Ballot access for minor parties.

Provides that the term "major political party" refers to: (1) with respect to the state, any of the parties whose nominees received more than 2,500 votes statewide for secretary of state in the last election; or (2) with respect to a political subdivision, any of the parties whose nominees received more than 250 votes in that political subdivision for secretary of state in the last election. Provides that a political party whose nominee received at least 2,500 votes but less than 25% of the votes cast for secretary of state at the last election shall nominate the party's candidates at a state convention and for certain local offices at a county convention. Provides that the petition of nomination for an independent or minor political party must be signed by 250 registered voters in the election district that the candidate seeks to represent.

Fertilizer runoff and Lake Michigan discharges.

Amends the water pollution control law effective July 1, 2024, to: (1) eliminate an exception to the prohibition against causing water pollution that applies to fertilizer runoff from a field in a storm event or irrigation return flow if the fertilizer was applied to the land in compliance with rules of the state chemist; (2) eliminate a provision requiring the commissioner of the department of environmental management (commissioner) to allow for a mixing zone in a permit that involves a discharge into Lake Michigan if the permit applicant can demonstrate that the mixing zone will not cause harm to human health or aquatic life; and (3) eliminate a provision under which the commissioner, in issuing a permit authorizing a discharge into a mixing zone in Lake Michigan, is required to allow for mixing initiated by the use of submerged, high rate diffuser outfall structures (or their equivalent) that provide turbulent initial mixing and minimize organism exposure times. Makes conforming changes.

Regulation of PFAS contaminants.

Requires the state department of health (state department) to establish state maximum contaminant levels for PFAS in water provided by public water systems. Provides that maximum contaminant levels established by the state department: (1) must be protective of public health, including the health of vulnerable subpopulations; and (2) may not be less stringent than any maximum contaminant level or health advisory promulgated by the United States Environmental Protection Agency.

Indiana permanent fund.

Establishes the Indiana permanent fund (fund) in the state treasury. Provides that the fund consists of: (1) 50% or such other greater percentage established by law of any general fund budget surplus realized during a state fiscal year; (2) appropriations made to the fund; and (3) other sources designated by law. Requires income from the fund to be reinvested in the fund. Authorizes the payment of dividends from the income to eligible recipients. Provides that, to be eligible to receive a dividend payment from the fund, a person must have voted in the most recent general election in which the person was eligible to vote occurring before the payment of the dividend. Provides that the principal of the fund may be used only for those investments specifically designated by law as eligible for investment from the fund.

Requires that, under certain circumstances, a court of record in Indiana shall give full faith and credit to judgments and orders of a tribal court affiliated with the Pokagon Band of Potawatomi Indians.

Codifies the compact between the Pokagon Band of Potawatomi Indians and the state providing for the conduct of tribal class III gaming.

Carbon credit market, carbon sequestration, and federal mandates.

Requires the state department of agriculture and the department of natural resources, in consultation with Purdue University, the utility regulatory commission (IURC), agricultural producers, woodland owners, foresters, certain technical experts, the agricultural industry, the forest industry, and environmental and conservation groups, to: (1) study and make findings and recommendations concerning the potential role of the state in a voluntary carbon credit market; and (2) issue a written report to the general assembly. Requires the director of the department of natural resources to designate the operator of the carbon sequestration pilot project (pilot project) before July 31, 2021. Provides that material compliance by the pilot project with a permit for a Class VI carbon dioxide underground injection well is an affirmative defense for the pilot project against certain civil actions or claims. Provides that: (1) a claimant may overcome the affirmative defense by proving actual interference with the use of the property or direct physical injury to tangible property; and (2) recovery by a public utility for any effect of the pilot project on the sources of the utility's public water supply is not prohibited or limited. Defines a "federal phaseout mandate" as any federal statutory or regulatory requirement that: (1) is established after April 20, 2021, by Congress, a federal agency, or a federal executive order; and (2) requires the phaseout or discontinuance of a particular type of electric generating facility, technology, or fuel source. Requires the IURC to consider in the context of: (1) applications for certificates of public convenience and necessity for new generating facilities; and (2) integrated resource planning; the impact of federal phaseout mandates on the estimated useful life of certain generating facilities of an electric utility, including on depreciation expense associated with such facilities.
