FRESH START Through Bankruptcy Act

Fostering Responsible Education Starts with Helping Students Through Accountability, Relief, and Taxpayer Protection Through Bankruptcy Act of 2021 or the FRESH START Through Bankruptcy Act This bill revises the treatment of student loans in bankruptcy. The bill makes federal student loan debt dischargeable in a bankruptcy proceeding ten years after the first loan payment is due, in addition to being dischargeable at any time in cases of undue hardship, as under current law. Further, institutions of higher education that have at least one-third of their students receiving federal student loans must partially repay a student loan to the Department of Education if that loan is later discharged in bankruptcy. The amount the institution must repay is dependent on the institution's average rates of student loan default and repayment.

State and Local Cybersecurity Improvement Act

State and Local Cybersecurity Improvement Act This bill establishes a grant program administered by the Federal Emergency Management Agency (FEMA) for state, territorial, and tribal governments to address cybersecurity risks and threats to information systems. A grant applicant must submit a cybersecurity plan that assesses current efforts to address cybersecurity concerns and outlines grant-funded activities. FEMA may award grant funding to support the development of a plan. A grant recipient must make available at least 80% of funds to local governments with a particular focus on rural areas. The bill requires various reports concerning the grant program, including an assessment of cybersecurity needs of tribal governments. The Government Accountability Office must also study the program.

A bill to oppose the provision of assistance to the People's Republic of China by the multilateral development banks.

This bill requires the Department of the Treasury to instruct the U.S. executive directors at certain multilateral development banks, such as the Asian Development Bank, to oppose providing a loan, financial assistance, or technical assistance to China. The executive directors must also advocate and vote to end lending and assistance to a country that has exceeded certain income thresholds.

GIFTs in Higher Education Act

Greater Insight into Foreign Transactions in Higher Education Act of 2021 or the GIFTs in Higher Education Act This bill revises certain disclosure requirements for institutions of higher education (IHEs). Under current law, an IHE must disclose to the Department of Education (ED) a gift or contract from a foreign source that is valued at $250,000 or more, considered alone or in combination with all other gifts from or contracts with that foreign source. This bill extends the disclosure requirement to include faculty, professional staff, and all staff engaged in research and development at the IHE. Further, an IHE (including faculty and staff) must disclose to ED a gift or contract from a designated foreign adversary source that is valued at $50,000 or more, considered alone or in combination with all other gifts from or contracts with that foreign adversary source within a calendar year. The IHE must, within 30 days of receipt of the gift or contract, file a disclosure report with ED. ED must, within 30 days of submission, publish online these disclosure reports. Next, the bill requires each federal agency to ensure that no federal funds are distributed to an IHE that knowingly or willfully violates these disclosure requirements. The bill also prohibits an IHE that knowingly or willfully violates these disclosure requirements from receiving federal education funds, with an exception for federal student-aid program funding.

Residential Substance Use Disorder Treatment Act of 2021

Residential Substance Use Disorder Treatment Act of 2021 This bill revises and reauthorizes through FY2026 grants for residential substance use disorder treatment programs at state and local correctional and detention facilities. Among the revisions, the bill replaces statutory references to substance abuse with substance use disorder , specifies that the term residential substance use disorder treatment program includes a medication-assisted treatment program, requires the chief medical officer or other staff overseeing a program to complete training on the science of addiction and the latest research and clinical guidance on treating substance use disorders in criminal justice settings, and allows people who are awaiting trial or in pretrial detention to participate in the programs.

Medicare Orthotics and Prosthetics Patient-Centered Care Act

Medicare Orthotics and Prosthetics Patient-Centered Care Act This bill revises payment rules and establishes several requirements relating to coverage of orthotics and prosthetics under Medicare. Specifically, the bill requires suppliers of orthotics and prosthetics to meet certain standards with respect to licensure and accreditation, physical facilities, and liability insurance. Orthotists and prosthetists may also issue written orders for commercial purposes that meet specified standards; such orders must be signed by the treating physician. The bill also prohibits payment under Medicare for certain prosthetics and orthotics that are delivered via drop shipment (i.e., direct shipment to a beneficiary who has not received corresponding patient care from a health care practitioner).

Border Health Security Act of 2021

Border Health Security Act of 2021 This bill modifies the duties and activities of the United States-Mexico Border Health Commission and the Canada-United States Pan-Border Public Health Preparedness Council and makes other changes to address health issues along the U.S. border. Specifically, the commission must cooperate with the council where appropriate, and both the commission and the council must develop strategic plans, work plans, evaluations, and reports concerning their activities. The Department of Health and Human Services must award grants to (1) eligible entities in border areas to address recommendations of the commission and the council to improve the health of border area residents; and (2) trauma centers, public health entities, and state, local, or tribal entities for infectious disease surveillance activities in border areas. In addition, the Office of the Assistant Secretary for Preparedness and Response may coordinate with the Department of Homeland Security in establishing a system that alerts clinicians and public health officials to emerging health threats in border areas. The Government Accountability Office must evaluate commission and council activities every two years.

Affordable Prescriptions for Patients Act of 2021

Affordable Prescriptions for Patients Act of 2021 This bill prohibits product hopping by drug manufacturers, authorizes the Federal Trade Commission to enforce this prohibition, and imposes limits on patent litigation involving biological products. Generally, product-hopping describes a situation where, when the patents on a reference drug (or biological product) expire, the manufacturer switches to a follow-on product that is covered by a later-expiring patent. Under this bill, a follow-on product is a modified version of the reference drug that shares an indication (what the drug is used for) with the reference drug. The bill presumes product hopping has occurred when a reference drug manufacturer, after receiving notice that the Food and Drug Administration (FDA) has received an application to market a competing generic (or biosimilar) version, takes certain actions such as withdrawing the reference drug from the market and selling a follow-on product. A drug manufacturer may rebut these presumptions by demonstrating that its conduct was not intended to limit competition. The bill also limits in certain instances the number of patents that a reference biological product manufacturer can assert in a patent infringement lawsuit against a company seeking to sell a biosimilar version. Specifically, if the biosimilar manufacturer completes certain actions as part of an abbreviated pathway to get FDA market approval, the bill limits, subject to exceptions and waivers, the number of certain types of patents that the reference product manufacturer may assert, such as patents filed more than four years after the reference product received market approval.
