WILDLIFE-REMOTE HUNTING

Amends the Wildlife Code. Provides that a person may not operate, provide, sell, use, or offer to operate, provide, sell, or use any computer software or service that allows a person not physically present at the hunt site to remotely control a weapon that could be used to take wildlife by remote operation. Sets out criminal penalties for violation of the Act. Effective immediately.

PREVAIL WAGE-SUBSTANCE ABUSE

Amends the Prevailing Wage Act. Provides that an employee may not use, possess, attempt to possess, distribute, deliver, or be under the influence of cannabis or a controlled substance, or use or be under the influence of alcohol, while performing work on a project covered by the Act. Requires an employer to have a substance abuse prevention program in place with specified elements. Provides for discipline of employees upon reasonable suspicion that the employee is in the possession of or under the influence of alcohol or drugs. Contains provisions regarding: drug and alcohol testing; presence of employees on job sites; employees commencing or returning to work under specified circumstances; rehabilitation programs; applicability; and other matters. Effective January 1, 2008.

VEH CD-SOS-HEARINGS

Amends the Illinois Vehicle Code. Provides that a petition to contest the imposition of a suspension of a person's driving privileges because of the person's refusal to undergo testing for alcohol, drugs, or intoxicating compounds, or because drugs, intoxicating compounds, or alcohol in excess of the legal limit were found in the person's blood, breath, or urine, must be filed within 90 days after the effective date of the suspension. Provides that if a petition is withdrawn, it must be refiled in 90 days. Provides that a petition that has been withdrawn more than twice may not be refiled. Provides that a person whose license has been suspended may subpoena the arresting officer or any other law enforcement officer who participated in the person's arrest to appear at the hearing to contest the suspension. Provides that the failure of a law enforcement officer to appear at the hearing is grounds for a continuance, if the hearing officer considers the continuance appropriate, but not grounds for rescission of the suspension. Makes other changes.

CONDO-GARAGE STORAGE NOT UNITS

Amends the Condominium Property Act. Provides that where the Act addresses the minimum voting requirements for taking action by a condominium owner's association in which 30% or less of the condominium units possess 50% or more of the association votes, a unit for the purpose of voting on matters before the Association by virtue of the Act or in the condominium instruments, shall not include a garage or a storage unit.

RECREATION LAND USE-VARIETY

Amends the Recreational Use of Land and Water Areas Act. Provides that purpose of the Act is to encourage owners of land to make areas available (at present, to any individual or the public). Provides that the definition of "recreational or conservation purpose" includes conservation, resource management, exercise, education, relaxation or pleasure (at present, hunting or recreational shooting).

VEH CD-DUI & FORFEITURE

Amends the Illinois Vehicle Code and the Criminal Code of 1961. Transfers from the Criminal Code of 1961 to the Illinois Vehicle Code provisions for seizure and forfeiture of the vehicles of certain persons driving without a valid driver's license or permit or without liability insurance or who have committed specified violations while driving under the influence of alcohol, drugs, or intoxicating compounds. Establishes procedure for the forfeiture, including the right to a hearing for persons with a claim to the vehicle. Combines changes made by several Public Acts regarding driving under the influence with various changes concerning organization of the provisions, elements of offenses, penalties, and other matters. Makes corresponding changes in the Unified Code of Corrections.

DHS-INSPECTOR GENERAL POWERS

Amends the Department of Human Services Act and the Abused and Neglected Long Term Care Facility Residents Reporting Act. Transfers provisions concerning the Office of the Inspector General within the Department of Human Services from the Abused and Neglected Long Term Care Facility Residents Reporting Act to the Department of Human Services Act. Also provides that the Inspector General shall establish and conduct periodic training programs for community agency employees concerning the prevention and reporting of neglect and abuse. Amends the Nursing Home Care Act to make conforming changes. Also changes references to the Department of Public Health's "nurse aide registry" to "health care worker registry", and amends the Mental Health and Developmental Disabilities Administrative Act and the Health Care Worker Background Check Act to make conforming changes. Effective immediately.

CRIM CD-UNIDENTIFIED AUDIO

Amends the Criminal Code of 1961 relating to the offense of the unlawful use of unidentified sound or audio visual recordings. Defines "manufacture" for purposes of the offense. Provides that when the offense involves more than 100 unidentified sound recordings or more than 7 unidentified audio visual recordings during any 180 day period, the trier of fact may infer (but is not required to infer) the existence of any of the mental states set forth for the offense. Effective immediately.

CITIZEN PARTICIPATION

Creates the Citizen Participation Act. Applies to motions in cases concerning SLAPP lawsuits (Strategic Lawsuits Against Public Participation) that have been filed to discourage citizen participation in government. Requires courts to decide those motions within 90 days. Provides that discovery is suspended pending a decision on the motion. Allows discovery on certain issues upon leave of court. Requires that the motion be granted and the claim dismissed unless the responding party produces clear and convincing evidence that the moving parties' acts are not immunized under this Act. Provides for attorney's fees and costs to be awarded to the prevailing moving party. Effective immediately.
