Sen. Ram Villivalam

Amends the Public Utilities Act. Provides that, for any general rate increase requested by a gas, electric, water, or sewer public utility under the provisions of the Act, the Commission shall hold at least one public hearing during which members of the public can provide input on the requested general rate increase. Provides that any affected ratepayer of a requested general rate increase may testify at the public hearing and may file statements that pertain to the subject matter of the public hearing with the person or persons conducting the public hearing. Provides that a public hearing shall be held in the service territory of the public utility that requested a general rate increase at a time and location to be determined by the Commission. Requires the Commission to comply with certain requirements when determining the location of a public hearing. Provides that the Commission shall provide reasonable notice that complies with the Open Meetings Act to members of the public regarding a public hearing. Provides that "reasonable notice" means notice that is provided at least 14 days before a public hearing. Provides that public hearings shall be conducted by the full Commission, a single commissioner, or an administrative law judge from the Commission. Provides that the Commission shall take into consideration any testimony or comments received from members of the public during the public hearing in its deliberations on the requested general rate increase. Makes other changes.

Amends the School Code. In provisions concerning the administration of asthma medication, epinephrine injectors, opioid antagonists, and oxygen, provides that "trained personnel" includes athletic coaches and trainers. Allows a pupil with asthma to self-administer and self-carry the pupil's asthma medication at a school-sponsored athletic practice or game. Allows a school nurse or trained personnel to administer undesignated asthma medication to a person at a school-sponsored athletic practice or game. Requires a school district, public school, charter school, or nonpublic school to maintain a supply of asthma medication in a secure location that is accessible before, during, and after school where a person is most at risk on account of physical activity. Requires at least one member of an athletic coach's staff at a school and any athletic trainers at that school to complete the training curriculum relating to the administration of undesignated asthma medication.

Creates the Charitable Organization Beneficiary Act. Requires a holder of property in which a charitable organization that is exempt from taxation as a 501(c)(3) entity is a designated beneficiary in a nonprobate instrument (excluding wills or trusts) to notify each charitable organization within 30 business days that it may have a right to the property. Creates a process in which the charitable organization may request that it be given information about the property or that the property be delivered to the charitable organization or both. Provides duties and obligations of the holder of the property. Provides the holder of the property protection from liability for a good faith reliance on the information it receives from a designated beneficiary. Provides remedies against a holder of property for a failure or refusal to provide the requested information or transfer of property if the provisions of the Act are followed. Defines terms.

Amends the Motor Vehicle Franchise Act. Provides that it shall be deemed a violation for a manufacturer, a distributor, a wholesaler, or other specified entity to distribute new motor vehicles directly to consumers or to circumvent franchise distribution obligations under the Act. Provides that it shall be deemed a violation for any manufacturer with an established franchise dealer network in the State to engage in the sale, lease, or servicing of new motor vehicles in a manner that bypasses or competes with the manufacturer's existing franchisee network. Makes conforming and other changes. Defines terms.

Expands the list of information that must be provided in the affordable housing plan to include, (i) an identification of "specific lands" (rather than "lands") within the jurisdiction that are most appropriate for the construction of affordable housing, (ii) proposed timelines to commence "specific actions and deadlines" (rather than "actions") to implement the components of the affordable housing plan, and (iii) incentives, including certain measures to address the need for affordable housing, that the local government may provide for the purpose of attracting affordable housing. In a provision permitting certain persons to appeal a local government's denial of a proposed affordable housing plan, expands the list to include a service provider that is under contract to provide services for potential residents of a proposed supportive housing project or community-integrated living arrangement that is included in the proposed affordable housing plan. Contains provisions concerning final actions or decisions by the governing body of the local government on the proposed affordable housing plans; appeal procedures and timelines; and other matters. Expands the Illinois Housing Development Authority's rulemaking authority to include the adoption of rules and regulations concerning the substance of affordable housing plans consistent with the changes made in the amendatory Act.

Creates the Transportation Network Driver Labor Relations Act. Defines "transportation network driver" as an individual who operates a motor vehicle that: (i) is owned, leased, or otherwise authorized for use by the individual; (ii) is not a taxicab or for-hire public passenger vehicle; (iii) is used to provide transportation network company services; and (iv) operates under the license of a transportation network company. Provides that transportation network drivers have the right of self-organization, to form, join, or assist transportation network driver organizations, and to bargain collectively. Sets forth provisions concerning unfair work practices; the prevention of unfair work practices; the designation of bargaining representatives; administrative fees; bargaining, impasse resolution procedures, and final determinations by the Department of Labor; applicability of other labor standards; rulemaking; and public records. Amends the Freedom of Information Act and the Labor Dispute Act to make conforming changes. Effective immediately.

Provides that the Board shall establish a Funding Formula Review Panel tasked with studying and reviewing topics pertaining to the implementation and impact of the funding formula. Contains provisions concerning the Board's annual budget request and the collection of data. Amends the Board of Higher Education Act. Removes certain provisions concerning budget proposals. Effective immediately.
