INC TX-ADOPTION EXPENSE DEDUCT

Amends the Illinois Income Tax Act. Creates an income tax deduction for individual taxpayers in an amount equal to the qualified adoption expenses paid by the taxpayer that are related to the taxpayer's adoption of an eligible child. Provides that the deduction may be claimed only for the taxable year in which the adoption becomes final but may include qualified adoption expenses paid in prior taxable years. Effective immediately.

WILDLIFE-DEER & TURKEY PERMITS

Amends the Wildlife Code. Requires one Deer Hunting Permit and one Wild Turkey Hunting Permit to be issued without charge to each person who is a current income beneficiary of a trust that holds 40 or more acres of land in a county in Illinois and who wishes to hunt only on that land held in trust. Authorizes current income beneficiaries to assign their right to receive a free permit to their immediate family members who wish to hunt only on that land held in trust. Provides that the number of permits issued without charge to income beneficiaries and their immediate family members may not exceed 15 for each 40 acres of that land held in trust in a county. Makes other technical changes. Defines "immediate family" and "income beneficiary". Effective January 1, 2011.

FOOD REG-FARMERS MKTS

Amends the Food Handling Regulation Enforcement Act. Provides that a city, county, or other local unit of government shall not adopt or enforce licensing ordinances or regulations for persons regulated under the provisions concerning farmers' markets. Provides that by July 1, 2011, the Director of Public Health in accordance with the provisions concerning farmers' markets shall adopt rules and regulatory guidelines for foods often found at farmers' markets and other food events. Provides that operators of stands and concessions who wish to sell products other than fresh, uncut, and unprocessed produce must contact each local health department in the region in which they will be operating to obtain specific requirements. Sets forth provisions concerning the transportation and delivery of food and food equipment. Sets forth provisions concerning specific food items. Effective immediately.

CRIM PRO-DNA ANALYSIS

Amends the Criminal Code of 1961. Provides that the offense of obstructing justice also includes destroying, altering, concealing, disguising, or otherwise tampering with samples collected for DNA fingerprinting analysis. Provides that the offense is a Class 3 felony. Amends the Code of Criminal Procedure of 1963 and the Unified Code of Corrections. Provides that every person arrested for committing a felony shall have a sample of his or her saliva or tissue taken for DNA fingerprinting analysis, at the time of booking, for the purpose of determining identity and for certain other specified purposes. Provides that subject to appropriation, the Department of State Police shall implement this provision. Provides that this provision becomes operative no later than the earlier of the following: (1) the date on which the Department of State Police informs law enforcement agencies that the Department is ready to collect samples; or (2) January 1, 2013. Provides that in the amendatory changes to the Unified Code of Corrections, intentionally using genetic marker grouping analysis information derived from a DNA sample beyond authorized uses is a Class 3 rather than a Class 4 felony. Provides that the identification, detention, arrest, or conviction of a person based upon a database match or database information is not invalidated if it is later determined that the sample should not have been obtained or placed in the database. Effective immediately.

PROHIBIT UNFUNDED MANDATES

Amends the School Code. Provides that no district is obligated to comply with any statutory or regulatory mandate or requirement unless a separate appropriation has been enacted into law providing funding for the school year during which such mandate is required. Contains provisions concerning discontinuing or modifying an activity to meet specified requirements. Provides that specified provisions do not apply to special education, transportation, or lunch programs, or coursework required for high school graduation. Effective immediately.

CRIM CD-INDECENCY-CHILD

Amends the Criminal Code of 1961. Provides that public indecency and sexual exploitation of a child are Class 4 felonies if committed by a person 18 years of age or older who is on or within 500 feet of elementary or secondary school grounds when children are present on the grounds.

PUB HEALTH-HONEY EXEMPT

Amends the Illinois Food, Drug and Cosmetic Act and the Criminal Code of 1961 to include in the definition of "raw agricultural commodity", honey that is in the comb or that is removed from the comb and in an unadulterated condition. Further amends the Illinois Food, Drug and Cosmetic Act to provide that notwithstanding any other provision of the Act, the Department of Public Health may not regulate honey that is in the comb or that is removed from the comb and in an unadulterated condition. Provides that both forms of honey are exempt from the provisions of the Act. Amends the Sanitary Food Preparation Act. Sets forth a definition of "honey house". Provides that notwithstanding any other provision of the Act, the Department of Public Health may not regulate honey that is in the comb or that is removed from the comb and in an unadulterated condition. Provides that both forms of honey are exempt from the provisions of the Act. Provides that if a producer is engaged in the sale of honey at a local market and packs or sells less than 500 gallons of honey produced in this State per year, then the Department may not regulate or inspect the producer's honey house.

SCH CD-DEBT LIMITATIONS

Amends the School Code. In provisions concerning the debt limitations of school districts, provides that in addition to all other authority to issue bonds, West Washington County Community Unit School District 10 may issue bonds with an aggregate principal amount not to exceed $32,200,000 and maturing over a period not exceeding 30 years, but only if all of specified conditions are met. Provides that the debt incurred on any bonds issued under specified provisions shall not be considered indebtedness for purposes of any statutory debt limitation. Effective immediately.
