Requires prescription drug manufacturers, health insurance issuers, pharmacy benefits managers, and wholesale drug distributors (reporting entities) to report certain information to the department of insurance (department), including increases in the wholesale acquisition cost of brand name drugs and generic drugs, the introduction into the United States of a new drug, and spending on prescription drugs before enrollee cost sharing for each of the top 25 prescription drugs and drug groups. Requires reporting entities to pay an annual assessment to support the operational costs incurred by the department in connection with the reporting. Requires a reporting entity to certify under the penalty of perjury that a required report is accurate. Authorizes the insurance commissioner to impose a civil penalty on a reporting entity that fails to comply with a reporting requirement. Requires the department to annually prepare and make available on its web site a report on emerging trends in prescription drug prices. Requires the department to keep confidential and protect from public disclosure all information submitted by reporting entities.

Requires a state employee health plan, a policy of accident and sickness insurance, a health maintenance organization contract, an employee welfare benefit plan, or any other health plan that is compliant with federal law to only offer health plans that do not require a covered individual to: (1) pay a deductible; or (2) pay more than the amount of the copayment or coinsurance specified in the plan's summary of benefits and coverage; with respect to a prescription drug. Prohibits a state employee health plan, a policy of accident and sickness insurance, or a health maintenance organization contract from requiring an insured to pay a cost sharing requirement of more than $250 for a 30 day supply of an individual prescription drug. Requires a state employee health plan, a policy of accident and sickness insurance, and a health maintenance organization contract to include any amounts paid by a covered individual or on behalf of a covered individual when calculating the covered individual's cost sharing requirement. Provides that the cost sharing requirement for a prescription drug under a state employee health plan, a policy of accident and sickness insurance, or a health maintenance organization contract will be calculated at the point of sale and based on a price that is reduced by an amount equal to at least 75% of all rebates received by the insurer in connection with the dispensing or administration of the prescription drug.
Provides that the office of judicial administration shall maintain data bases required under current law for secure storage of electronic juvenile court documents and data regarding expunged juvenile court records. Provides that an individual is not required to pay a fee to file a petition for expungement of the juvenile court records and law enforcement records of a child alleged to be a delinquent child or child in need of services. Requires a law enforcement agency to destroy any retained copies, in any format, of records sent to a court under an order granting expungement of the records. Creates a process for automatic review and expungement of an individual's juvenile delinquency record after a certain period of time. Requires: (1) a law enforcement agency, at the time the law enforcement agency creates a law enforcement record regarding a child accused of a delinquent act; and (2) the clerk of a juvenile court to which a child is referred; to give written notice to the child and the child's parent, guardian, or custodian describing the process to petition for expungement of the child's law enforcement records and juvenile court records, respectively, and written notice of the requirements for automatic expungement of the child's law enforcement records and juvenile court records. Makes conforming amendments.
Requires every infant to be screened for cytomegalovirus at the earliest feasible time.
Allows a business owner, including a lessee, that operates a business located on property subject to an eminent domain action to seek business damages. Provides for the assessment of business damages in an eminent domain matter. Expands the right to an award of attorney's fees in an eminent domain matter.
Extends the time period for a "pay-or-quit" notice from 10 to 14 days, and removes a provision permitting termination of a rental agreement without notice. Allows a prevailing tenant in a landlord-tenant case to expunge records relating to the action. Establishes a procedure permitting a tenant to withhold rent from a landlord and deposit it with a court if the landlord has failed to comply with the landlord's statutory obligations, or if the rental unit is in violation of an ordinance, rule, code or other law, and the violation may materially affect the health or safety of a tenant. Specifies the circumstances under which withheld rent may be returned, and authorizes a court to release some or all of the withheld rent to the tenant to permit the tenant to remedy the violation. Establishes a rental escrow fee of 1% of the amount of the withheld rent to be deposited in the clerk's record perpetuation fund. Makes other changes and conforming amendments.
