EPA-PERMITS-POLLUTION CONTROL

Amends the Environmental Protection Act. Provides that for (i) permits for the development or construction of new pollution control facilities and (ii) permits for local siting approval of pollution control facilities, the appropriate county board or governing body of the municipality for the facility shall be the county board of the county or the governing body of the municipality in which the facility is to be located as of the date when the application for siting approval is filed. Provides that facilities subject to provisions of the Act relating to garbage transfer stations must be in compliance with the location requirements of those provisions as of the date the application for siting approval is filed in order to obtain local siting approval for the pollution control facility. Repeals the Illinois Pollution Prevention Act. Provides that the changes made by this amendatory Act apply only to siting applications filed on or after the effective date of this amendatory Act. Effective immediately.

SCH CD-NONINSTRUCTIONAL SERVIC

Amends the School Code. Provides that a board of education may enter into a contract with a third party for non-instructional services currently performed by an employee or bargaining unit member or lay off those educational support personnel employees upon 90 (instead of 30) days written notice. Adds conditions on the entering of such a contract, including providing that: (1) a contract must not be entered into during the term of a collective bargaining agreement; (2) any third party that submits a bid to perform the services shall provide comparable liability insurance, a comparable benefits package, a list of the number of employees who will provide the services and the wages the third party will pay those employees, a minimum 3-year cost projection, and information about the criminal and disciplinary records of the employees; (3) a contract must not be entered into unless the school board provides a cost comparison; (4) a minimum of 2 public hearings to discuss the school board's proposal to contract with a third party must be held; (5) a contract shall contain provisions requiring the contractor to offer available employee positions pursuant to the contract to qualified school district employees whose employment is terminated because of the contract; and (6) a contract shall contain provisions requiring the contractor to comply with a policy of nondiscrimination and equal employment opportunity. Amends the State Mandates Act to require implementation without reimbursement. Effective immediately.

RECYCLABLE METAL PURCHASE LAW

Amends the Copper Purchase Registration Law. Changes the short title to the Recyclable Metal Purchase Registration Law. Provides that, for each purchase of recyclable metal, a recyclable metal dealer must enter specified information on a form provided by the Department of State Police. Requires the recyclable metal dealer to: copy the seller's drivers license or state-issued identification card; photograph the items of recyclable metal purchased; and photograph the license plate and the side of the vehicle or conveyance on which the recyclable metal was delivered or use a security camera to record the license plate and the side of the vehicle or conveyance. Provides that security camera recordings must be retained for 90 days. Provides for reporting to local law enforcement and changes provisions exempting certain municipalities that provide for the registration of recyclable metal. Provides that violation of the Act is a Class A misdemeanor for a second offense and a Class 4 felony for a third or subsequent offense.

CRIMINAL-LISTENING DEVICE

Amends the Criminal Code of 1961. Provides that, with prior notification to the State's Attorney of the county in which it is to occur, recording or listening with the aid of any device to any conversation taking place within or about any motor vehicle under the control and direction of a law enforcement officer, under circumstances where the use of the device is necessary for the detection or investigation of the theft of that motor vehicle is exempt from the Code's eavesdropping provisions. Requires the Director of State Police to issue regulations as are necessary concerning the use of devices, retention of tape recordings, and reports regarding their use. Provides that any recording or evidence derived as the result of the exemption is inadmissible in any proceeding, criminal, civil, or administrative, except for (i) the theft of the motor vehicle in question, (ii) the commission of any crime taking place within, or otherwise involving the use of, the motor vehicle in question, or (iii) when used as direct impeachment of a witness concerning matters contained in the interception or recording.

MEDICAID-AGE 60-CHRONIC ILLNES

Amends the Illinois Public Aid Code. Provides for Medicaid eligibility for persons who (i) are age 60 or older, (ii) have an ongoing need for medical services for the monitoring or treatment of a chronic condition, without which institutionalization would be necessary, and (iii) have income and resources that are equal to or less than the monthly maintenance allowance and resource allowance amounts for a community spouse as set forth in the Social Security Act. Effective immediately.

FOOD FARMS AND JOBS ACT

Creates the Illinois Food, Farms, and Jobs Act and the Illinois Local and Organic Food and Farm Task Force. Sets out the composition of the Task Force. Provides that the Task Force shall develop a plan for expanding and supporting a State local and organic food system and for assessing and overcoming obstacles to an increase in locally grown food and local organic food production. Sets out the contents of the plan. Amends the State Finance Act to create the Illinois Local Organic Food and Farm Fund. Effective immediately.

SEX OFF&VIOLENT OFFENDER

Amends the Sex Offender Registration Act and the Child Murderer and Violent Offender Against Youth Registration Act. Provides that a person who becomes subject to registration under either Act who has previously been subject to registration under either Act or similar registration requirements of other jurisdictions shall register for the period of his or her natural life if not confined to a penal institution, hospital, or other institution or facility, and if confined, for the period of his or her natural life after parole, discharge, or release from any such facility. Effective immediately.

CNTY CD-CHILD ADVOCACY FEE

Amends the Counties Code. Provides that, in each county in which a Children's Advocacy Center provides services, the county board may adopt a mandatory fee of up to $5 to be paid by a defendant on a judgment of guilty or a grant of supervision under certain Sections of the Unified Code of Corrections.

CRIM CD-ID THEFT MILITARY

Amends the Criminal Code of 1961. Increases the penalties for identity theft by one class when the penalties for the offense are less than a Class X felony if the victim of the offense is an active duty member of the Armed Services or Reserve Forces of the United States or of the Illinois National Guard serving in a foreign country.
