AGING-DPH-HFS-OLDER ADULT SRVC

Amends the Older Adult Services Act. In provisions concerning the development of a plan to restructure the State's service delivery system for older adults, provides that the Department on Aging and the Departments of Public Health and Healthcare and Family Services shall develop the plan no later than September 30, 2010. Provides that the plan shall protect the rights of all older Illinoisans to services based on their health circumstances and functioning level, regardless of whether they receive their care in their homes, in a community setting, or in a residential facility. Provides that financing for older adult services shall take into account individual preference but shall not jeopardize the health, safety, or level of care of nursing home residents. Effective immediately.

STRUCTURAL PEST CONTROL ACT

Amends the Structural Pest Control Act. Defines "person" to also mean any public school or any licensed day care center. Provides that only a person who is certified or licensed as a structural pest control technician by a contiguous state or the federal government may apply for reciprocal certification without an examination by the Department in those sub-categories or areas for which the applicant holds certification or licensure. Provides that the Department shall adopt rules for any examinations required for the proper administration of the Act, including any category or sub-category examination involving the use of general or restricted use pesticides and any examination which may be required under certain categories specified in the rules adopted by the Department of Agriculture in the Illinois Administrative Code. Provides that any fine that remains unpaid 60 days after receiving notice from the Department may be submitted to any other public or private agency for collection of the amounts owed plus any fees and costs incurred during the collection process (now, may only be submitted to the Attorney General's Office). Provides that only the Department of Public Health and any local health department shall not be required to pay any fees, nor shall the employees thereof engaged in pest control activities in their official capacity be required to pay any fees for examination, certification, or renewal of certification (now, the State, any agency thereof, or any local unit of government). Makes changes in provisions concerning definitions, license or registration renewal, renewal of technician certification, violations, notification, and penalty. Makes other changes. Effective immediately.

ELECTRONIC RECORDS ACT

Creates the Government Electronic Records Act. Authorizes and requires the use of electronic records in the executive branch, rather than hard copy, if appropriate. Sets forth exceptions and opt-out provisions. Requires the adoption of rules. Amends the State Records Act concerning retention of electronic records. Effective July 1, 2011.

MERCURY THERMOSTAT COLLECTION

Creates the Mercury Thermostat Collection Act. Requires thermostat manufacturers to establish an out-of-service mercury thermostat collection program that meets certain requirements. Requires thermostat manufacturers to submit certain reports on their collection programs to the Agency. Sets goals for the collection of out-of-service mercury thermostats. Provides that if those goals are not met, then the manufacturers must revise their collection programs as necessary to achieve the applicable goal. Requires contractors, service technicians, thermostat wholesalers, thermostat manufacturers, and thermostat retailers to handle and manage out-of-service mercury thermostats in a manner that is consistent with the provisions of the universal waste regulations adopted by the Illinois Pollution Control Board. On and after January 1, 2011, prohibits (i) thermostat wholesalers from selling, offering to sell, distributing, or offering to distribute thermostats unless certain requirements are met and (ii) contractors from removing, replacing, or otherwise taking mercury thermostats out of service unless the contractors deliver those thermostats to a collection site. On and after January 1, 2011, prohibits thermostat manufacturers that are in violation of the Act from selling, offering to sell, distributing, or offering to distribute thermostats in the State. Requires the Agency to post certain information on its website and to report certain information to the General Assembly. Provides for prosecution by the Attorney General or the State's Attorney of the county in which a violation occurs. Requires the Agency to make certain recommendations to the Governor and General Assembly by January 1, 2012. Effective immediately.

INC TX-HOUSING CREDIT-EXTEND

Amends the Illinois Income Tax Act. Extends the credit for affordable housing donations through the taxable year ending on December 31, 2016 (instead of 2011). Effective immediately.

EPA-LEAD/MERCURY-TIRE WEIGHTS

Amends the Environmental Protection Act. Provides that, on and after January 1, 2011, a person may not (i) use a weight or other product to balance a vehicle wheel or tire if the weight or other product contains lead or mercury or (ii) sell, offer to sell, distribute, or offer to distribute a weight or other product for balancing a vehicle wheel or tire if the weight or other product contains lead or mercury. Also provides that, on and after January 1, 2012, a person may not sell a new vehicle equipped with a weight or other product used to balance a vehicle wheel or tire if the weight or other product contains lead or mercury. Effective immediately.

ID CARDS--NON-EXISTENT ADDRESS

Amends the Illinois Identification Card Act. Provides that information concerning a non-existent address used to obtain an identification card is false information for the purposes of a particular provision of the Act. Amends the Illinois Vehicle Code. Provides that information concerning a non-existent address used to obtain a driver's license or permit is false information for the purposes of a particular provision of the Code. Also makes technical changes.

SCH CD MANDATE WAIVER REPORT

Encourages the General Assembly to promptly review and evaluate the Report on Waiver of School Code Mandates filed by the State Board of Education to determine if the Report should be disapproved in whole or in part.
