USE/OCC TAX-PENALTIES

Amends the Use Tax Act, the Service Use Tax Act, the Service Occupation Tax Act, and the Retailers' Occupation Tax Act. In provisions setting forth criminal penalties for failure to file a return and for filing a fraudulent return, provides that: (i) when the amount due is under $300, the person is guilty of a Class 4 felony; (ii) when the amount due is at least $300 but less than $1,000, the person is guilty of a Class 3 felony; and (iii) when the amount due is at least $1,000, the person is guilty of a Class 2 felony. Creates the offense of tax evasion. Provides that a person commits the offense of tax evasion when he knowingly attempts in any manner to evade or defeat the tax imposed on him or on any other person, or the payment thereof and he commits an affirmative act in furtherance of the evasion. Provides that two or more acts of tax evasion may be charged as a single count in any indictment, information, or complaint and the amount of tax deficiency may be aggregated for purposes of determining the amount of tax which is attempted to be or is evaded and the period between the first and last acts may be alleged as the date of the offense. Sets forth criminal penalties for the offense of tax evasion.

INTERNET DATING SAFETY ACT

Creates the Internet Dating Safety Act. Requires Internet dating services offering services to Illinois members to provide a safety awareness notification to all Illinois members. Provides that if an Internet dating service does not conduct criminal background screenings on its members, the service shall disclose, clearly and conspicuously, to all Illinois members that the Internet dating service does not conduct criminal background screenings. Provides that an Internet service provider does not violate the Act solely as a result of serving as an intermediary for the transmission of electronic messages between members of an Internet dating service. Provides that the Attorney General, pursuant to the Illinois Administrative Procedure Act, shall adopt rules and regulations to effectuate the purposes of the Act. Amends the Consumer Fraud and Deceptive Business Practices Act. Provides that it is an unlawful practice under the Consumer Fraud and Deceptive Business Practices Act for an Internet dating service to fail to provide notice or falsely indicate that it has performed criminal background screenings in accordance with the Internet Dating Safety Act. Effective immediately.

LIQUOR - UNDERAGE DRINKING

Amends the Liquor Control Act of 1934. Provides that any person shall be guilty of a Class A misdemeanor where he or she permits, allows, or hosts a gathering of 2 or more persons at a residence which he or she occupies or any other private property, public place, or premises under his or her control where any one or more of the persons is under 21 years of age and (1) the person occupying the residence or controlling the private property, public place, or premises knows or reasonably should know that any such person under the age of 21 is in possession of or is consuming any alcoholic beverage; and (2) the possession or consumption of the alcohol by the person under 21 is not otherwise permitted by the Act. Provides that in addition to being guilty of a Class A misdemeanor, the sentence of any person who violates the provisions of the amendatory Act shall include, but shall not be limited to, a fine of not less than $500. Provides that where the violation directly or indirectly results in great bodily harm or death to any person, the person who committed the violation shall be guilty of a Class 4 felony. Provides that a person shall not be in violation of the provisions of the amendatory Act if (A) he or she requests assistance from the police department or other law enforcement agency to either (i) remove any person who refuses to abide by the person's performance of the duties imposed by the amendatory Act or (ii) terminate the gathering because the person has been unable to prevent persons under the age of 21 years from consuming alcohol despite having taken all reasonable steps to do so and (B) this assistance is requested before any other person makes a formal complaint to the police department or other law enforcement agency about the gathering. Makes other changes.

HIGHER ED-RELIGIOUS OBSERVANCE

Amends the University Religious Observances Act. Provides that any student in an institution of higher learning, other than a religious or denominational institution of higher learning, who is unable, because of his or her religious beliefs, to attend classes or to participate in any examination, study, or work requirement on a particular day shall be excused from any such examination, study, or work requirement and shall be provided with an opportunity to make up the examination, study, or work requirement that he or she may have missed because of such absence on a particular day; provided that the make-up examination, study, or work does not create an unreasonable burden upon the institution. Prohibits fees of any kind from being charged by the institution for making available to the student such an opportunity. Provides that no adverse or prejudicial effects shall result to any student because of his or her availing himself or herself of these provisions. Requires publication of these provisions.

VOLUNTARY PAYROLL DEDUCTIONS

Amends the Voluntary Payroll Deductions Act of 1983. Reduces the number of designations that must be made on behalf of an organization by employees or State annuitants in order for that organization to qualify to receive payments through payroll deductions under the Act. Authorizes the designations to be submitted electronically or in writing (now, the designations must be submitted in writing).

HUMAN TRAFFICKING LIMITATIONS

Amends the Criminal Code of 1961. Provides that the statute of limitations for a prosecution for involuntary servitude, involuntary sexual servitude of a minor, or trafficking in persons for forced labor or services may be commenced within one year of the victim attaining the age of 18 years. Provides that in no case shall the time period for prosecution of those offenses expire sooner than 3 years after the commission of the offense. Includes in the offense of involuntary servitude using a scheme, plan, or pattern intended to cause the person to believe that, if the person did not perform that labor or services, that person or another person would suffer serious harm or physical restraint. Amends the Code of Criminal Procedure of 1963. Provides that in prosecutions for involuntary servitude, involuntary sexual servitude of a minor, and trafficking in persons, when the offense involves sexual activity, the prior sexual activity or the reputation of the alleged victim or corroborating witness is inadmissible except under certain circumstances. Amends the Sex Offender Registration Act. Includes in the definition of "sex offense" trafficking in persons, involuntary servitude, and related offenses, provided the offense involved commercial sexual activity, a sexually-explicit performance, or the production of pornography. Also includes in the definition of "sex offense", involuntary sexual servitude of a minor.

EPA-WASTE DISPOSAL OPERATIONS

Amends the Environmental Protection Act. Provides that, except as otherwise provided in the Act, no person other than the State of Illinois, its agencies and institutions, or a unit of local government shall own or operate (rather than conduct) any waste disposal operation on or after March 1, 1985, which requires a specified permit, unless that person has posted with the Agency a performance bond or other security. Provides that, on and after the effective date established by the USEPA for MSWLF units to provide financial assurance under Subtitle D of the Resource Conservation and Recovery Act, no person, other than the State of Illinois, its agencies and institutions, shall own or operate (rather than conduct) any disposal operation at a MSWLF unit that requires a specified permit, unless that person has posted with the Agency a performance bond or other security. Effective immediately.
