REVISORY RENAMING BOB AND DCCA

Makes revisory changes to numerous Acts to conform them to Public Act 93-25, which renamed the Bureau of the Budget as the Governor's Office of Management and Budget and renamed the Department of Commerce and Community Affairs as the Department of Commerce and Economic Opportunity. Makes no substantive change. Effective immediately.

MARRIAGE ACT-CHILD'S BEST INT

Amends the Illinois Marriage and Dissolution of Marriage Act. Provides that there is a rebuttable presumption that it is not in the best interest of a child to award custody to a parent who has been convicted of a crime that is in one of several designated categories (including battery, unlawful restraint, and stalking), convicted of a crime that resulted in serious physical injury to a family or household member, or determined by a court order to have violated an order of protection. The presumption can be rebutted by a preponderance of the evidence that the parent has completed a partner abuse program; alcohol and drug screening, if the court deems the screening to be appropriate, and alcohol or drug counseling or treatment, if applicable; all of the factors weigh in the parent's favor; and there is little likelihood of any future injury to the child. If the presumption is rebutted, the court shall state the evidence relied upon. If the presumption is not rebutted, custody shall be with the other parent, provided that is in the best interest of the child. If the presumptions for both parents are not rebutted, the court may award custody to one parent, if to do so is in the best interest of the child. Deletes from the list of relevant factors to consider in the determination of the best interest of the child, the willingness and ability of each parent to facilitate and encourage a continuing relationship between the other parent and the child.

SRFCE MINING-NATL SCENIC BYWAY

Amends the Surface Coal Mining Land Conservation and Reclamation Act. Provides that on or after the effective date of the amendatory Act, no initial permit shall be issued and no existing permit shall be revised or renewed for mining on land that measures less than 300 feet away from an area that has been designated a national scenic byway by the United States Department of Transportation. Effective immediately.

$COMPTROLLER

Appropriates $4,500,000 from the General Revenue Fund to the State Comptroller for the State share of compensation for public defenders. Effective July 1, 2006.

HOME HEALTH-DRUG DISPENSE ACT

Creates the Home Health and Hospice Drug Dispensation and Administration Act. Allows home and community support services agencies and their employees who are registered nurses or advanced practice nurses to purchase, store, or transport certain drugs for the purpose of administering the drugs to home health or hospice patients of the agencies. Requires an agency that purchases, stores, or transports these drugs to establish policies and procedures concerning proper storage, transportation, temperature stability, removal from container on physician's order, administration of the drug, and the maintenance of written records. Provides that an agency or its authorized nursing employee may administer the drug only in the patient’s residence under physician's orders. Sets forth procedures for agency handling of physician oral orders and pharmacy dispensation of the drugs. Provides that upon a home health agency's administration or dispensation of a specific drug to a patient, that agency shall be reimbursed the cost of that specific drug by the Department of Public Aid. Effective immediately.
