Amends provisions of the Illinois Marriage and Dissolution of Marriage Act concerning maintenance. Adds language providing that the court shall first determine whether a maintenance award is appropriate, using factors already in the statute. Provides that, if a court determines that a maintenance award is appropriate, the court shall order maintenance either: in accordance with guidelines involving the income of the parties and the length of the marriage; or after the court's consideration of relevant factors already in the statute. Provides that, in a case involving the issue of maintenance, the court shall make specific findings of fact stating the reasoning for awarding or not awarding maintenance, including references to factors already in the statute, and, if the court deviates from otherwise applicable guidelines, stating the amount of maintenance (if determinable) or duration that would have been required under the guidelines and the reasoning for any variance from the guidelines. Defines "gross income", for purposes of calculating maintenance obligations, as "all income from all sources", as that phase is used in calculating net income for purposes of calculating child support. Provides that, unless the parties otherwise agree, the court may not order unallocated maintenance and child support in a dissolution judgment or a post-dissolution order, but the court may order unallocated maintenance and child support in a pre-dissolution temporary order. Adds headings to existing subsections. In provisions of the Act concerning the determination of child support, provides that obligations pursuant to a court order for maintenance in the pending proceeding actually paid or payable to the same party to whom child support is to be payable shall be deducted from net income.

Amends the Code of Criminal Procedure of 1963. Provides that a defendant convicted in a criminal prosecution whose conviction is reversed on final appeal or by a finding of factual innocence in a collateral proceeding such as habeas corpus or post-conviction relief under Article 122 of this Code is not liable for any costs or fees of the court or circuit clerk's office, or for any charge of subsistence while detained in custody. Provides that if the defendant has paid any costs, fine, or fees, in the case, the clerk or judge shall give him or her a certificate of the payment of those costs, fine, or fees with the items of those expenses, which, when audited and approved according to law, shall be refunded to the defendant.
Amends the Probate Act of 1975. Provides that provisions barring certain persons from receiving any property, benefit, or other interest by reason of the death of an elderly person or person with a disability apply also to persons who have been found liable for financial exploitation, abuse, or neglect of an elderly person or a person with a disability by a preponderance of evidence in a civil proceeding. Provides that a civil action against a person for financial exploitation, abuse, or neglect of an elderly person or a person with a disability may be brought after the death of the victim or during the lifetime of the victim if the victim is adjudicated disabled. Provides that the court may, in its discretion, consider such facts and circumstances as it deems appropriate to allow the person found liable for financial exploitation, abuse, or neglect of an elderly person or a person with a disability to receive a reduction in interest or benefit rather than no interest or benefit.
Amends the Illinois Holocaust and Genocide Commission Act. Provides that the President and Minority Leader of the Senate shall each designate a member or former member of the Senate and the Speaker and Minority Leader of the House of Representatives shall each designate a member or former member of the House of Representatives to advise the Commission. Provides that upon the expiration of the terms of the initial members, the appointing authority may re-appoint initial members and sets forth the terms of those re-appointments. Provides that a representative under the Act must be an officer or employee of the State agency that employs the ex officio member or an individual with demonstrated expertise in the subject matter of the ex officio member's State agency. Effective immediately.
Creates the Best Candidate for the Job Act. Provides that an employer may not inquire into or require disclosure of a job applicant's criminal record or criminal history before the candidate has been notified that the candidate has been selected for a job interview or has been offered a conditional offer of employment. Requires consideration of the nature and gravity of a candidate's conviction record, the time elapsed since the conviction, and whether the conviction has a direct bearing on the candidate's fitness before excluding a candidate. Authorizes civil remedies. Provides that the Department of Labor may impose penalties for violations. Effective January 1, 2015.
Amends the Critical Health Problems and Comprehensive Health Education Act. Provides that training on how to properly administer cardiopulmonary resuscitation and how to use an automated external defibrillator shall be included as a basis for health education curricula in all secondary schools in this State and shall be a prerequisite to receiving a high school diploma. Effective July 1, 2014.
Amends the Video Gaming Act. Defines "Video Gaming Board Exclusion List". Provides that the Gaming Board shall have authority to establish and place persons on the Video Gaming Board Exclusion List. Establishes the grounds for which the Board may place a person on the Exclusion List, and that persons on the Exclusion List shall be prohibited from licensure under the Act and from engaging in any activities, agreements, or transactions authorized under the Act. Provides that the Board may place a person on the Exclusion List when that person has been found to be in violation of the Act by a final administrative decision of the Board or by a final decision of a court. Further provides that the Board may place a person on the Exclusion List when that person's conduct or reputation is such that his or her licensure under the Act or engagement in activities, agreements, or transactions authorized by the Act may, in the opinion of the Board, call into question the honesty and integrity of video gaming operations or interfere with the orderly conduct of such operations. Provides that the placement of a person on the Exclusion List shall be subject to subsequent hearing by the Board. Effective immediately.
