Amends the Probate Act of 1975. Requires that a guardian ad litem in a petition seeking a guardianship of an adult with alleged disability to inquire with the respondent before the hearing on whether a supported decision-making agreement is an appropriate alternative to guardianship or a limited guardianship is an appropriate alternative to plenary guardianship. Requires that the court make the same inquiry at the hearing and advise the respondent of the right to modify an adjudication of disability using a limited guardianship or termination of guardianship with a supported decision-making agreement. Amends the Supported Decision-Making Agreement Act. Allows the existence of a supported decision-making agreement to be entered into evidence for purposes other than as evidence of capacity or incapacity. Requires that a support decision-making agreement must be written in plain language and include the following: (1) a list of the areas in which both the principal requests support and the supporter agrees to provide support; (2) the supporter's agreement that the supporter is not disqualified from acting as a supporter under the Act; (3) the supporter's agreement that the supporter will complete the training required by the Act; (4) a statement that a supporter is not authorized to make a decision for the principal; and ( 5) information about how to report suspicion that an adult with a disability is being abused, neglected, or exploited by the supporter. Requires that a supported decision-making agreement must be signed by the principal and each supporter. Provides that the principal may use reasonable modifications, such as assistive technology or physical assistant, to sign the agreement. Provides that a supported decision-making agreement should be reviewed by the principal and all supporters every 2 years and, updated as needed, in the same manner as an initial supported decision-making agreement is executed. Amends the Illinois Lottery Law. In a provision concerning a scratch-off for the benefit of Illinois veterans, provides that the 3-member funding authorization committee appointed by the Director of Veterans Affairs shall meet twice a year (instead of on a quarterly basis), at minimum.
Amends the Educator Licensure Article of the School Code. Allows the State Superintendent of Education to issue a short-term approval for a paraprofessional educator to an individual who does not meet the requirements necessary for issuance of an Educator License with Stipulations with a paraprofessional educator endorsement. Provides that the short-term approval authorizes an individual to serve as a paraprofessional educator in a school district, including a charter school, or a State-operated program, with the short-term approval expiring on June 30 immediately following the third full fiscal year after the approval was issued without renewal. Provides that upon expiration of the short-term approval, the State Superintendent of Education shall issue an Educator License with Stipulations with a paraprofessional educator endorsement to the individual if the individual meets specified requirements.
Amends the Children with Disabilities Article of the School Code. Provides that "school psychologist" means a psychologist who, along with other qualifications, has graduated with a specialist degree, an equivalent degree with the completion of a minimum of 60 graduate semester hours, or a higher degree in school psychology (rather than a master's degree or higher degree in psychology or educational psychology) from an institution of higher learning and has had at least 1,200 clock hours of supervised experience (rather than one school year of full-time supervised experience) in the delivery of school psychological services. Makes changes to provide that school psychological services provided by qualified specialists who hold a Professional Educator License endorsed for school psychology may include, but are not limited to: (1) providing assessments; (2) creating and implementing prevention and intervention services that support student learning; (3) providing mental and behavioral health services; (4) acting as liaisons between public schools and community agencies; (5) evaluating program effectiveness; (6) providing crisis prevention, response, and intervention within the school setting; (7) providing consultation and collaboration; (8) supervising school psychologist interns enrolled in school psychology programs; (9) screening school enrollments to identify children who should be referred for individual study; and (10) developing any other necessary programs and services. Provides that a school psychologist may not provide school psychological services outside of his or her employment to any student in any school district that employs the school psychologist. Makes other changes.
Amends the Genetic Information Privacy Act. Provides that the use of genetic testing, biomarker testing, or both (rather than only genetic testing), and the information derived from testing is confidential and privileged and may be released only to the individual tested and persons specifically authorized in writing by the individual tested to receive the information. Provides that an insurer may not seek information derived from genetic or biomarker testing (rather than only genetic testing) for use in connection with a policy of accident or health insurance (unless the individual voluntarily submits the results and the results are favorable to the individual), for nontherapeutic purposes, or for underwriting purposes. In provisions concerning the use of testing information by employers, provides that an employer may release genetic testing or biomarker testing information (rather than only genetic testing information) under specified circumstances. Limits an employer's use of genetic information, genetic testing, biomarkers, and biomarker testing (rather than only genetic information and genetic testing). In provisions concerning testing, provides that no person may disclose or be compelled to disclose the identity of any person upon whom a genetic test or biomarker test (rather than only genetic test) is performed or the results of a genetic test or biomarker test (rather than only genetic test) in a manner that permits identification of the subject of the test, except to the persons specified in the Act. Limits the concurrent exercise of home rule powers. Defines "biomarker" and "biomarker testing". Makes other and conforming changes.
Creates the Companion Animal Custody Equity Act. Provides that in a possession dispute involving a companion animal, a court may consider the well-being of the companion animal regardless of the marital status of the parties. "Companion animal" means a domesticated dog or cat that resides in a household. Authorizes the court to issue temporary possession or caregiving orders, including limited visitation, if necessary to reduce stress or disruption to the companion animal. Provides that for companion animals 10 years of age or older, courts may give additional consideration to factors including continuity of environment, emotional stability, stress minimization, and maintenance of established routines. Provides that a court may, if appropriate, order mediation between the parties to resolve issues related to companion animal possession.
Amends the Chicago Teacher Article of the Illinois Pension Code. Requires charter schools and contract schools to retain all payroll records and contribution information for a minimum of 5 years after the payroll records and contribution information are created. Effective immediately.
Amends the State Employees Group Insurance Act of 1971, the Counties Code, the Illinois Municipal Code, the School Code, the Health Maintenance Organization Act, the Limited Health Service Organization Act, the Voluntary Health Services Plans Act, and the Illinois Public Aid Code to require coverage for eye medication under the provisions of those Acts pursuant to the Topical Eye Medication Prescription Act.
Amends the Missing Persons Identification Act. Provides that, if a missing person remains missing for 30 days after the date of the police report (rather than 60 days after the date of the police report and missing for 60 days after the date of the police report in the National Missing and Unidentified Persons System (NamUs)), then the missing person's dental record shall be added to the missing person entry in the Law Enforcement Agencies Data System (LEADS). Provides that, if a missing person remains missing for 60 days after the date of the police report, then the missing person's dental record shall be entered in the National Missing and Unidentified Persons System (NamUs).
Amends the Regional Superintendent of Schools Article of the School Code. With respect to the requirement that institutes provide instruction on trauma-informed practices and include the definitions of trauma, trauma-responsive learning environments, and whole child before the first student attendance day of each school year, makes changes to the definitions of "trauma" and "trauma-responsive learning environments". Defines "trauma-informed practices" to include awareness of populations for whom trauma may be ongoing, relational, and developmentally expressed over time. Effective immediately.
