MERCURY SWITCH REMOVAL

Creates the Mercury Switch Removal Act. Provides that mercury switches removed from end-of-life vehicles must be managed in accordance with the Environmental Protection Act and regulations adopted thereunder. Requires vehicle recyclers, vehicle crushers, and scrap metal recyclers that remove mercury switches to maintain certain records and make reports relating to the mercury switches removed. Requires manufacturers of vehicles in Illinois that contain mercury switches to begin a mercury switch collection program, within 60 days of the effective date of this Act, that facilitates the removal of mercury switches from end-of-life vehicles prior to the vehicles being flattened, crushed, shredded, or otherwise processed for recycling. Sets forth that these programs must, to the extent practicable, use the currently available vehicle recycling infrastructure and be designed to achieve a capture rate of not less than (i) 35% for the period of July 1, 2006, through June 30, 2007; (ii) 50% for the period of July 1, 2007, through June 30, 2008; and (iii) 70% for the period of July 1, 2008, through June 30, 2009 and for each subsequent period of July 1 through June 30. Sets forth certain requirements for these collection programs including that each manufacturer adopt an implementation plan for their mercury switch collection program. Provides that if the required capture rates are not met, the Agency shall provide notice to the manufacturers subject to the collection requirements, and that beginning 30 days after the Agency first provides notice, a vehicle recycler that sells, gives, or otherwise conveys an end-of-life vehicle to an on-site or off-site vehicle crusher or a scrap metal recycler must remove all mercury switches from the vehicle prior to its conveyance, and that manufacturers subject to these collection requirements must provide to vehicle recyclers, vehicle crushers, and scrap metal recyclers (i) $2.00 for each mercury switch removed by the vehicle recycler, vehicle crusher, or the scrap metal recycler, (ii) the costs of the containers in which the mercury switches are collected, and (iii) the costs of packaging and transporting the mercury switches off-site. Provides civil penalties for violations of the Act. Authorizes periodic reviews of these programs. Repeals the Act on January 1, 2018. Contains other provisions. Effective immediately.

CONDOMINIUM PROP-LATE FEES

Amends the Condominium Property Act. Permits condominium bylaws to provide for late fees for the delinquent payment of condominium assessments. Provides that the late fees may not exceed the greater of $25 or 10% of the amount due and may not be charged more than once for the same late payment.

CRIM PRO-CAP LIT BUDGET

Amends the Code of Criminal Procedure of 1963. Provides that in a case in which the State has filed a statement of intent to seek the death penalty, the court shall require appointed counsel, after counsel has had adequate time to review the case, to submit a proposed estimated litigation budget for court approval that will be subject to modification in light of facts and developments that emerge as the case proceeds. Provides that the budget shall be incorporated into a sealed initial pretrial order that reflects the understandings of the court and counsel regarding all matters affecting counsel compensation and reimbursement and payments for investigative, expert and other services. Provides that the court shall not authorize payment of bills to appointed trial counsel that are not properly itemized.

ATTORNEY ACT-LEGAL SERVICES

Amends the Attorney Act. Provides that no entity shall receive any compensation directly or indirectly for any legal services other than a regular licensed attorney. Provides that an unlicensed person or entity may not advertise or hold himself, herself, or itself out to provide legal services or own, conduct, or maintain a facility to provide legal services. Provides that a person or entity advertising or holding himself, herself, or itself out to provide legal services is guilty of contempt of court.

ANIMAL POPULATION CONTROL ACT

Creates the Illinois Public Health and Safety Animal Population Control Act. Requires the Department of Public Health to develop and administer a program of reimbursements to veterinarians for the sterilization and rabies vaccination of the dogs and cats of low-income owners and feral cat colony caretakers. Requires a co-payment by the owner or feral cat colony caretaker. Funds the program through a voluntary individual income tax checkoff and a $3 fee on each rabies vaccination required by the Animal Control Act. Authorizes administrative fines for violations of the program. Amends the State Finance Act to create the necessary special fund within the State treasury and amends the Illinois Income Tax Act to establish the checkoff. Amends the Animal Control Act. Requires (now, authorizes) a county board to require the registration of dogs and cats. Imposes a $100 fine for failure to register. Requires that the fine be divided between the local animal control fund and the Illinois Public Health and Safety Animal Population Control Fund. Amends the State Mandates Act to require implementation without reimbursement. Effective immediately.

CDB - LEED GREEN BUILDING

Amends the Capital Development Board Act. Requires the Board to implement the LEED green building rating system. Requires any new building, repair, or retrofit construction work authorized by the Board to meet the requirements for LEED certification. Defines "LEED" and "LEED green building rating system". Effective January 1, 2006.
