Amends the Illinois Vehicle Code. Provides that the driver of a vehicle overtaking a bicycle or individual proceeding in the same direction on a highway must maintain a distance of at least 3 feet between the vehicle and the bicycle or individual. Provides that a bicycle rider may signal a right turn by extending his or her right hand horizontally and to the right side of the bicycle. Provides that the rider of a bicycle or a motorized pedal cycle shall ride as close to the right-hand curb or edge as practicable and safe (rather than as close as practicable), except in specified circumstances. Provides that, in addition to the existing exceptions, the rider is not required to ride as close to the right-hand curb or edge as practicable and safe when the rider is approaching a place where a right turn is authorized.

Amends the Senior Citizens and Disabled Persons Property Tax Relief and Pharmaceutical Assistance Act. In provisions concerning pharmaceutical assistance effective January 1, 2006, provides that Eligibility Group 5 consists of beneficiaries who are otherwise described in Eligibility Groups 2 and 3 who have a diagnosis of HIV or AIDS (instead of who are otherwise described in Eligibility Group 1 and have such a diagnosis). Defines "covered prescription drug" for persons in Eligibility Group 5 according to whether they are otherwise described in Eligibility Group 2 or in Eligibility Group 3. Provides that individuals in Eligibility Group 1, 2, 3, 4, or 5 (instead of in Eligibility Group 3 or 4) may opt to receive a $25 monthly payment in lieu of direct prescription drug coverage. Effective immediately.

Amends the Hospital Licensing Act. Provides that every hospital must adopt policies and procedures to ensure that, in making decisions concerning the treatment of a patient at the hospital, health care professionals must take into account the patient's religious beliefs.

Amends the Criminal Code of 1961. Provides that in the offenses of soliciting for a juvenile prostitute, keeping a place of juvenile prostitution, and juvenile pimping the prostitute must be under 17 years of age (rather than under 16 years of age).

Creates the Smoke Free Illinois Act. Sets forth the findings of the General Assembly. Creates several definitions. Prohibits smoking in public places, places of employment, and governmental vehicles. Requires "No Smoking" signs to be posted in each public place and place of employment where smoking is prohibited. Requires ashtrays to be removed from any area where smoking is prohibited. Prohibits smoking in student dormitories, including, but not limited to, sleeping rooms, dining areas, restrooms, laundry areas, lobbies, and hallways, of a building used in whole or in part as a student dormitory that is owned and operated or otherwise utilized by a public or private institution of higher education. Provides that the Department of Public Health, State-certified local public health departments, and local law enforcement agencies shall enforce the provisions of the Act. Sets forth fines for violations of the Act. Provides that the Department, a State-certified local public health department, local law enforcement agency, or any individual personally affected by repeated violations may institute, in a circuit court, an action to enjoin violations of the Act. Prohibits discrimination against individuals who exercise their rights afforded by the Act. Provides that a home rule unit may regulate smoking in public places, but that regulation must be no less restrictive than the provisions in the Act. Prohibits smoking within a minimum distance of 15 feet from entrances, exits, windows that open, and ventilation intakes that serve an enclosed area where smoking is prohibited. Amends the State Mandates Act to require implementation without reimbursement. Repeals the Illinois Clean Indoor Air Act.

Amends the Protection and Advocacy for Mentally Ill Persons Act. Makes a technical change in a Section concerning the short title.

Encourages the Department of Public Health, the Department of Healthcare and Family Services, the Department of Human Services, and the Department of Financial and Professional Regulation to address pain management issues.

Resolves that the Illinois House of Representatives is committed to the goal of providing breast cancer screening services to every low-income and uninsured woman in the State of Illinois and commends those thousands of Illinois breast cancer advocates and survivors who are fighting to achieve this goal.

Mourns the death of Dr. James Barushok of Northeastern Illinois University.

Amends the Vital Records Act. Adds a definition of "medical treatment". Provides that the State Registrar of Vital Records shall establish a new certificate of birth when he or she receives an affidavit by a physician that a person has undergone medical treatment and that by reason of the medical treatment the sex designation on such person's birth record should be changed (now, an affidavit by a physician that he has performed an operation on a person, and that by reason of the operation the sex designation on such person's birth record should be changed). Effective immediately.
