Rep. Robb Greene

Requires the office of the secretary of family and social services (office of the secretary) to: (1) study and prepare a report on applied behavior analysis (ABA) therapy services; and (2) not later than August 1, 2025, submit the report to specified entities, including the Indiana behavioral health commission (commission) and the general assembly. Specifies the information that must be in the report. Requires the commission to hold a public meeting to discuss the contents of the report and submit recommendations to the general assembly. Prohibits the office of the secretary from amending any Medicaid waiver or the Medicaid state plan to reduce or limit applied behavior analysis therapy services until the general assembly has reviewed the report and the commission's recommendations.

Provides for appointment to the board of the Indiana economic development corporation (IEDC) of two nonvoting, advisory members who are members of the general assembly. Requires the IEDC, before purchasing land that exceeds 100 acres in a county, to first give notice to the county or municipality, or both, in which the land is located not later than 30 days before the closing date for the purchase. Specifies additional procedures that the IEDC must take when acquiring land. Requires the IEDC to establish a mechanism to track the impacts of economic development projects based on: (1) wages paid to employees; and (2) financial impacts to local governments. Sets forth the information required to be reported on the tracking mechanism, which must be updated quarterly and posted quarterly on the IEDC's transparency portal. Requires the IEDC to provide an annual report of the information reported on the tracking mechanism and other information related to economic development to the general assembly. Requires the IEDC to dedicate at least 5% of the funds appropriated to the IEDC for economic development purposes in state fiscal years 2026 and 2027 for economic development projects located in communities that meet specified criteria.

Reenacts, and extends the expiration date of, the term "practitioner". Establishes a temporary license for behavior analysts and assistant behavior analysts. Establishes a temporary certification for behavior technicians. Makes conforming changes.

Provides that particular elected officials who are convicted of a crime violating public trust forfeit state retirement benefits. Specifies exceptions.

Requires the office of the secretary of family and social services to apply to the United States Department of Health and Human Services for an amendment to each home and community based services Medicaid waiver to exclude the income and resources of a spouse when determining an individual's eligibility for the waiver.

Provides that the Indiana economic development corporation, the state, any instrumentality of the state, or any other public authority, or any party negotiating on behalf of any of those entities, may not, after June 30, 2025, enter into an economic development agreement or contract that contains any provision, clause, or language that provides that the agreement or contract, or any of its terms, is confidential, or that the parties to the agreement or contract are prohibited from disclosing, discussing, describing, or commenting upon the terms of the agreement or contract.

Provides that a governmental entity operating an activity on land leased by the governmental entity from the federal government is entitled to certain immunities from a tort claim. Expands the definition of "extreme sport area" to include an obstacle course.

Amends the definition of "countable resources" for purposes of the Medicaid buy-in program (program). Removes consideration of income in determining an individual's eligibility for participation in the program. Requires the office of the secretary of family and social services (office of the secretary) to apply for a state plan amendment or waiver to implement this provision. Increases the maximum age to be eligible for participation in the program from 64 years of age to 67 years of age. Allows a recipient's participation in an employment network recognized by the federal Social Security Administration to qualify as participating with an approved provider of employment services. Changes the monthly maximum premium that a recipient must pay. Requires that the premium scale be promulgated by administrative rule. Allows the office of the secretary to annually review the premium amount that a recipient must pay in the program. (Current law requires annual review of the premium amount.) Specifies changes in circumstances that must result in an adjustment of the premium. Specifies that a recipient in the program is eligible for the same services as offered in the Medicaid program. States that an individual's participation in the program does not preclude the individual from participating in a Medicaid waiver program. Specifies that a recipient of the program may simultaneously participate in a Medicaid waiver program and requires the office of the secretary to individually determine eligibility for both programs based on the individual's medical need requirements.

Defines "antisemitism", specifies that the public policy of the state is to provide educational opportunities free of religious discrimination, and provides that antisemitism is discrimination on the basis of race, creed, religion, or national origin.

Defines "election worker" and makes it a Level 6 felony under certain circumstances to: (1) threaten an election worker; or (2) to obstruct, interfere with, or injure an election worker.
