Foster care program tax credit.

Provides a tax credit for a taxpayer that makes a monetary contribution to a qualifying foster care organization. Defines a "qualifying foster care organization" as an organization that (1) is exempt from federal income tax under Section 501(c)(3) of the Internal Revenue Code; (2) provides foster care prevention services and programs or direct assistance to individuals in the foster care system; (3) spends at least 50% of its available revenue on qualified services to Indiana residents; (4) affirms it will continue spending at least 50% of its available revenue on qualified services to Indiana residents; and (5) provides ongoing qualified services to at least 200 Indiana residents. Provides that the department of state revenue (department) shall grant a tax credit against any state tax liability due equal to 50% of the amount of the monetary contribution by a person to a qualifying foster care organization. Provides that the tax credit that a taxpayer receives may not exceed $10,000 for any taxable year. Provides that the amount of tax credits allowed may not exceed $2,000,000 in the state fiscal year. Provides that to claim a tax credit an application must be filed with the department. Provides that the department shall promptly notify an applicant whether, or the extent to which, the tax credit is allowable in the state fiscal year in which the application is filed. Provides that when the total credits approved equal the maximum amount allowable in any state fiscal year, no application thereafter filed for that fiscal year shall be approved. Provides that the tax credit chapter expires in 2025.

Highway finances.

Reduces the required percentage amount of the motor vehicle highway account distributions that counties, cities, and towns must use for the construction, reconstruction, and preservation of highways from 50% in current law to 40% in calendar years beginning January 1, 2022, and ending December 31, 2023. Provides that, for a period in which the reduction applies, the term "preservation" includes both snow removal and expenditures for deicing road salt or similar deicing agents. Requires counties, cities, and towns that apply the reduced required percentage amounts authorized under the bill to submit to the local technical assistance program at Purdue University in conjunction with the Indiana department of transportation (LTAP) a detailed itemization of the uses of the funds in the calendar year that were for: (1) purposes other than construction, reconstruction, and preservation; and (2) preservation that included only snow removal and expenditures for deicing road salt or similar deicing agents. Requires the LTAP to present a statewide aggregate report of the results received from counties, cities, and towns to the state budget committee for each year.

Publication of local government notices.

Allows a political subdivision to publish legal notices on a legal notice web site instead of in a newspaper. Establishes requirements regarding availability and accessibility of a legal notice web site. Requires a political subdivision to designate an official responsible for the electronic publication of legal notices, if the political subdivision publishes legal notices electronically. Provides that if a political subdivision does not have an official web site, legal notices may be published on an official web site of the county government. Establishes requirements for the duration of the posting of a legal notice and proof of posting. Provides that a towing service acting as an agent of a government agency that provides the notice required to dispose of abandoned vehicles or parts is subject to the same public notice advertising rates as a governmental agency.

Residential building design elements.

Prohibits a municipality from regulating design elements of residential structures. Specifies certain exclusions from this prohibition. Provides that any rule, ordinance, or other regulation that conflicts with the prohibition is void. Provides that a person aggrieved by a violation of the bill's provisions may file, in a court having jurisdiction, a petition to obtain an injunction against the violation.

Closed captioning.

Requires that an owner or operator of a public accommodation must activate closed captioning on all television receivers that are in use during regular hours. Provides that the definition of "television receiver" includes a receiver or electronic device that receives television or streamed programming and has the ability to display closed captioning, including a television, a display screen, and a digital set top box. Allows the civil rights commission (commission) to investigate violations and enforce compliance. Provides that the commission may impose the following civil penalties: (1) $50 for the first violation. (2) $150 for the second violation. (3) $300 for the third violation. (4) $500 for the fourth violation and each subsequent violation. Provides that if a penalty is imposed, the commission must enter into a remedial plan with the owner or operator for the first violation.

Assistance for the hearing impaired.

Requires the fire prevention and building safety commission (commission) to adopt rules requiring the installation of assistive listening systems that provide a wireless direct connection to the listener, such as audio frequency induction loop systems (AFILs), and beacon positioning systems in Class 1 structures located in a first or second class city. (Under current law, the commission is required to adopt rules requiring that a person must consider the installation of AFILs and beaconing position systems.) Provides that if an owner, operator, or employee of a retail establishment wears a face mask while interacting with customers during a public health emergency, an owner, operator or employee must, upon request, wear a face mask that is transparent to allow for lip reading. Provides that a customer may file a complaint with the local health department. Provides that a local health department may issue a letter of reprimand to the retail establishment if it receives more than five complaints.

Fair and open competition for public works projects.

Provides that a public agency may not do any of the following: (1) Impose by rule, ordinance, or other action, or in the bid specifications or contract documents for a public works project, a requirement inconsistent with, in addition to, or more stringent or restrictive than certain statutory prequalification or any other requirement of an applicable public works statute. (2) Award a public works contract to a contractor under a contract award standard other than the contract award standard of the applicable public works statute. (3) Require a potential bidder on a public works project to provide any information other than the applicable financial information required by the prequalification statutes or as prescribed by the state board of accounts under the applicable public works statute. (4) By rule, ordinance, or any other action relating to contracts for public works projects, create or impose any prequalification processes that are additional to or inconsistent with those established by the prequalification statute or impose any requirements that directly or indirectly restrict potential bidders or proposers to any predetermined class of bidders defined by labor affiliation or membership or minimum training requirements inconsistent with, or more restrictive than, those required by certain public works statutes. (5) Take certain actions based on a bidder's, offeror's, or contractor's entering into, refusing to enter into, adhering to, or refusing to adhere to an agreement with a labor organization.

Mental health and law enforcement.

Requires the division of mental health and addiction (division), upon request, to issue a bracelet, an identification card, or both, indicating that an individual has been medically diagnosed with a mental illness, a substance addiction disorder, or both. Allows the division to charge a fee for the bracelet and identification card. Provides that the information collected by the division is confidential and establishes requirements before information may be released under a court order. Provides that if a person presents a bracelet or identification card issued by the division to a law enforcement officer, then the law enforcement officer shall use all reasonable means necessary to ensure that: (1) a crisis intervention team trained officer assists in the investigation that the law enforcement officer is conducting; and (2) the person is placed in a mental health facility before being confined in a county jail, if applicable. Requires the division to work with the law enforcement training board in a collaborative manner to develop best practice recommendations in order to ensure improved outcomes when a law enforcement officer encounters a person with a mental illness, a substance addiction disorder, or both.

Barrett Law assessments for broadband development.

Allows a county or municipality to use Barrett Law assessments to fund projects for the deployment of broadband infrastructure in areas in which there is not at least one provider of terrestrial broadband Internet service.
