INSURANCE-TRANSPORT NETWORK CO

Amends the Illinois Insurance Code. Provides that automobile insurers may exclude any or all coverage to a transportation network company driver's personal vehicle for any loss or injury that occurs while the driver is logged on to the transportation network company's digital network or while the driver is engaged in a prearranged ride. Amends the Transportation Network Providers Act. Provides definitions for: digital network, personal vehicle, prearranged ride, and transportation network company passenger. Provides automobile insurance requirements for a transportation network company and a transportation network company driver while a driver is logged on to the transportation network company's digital network and while a driver is engaged in a prearranged ride. Effective immediately.

CIVIL JUSTICE FUNDING

Creates the Civil Justice Funding Act. Establishes requirements for civil justice funding contracts, prohibitions on civil justice funding companies, disclosure requirements, limitations on fees, prohibitions on attorneys, and a requirement to register with the Department of Financial and Professional Regulation before engaging in civil justice funding. Effective July 1, 2015.

MOTOR VEHICLE THEFT PREVENTION

Amends the Illinois Motor Vehicle Theft Prevention Act. Eliminates references to the Illinois Criminal Justice Information Authority within the Act. Provides that money in the Motor Vehicle Theft Prevention Trust Fund shall be used to pay the administrative costs to support the Illinois Motor Vehicle Theft Prevention Council, not to exceed 10% in any one fiscal year of other amounts collected under the Act (currently, to pay the Authority's costs to administer the Council). Requires the Trust Fund to be administered by a statewide association representing property and casualty insurance companies that pay into the Trust Fund (instead of the Executive Director of the Authority). Makes changes to the purpose of the Act and to the powers of the Illinois Motor Vehicle Theft Prevention Council. Provides that moneys in the State Police Motor Vehicle Trust Fund shall be used by the Department of State Police for motor vehicle fraud prevention purposes in addition to motor vehicle theft prevention purposes. Makes conforming changes. Effective July 1, 2017.

HEALTH INS GRACE PERIOD

Creates the Health Care Professional and Provider Notification of Patients in Health Insurance Exchange Grace Period Act. Provides that when a health care professional or provider or a representative of the health care professional or provider requests information from a QHP issuer regarding (i) an enrollee's eligibility, (ii) an enrollee's coverage or health plan benefits, or (iii) the status of a claim or claims for services provided to an enrollee, or reports a claim in a remittance advice, and the request or service is for a date within the second or third month of a grace period, the QHP issuer shall clearly identify that the applicable enrollee is in the grace period and provide additional information. Provides that if the QHP issuer informs the health care professional or provider or a representative of the health care professional or provider that the enrollee is eligible for services, and does not inform the health care professional or provider that the enrollee is in the grace period, that determination shall be binding on the QHP issuer, and the claim or claims for services rendered shall be paid by the QHP issuer. Requires QHP issuers to maintain a hotline for questions from a health care professional or provider. Requires that QHP issuers seeking to recoup claims made during the last 60 days of the grace period must commence such recovery or recoupment efforts no later than 60 days after the expiration of the grace period. Provides that the Director of Insurance shall investigate all complaints of violations of the Act. Provides that the Director shall issue cease and desist orders to any QHP issuers found to be in violation of the Act. Provides that failure to comply with a cease and desist order shall result in fines of $1,000 for each violation, and each day the QHP issuer is in violation of the Act is a separate offense. Effective immediately.

CONCEALED CARRY-LICENSE DENIAL

Amends the Firearm Concealed Carry Act. Provides that the Department of State Police must notify the applicant stating detailed grounds for the denial and the applicant's right to receive copies of all documents and other evidence that was provided to the Department concerning the application. Provides that in the event that an applicant is denied a license, a copy of any and all objections made by law enforcement agencies shall be made available to the applicant. Provides that upon the referral, applicants shall be given notice by the Department that the application is undergoing review by the Board. The notice shall include the next date upon which the Concealed Carry Licensing Review Board is expected to convene, and shall inform the applicant that the 90-day time period has been tolled. Provides that all documents and evidence provided to the Board, including a list of the names of all witnesses who provided testimony to the Board, shall be made available to the applicant and the applicant's designated attorney, if any. Provides that an applicant may appeal a denial of an application for a concealed carry license by the Department to the Director for a hearing within 70 calendar days after the denial. Provides that the time deadline for filing a petition for administrative or judicial review shall be 70 calendar days from the date the notice of denial was received by the applicant. If an applicant brings a petition for judicial review under this Act, the petition must be decided without remand to the Department.

UNCLAIMED LIFE INS BENEFIT ACT

Creates the Unclaimed Life Insurance Benefits Act. Provides that insurers with life insurance policies, annuity contracts, or retained asset accounts shall compare those accounts to the Social Security Administration's Death Master File or similar database on at least a semi-annual basis. Provides that within 90 days of finding a Death Master File match, the insurer shall complete a good faith effort to confirm the death of the insured or retained asset account holder, and to determine whether benefits are due and, if so, to locate beneficiaries and provide the appropriate forms or instructions. Provides that benefits from a policy, annuity contract, or a retained asset account, plus any applicable accrued contractual interest shall first be payable to the designated beneficiaries or owners and, in the event the beneficiaries or owners cannot be found, shall escheat pursuant to the Uniform Disposition of Unclaimed Property Act, and requires insurers to contact the Treasurer pursuant to the Uniform Disposition of Unclaimed Property Act. Provides that failures to meet the requirements of the Act with such frequency as to constitute a general business practice is a violation of provisions of the Illinois Insurance Code concerning unfair methods of competition and unfair or deceptive acts or practices. Makes conforming changes in the Illinois Insurance Code.
