Rep. John Bartlett

Authorizes the attorney general to assess a civil penalty of $1 million on a corporation with a market capitalization of at least $100 billion for each instance in which the corporation knowingly makes available child sexually abusive material, and establishes a procedure for the investigation of a complaint relating to child sexually abusive material. Establishes the child sexually abusive material facilitation prevention fund. Specifies that money in the fund shall be used to: (1) fund the Internet crimes against children fund; and (2) offset forgone tax remittances. Makes an appropriation.

Provides that "The Hoosier State" is designated as the official nickname of the state of Indiana. Provides that the designation is to recognize and memorialize the legacy of Harry Hoosier. Makes certain findings in recognizing Harry Hoosier as the namesake of The Hoosier State.

Establishes the child services workforce stabilization fund (fund) for the provision of grants by the department of child services (department) to child services providers for the purpose of addressing costs associated with increased wages for direct care staff. Prescribes: (1) requirements for grant applications; and (2) reporting requirements for grant recipients. Prescribes requirements for reporting by the department to: (1) the commission on improving the status of children in Indiana; and (2) the general assembly; regarding the grant program. Provides that the fund sunsets on June 30, 2025.

Provides 3% annual raises for state police officers.

Provides that before July 1, 2023, the state police board (board) shall establish a new salary matrix for police employees. Provides that the base salary of a police employee with the rank of trooper (excluding longevity increases) must be equal to or greater than the average of the 10 highest base salaries (excluding longevity increases) for a nonpromoted patrolman employed by any law enforcement department in Indiana. Requires the natural resources commission to categorize conservation officer years of service through the fifteenth year after June 30, 2023, rather than through the twentieth year. Provides that the department of natural resources shall adjust the salaries of conservation officers in accordance with changes made by the board. Requires the department of workforce development to provide certain information relating to salaries to the board. Provides that, after June 30, 2023, the number of salary increase increments for each rank for state police officers and conservation officers is reduced from 20 years to 15 years.

Establishes the parent education assistance pilot program (pilot program). Provides that the office of the secretary of family and social services (office of the secretary) shall administer the pilot program. Specifies the requirements an individual must satisfy to be eligible to participate in the pilot program. Provides requirements for maintaining participation in the pilot program. Specifies the amount of an eligible individual's grant under the pilot program. Establishes the parent education assistance pilot program fund (fund) for the purpose of funding the pilot program. Provides that the office of the secretary administers the fund.

Establishes the criminal justice study committee to conduct a comprehensive study of the criminal justice system in the 2023 and 2024 interims. Establishes a permanent criminal justice reform commission to study sentencing, corrections, services provided to offenders, and other topics affecting the criminal justice system.

Provides that during an odd-numbered year, the general assembly shall adjourn sine die not later than the third Monday in November of that year. Provides that in an even-numbered year, the general assembly shall adjourn sine die not later than the first Monday in November of that year. Provides that the sessions of the general assembly are considered to adjourn sine die, by operation of law, not later than the required sine die adjournment days, if the general assembly has not previously adjourned sine die. Codifies provisions relating to the "legislative business per diem allowance", the legislative "subsistence allowance", and the legislative "mileage allowance". Provides that legislators are paid the subsistence allowance for each day: (1) when the general assembly is in session, but in recess for six or more calendar days; and (2) each day after the general assembly adjourns sine die unless the general assembly is in special session, when a legislator is paid the legislative business per diem allowance. Provides that the "prohibited period" during which campaign fundraising may not occur by candidates for election to the general assembly and for state offices ends on the date the budget bill for the following budget period is approved by the governor. (Under current law, the prohibited period ends the day the general assembly adjourns sine die in an odd-numbered year.) Repeals the statutes providing for technical sessions. Repeals the emergency sessions statute. Makes technical changes in statutes to reflect these substantive changes.

Modifies the definition of "protected person" for purposes of the admission of a statement or videotape of an individual who is less than 14 years of age at the time of the offense but less than 18 years of age at the time of trial. Provides that a person who knowingly or intentionally: (1) pays, or offers or agrees to pay, money or other property; or (2) offers a benefit; for a human trafficking victim with the specific intent to induce or obtain the product or act for which the human trafficking victim was trafficked commits human trafficking, a Level 4 felony. Specifies that consent by the human trafficking victim is not a defense to a prosecution. Requires law enforcement agencies to report human trafficking investigations to the attorney general within 30 days after an investigation begins. Makes a technical correction.
