CD OF CIV PRO-MED MAL-TECH

Amends the Code of Civil Procedure. Makes a technical change in a Section concerning the definitions of "economic loss" and "non-economic loss".

BIODIESEL FUEL ACT

Creates the Biodiesel Fuel Act. Requires diesel fuel sold or offered for sale in this State for use in internal combustion engines to contain at least 2% biodiesel fuel oil by volume. Provides exceptions to the 2% requirement. Allows for reimbursement, if the Act is repealed within a specified time, to distributors that have to make capital expenditures to adapt or add equipment to blend biodiesel fuel oil.

CON AMEND DAMAGES-MED CARE

Proposes to amend the Legislature Article of the Illinois Constitution. Provides that the General Assembly may determine by statute the limit of liability for all damages and losses other than economic damages of a provider of medical or health care with respect to treatment, lack of treatment, or other claimed departure from an accepted standard of medical or health care or safety that is or is claimed to be a cause of or that contributes or is claimed to contribute to the disease, injury, or death of a person. Requires a majority vote to pass legislation to limit liability on non-economic damages and requires that the legislation cite this Section. Effective upon being declared adopted.

EPA-FEES

Amends the Environmental Protection Act. Reduces the amounts various fees to be collected by the Environmental Protection Agency. Sets forth new procedures for the collection of NPDES fees and requires that all moneys collected from the fees be deposited into the Illinois Clean Water Fund. Repeals Sections concerning air pollution operating permit fees and fees for water quality certification. Amends the State Finance Act to create the Illinois Clean Water Fund. Effective immediately.

USE & OCC TAX-ROLLING STOCK

Amends the Use Tax Act, the Service Use Tax Act, the Service Occupation Tax Act, and the Retailers' Occupation Tax Act. Provides that "use as rolling stock moving in interstate commerce" means that term as it was defined prior to the changes made by Public Act 92-23. Effective immediately.

Amends the Code of Civil Procedure. Provides that every medical malpractice action must be commenced in the county where the medical care that is the subject of the cause of action took place. Effective July 1, 2004.

PROP TAX-SR CITZN ASSESS FREEZ

Amends the Senior Citizens Assessment Freeze Homestead Exemption provisions in the Property Tax Code. Provides that if an applicant for an exemption who moves to a new residence during the taxable year was granted an exemption for his or her previous residence in the immediately prior taxable year, then, for purposes of these provisions, that applicant's "residence" shall be deemed to be the new residence to which he or she moves. Provides that the "base amount" for the new residence shall be established by the chief county assessment officer at the same percentage of equalized assessed value of the new residence as the base amount for the previous residence was to the equalized assessed value of the previous residence in the most recent year for which an exemption was granted. Amends the Senior Citizens Assessment Freeze Homestead Exemption provisions and the State Mandates Act to require implementation without reimbursement from the State. Effective immediately.

Amends the Environmental Protection Act. Removes provisions allowing the Environmental Protection Agency to assess and collect NPDES discharge fees. Effective immediately.

OBRE-DAGING-FRAUD

Amends the Office of Banks and Real Estate Act. Requires the Commissioner of Banks and Real Estate to work in cooperation with the Director of Aging to ensure that all financial institutions regulated by the Office of Banks and Real Estate participate fully in the Department on Aging's financial exploitation of the elderly intervention program. Effective immediately.
