Requires: (1) counties; and (2) municipalities that have police departments; to establish a citizen review board not later than December 31, 2023, to review complaints filed by citizens having personal knowledge of alleged misconduct by a police officer.
Permits a voter to register at the polls by completing a voter registration form and an affirmation that the individual has not voted elsewhere in the election and by providing proof of residence. Requires the ballot of a voter who registers at the polls to be treated as a provisional ballot.
Terminates the Gary Community School Corporation's (school corporation) status as a distressed political subdivision on June 30, 2024. Provides that the members of the governing body of the school corporation shall be elected at the municipal general election held on November 7, 2023, and take office upon taking the oath required by the Constitution of the State of Indiana not later than November 14, 2023. Requires the governing body to select a superintendent not later than February 1, 2024. Requires the emergency manager and chief financial officer to consistently inform the superintendent of the school corporation regarding the day to day operations of the school corporation. Requires the emergency manager to provide monthly financial and academic reports to the governing body. Provides that the current emergency manager's appointment terminates on June 30, 2024. Provides that the elected governing body assumes all powers, rights, duties, and obligations of the school corporation on July 1, 2024. Provides that, before the governing body sells real property, a building, or another structure owned by the school corporation, the governing body shall: (1) provide written notice to the mayor of the city of Gary at least 30 days before selling the real property, building, or other structure; and (2) provide public notice and hold at least one public hearing within the geographic boundaries of the school corporation to hear public testimony on the proposed sale. Transfers, not later than July 1, 2023, to the common school fund from the state general fund an amount sufficient to pay off all debts from advances and loans that were made to the school corporation from the common school fund. Removes or repeals provisions regarding the establishment and use of a school improvement fund.
Expands the definition of "employer", for purposes of civil rights enforcement, to include any person employing one or more persons within the state. (Current law defines "employer" to include any person employing six or more persons within the state.) Permits a civil rights action to be tried by a jury. Removes the requirement that both parties must consent before a civil rights claim is heard as a civil cause of action.
Requires a person who carries a handgun to obtain and continuously maintain a liability insurance policy that covers losses or damages resulting from the negligent or accidental use of the handgun. Makes the failure to do so a Class A misdemeanor, elevated to a Level 5 felony in some instances. Specifies exceptions.
Authorizes the town of Merrillville to impose a food and beverage tax.
Establishes billing procedures for municipal sewage or storm water user fees assessed for real property that is occupied by someone other than the owner. Provides that a lien does not attach for user fees assessed against real property occupied by someone other than the owner under certain circumstances. Requires the assessing entity to release certain liens and delinquent user fees upon receipt of a verified demand in writing from the owner.
Provides that a person who: (1) has been convicted of a crime of domestic violence; and (2) knowingly or intentionally possesses a firearm; commits a Class A misdemeanor. Specifies certain defenses. Requires a court to issue an order, upon entry of a judgment of conviction for domestic battery or a crime of domestic violence, that: (1) prohibits ownership or possession of a firearm; (2) requires the defendant to surrender: (A) any firearm owned or possessed by the defendant; and (B) any license or permit to carry a handgun (license); and (3) requires confiscation, within 72 hours, of any firearm or license owned or possessed by the defendant. Provides that a domestic batterer who knowingly or intentionally fails to surrender a certain firearm or license commits a Class A misdemeanor, enhanced to a Level 6 felony in specific instances. Provides certain defenses. Specifies how a confiscated firearm or license shall be returned or disposed of if a defendant's right to possess a firearm is restored. Defines certain terms. Makes conforming amendments.
Establishes the hunger-free campus grant program (grant program) to provide grants to state educational institutions for purposes of addressing food insecurity among students enrolled in state educational institutions. Provides that the commission for higher education (commission) shall provide a grant under the grant program to a state educational institution, if at least one campus is designated by the commission as a hunger-free campus. Establishes criteria that a campus of a state educational institution must meet in order to be designated a hunger-free campus. Makes an appropriation.
