resident of Indiana regardless of whether: (A) the creditor has a physical presence in any state; or (B) the transaction is conducted, in whole or in part, by means of the Internet. (2) Specifies that the licensing requirements under the UCCC apply to any person that regularly engages in making consumer loans in Indiana regardless of whether: (A) the person has a physical presence in any state; or (B) the loan transactions are conducted, in whole or in part, by means of the Internet. (3) Provides that after June 30, 2020, a lender may not contract for or receive the authorized minimum finance charge upon a borrower's prepayment of the second or any subsequent refinancing of a consumer loan made to that borrower by the lender. (4) Provides that after June 30, 2020, a lender may not assess the authorized nonrefundable prepaid finance charge on the second or any subsequent refinancing of a consumer loan made to a borrower by the lender. (5) Provides that a creditor: (A) who is licensed with the department of financial institutions (department) under the UCCC or is required to be licensed with the department; and (B) who violates the UCCC; commits a deceptive act that is actionable by the attorney general or a consumer under the deceptive consumer sales act.

Small loan finance charges.

Changes the current incremental finance charge limits that apply to a small loan to a maximum annual rate. Prohibits making, or taking other actions with respect to, a small loan with a greater rate or amount of interest, or other fees and charges, than allowed under the statute governing small loans. Prohibits a credit services organization from providing certain functions with respect to a small loan and makes a violation a deceptive act.

School accountability.

Provides that a school's or school corporation's category or designation of school or school corporation performance assigned by the state board of education for the 2018-2019 school year may not be lower than the school's or school corporation's category or designation of school or school corporation performance for the 2017-2018 school year. Provides that a school's or school corporation's category or designation of school or school corporation performance assigned by the state board of education for the 2019-2020 school year is the higher of the school's or school corporation's: (1) category or designation of school or school corporation performance assigned for the 2018-2019 school year; or (2) category or designation of school or school corporation performance for the 2019-2020 school year. Provides that consequences for school improvement do not apply for the 2018-2019 or 2019-2020 school years. Provides that ILEARN program test scores or a school's category or designation of school improvement for the 2018-2019 or 2019-2020 school year may not be used by a school corporation as part of an annual performance evaluation of a particular certificated employee unless the use of the ILEARN program test scores or a school's category or designation of school improvement would improve the particular certificated employee's annual performance rating.

Civics test passage rate report.

Beginning in 2022, requires that the department of education (department) annually report to the general assembly the number of students who pass the naturalization exam by at least 60% on their first attempt. Requires that the department post the passage rate on its Internet web site.

Protection of privacy rights of students.

Establishes certain consent requirements regarding students. Provides that, if the attorney general determines that a school corporation or school: (1) discloses a student education record, or any information in a student education record, in violation of federal law; or (2) has a student who is less than 18 years of age and is not emancipated participate in any mental health assessment, mental health service, psychiatric or psychological examination or test, or psychiatric or psychological treatment without the informed written consent of the student's parent; the attorney general may assess a civil penalty against the school corporation or school. Provides that the parent of a student may bring a civil action for certain violations. Provides that the civil penalty and civil action provisions also apply to violations of other provisions concerning: (1) consent for mental health referrals; (2) disclosure of medical records; (3) mental health diagnoses or information; (4) requirements to make certain materials available for inspection; (5) requirements concerning human sexuality instruction; and (6) obtaining consent before requiring a student to participate in certain personal analyses, evaluations, or surveys. Amends a civil immunity provision currently in law to provide that a school, school employee, or school board does not have civil immunity for referrals the school made or services the school offered concerning evaluations or treatment of a student's health if the school, school employee, or school board violated certain consent requirements in making the referral or offering the services. Reconciles the versions of IC 10-21-1-2 that were enacted by the 2019 general assembly.

School curriculum.

Requires each school corporation, charter school, and accredited nonpublic elementary school to include cursive writing in its curriculum.

Gender on driver's licenses.

Defines "gender" for purposes of the motor vehicle law. Defines "nonbinary designation" for purposes of the motor vehicle law. Defines "sex" for purposes of certificates of birth. Sets forth requirements to change the gender that appears on: (1) a driver's license; (2) a driver's permit; (3) an identification card; or (4) a photo exempt identification card. Prohibits: (1) a driver's license; (2) a driver's permit; (3) an identification card; or (4) a photo exempt identification card; from displaying a nonbinary designation. Specifies that certain credentials with a nonbinary designation are valid until their date of expiration. Requires a person to specify a gender when renewing a credential that previously displayed a nonbinary designation. Specifies that the presence of a nonbinary designation on a credential used to obtain: (1) a driver's license; (2) a driver's permit; (3) an identification card; or (4) a photo exempt identification card; does not abrogate certain prohibitions concerning the display of nonbinary designations.
