Amends the Criminal Code of 1961. Eliminates from the child abduction statute a provision that a person commits child abduction when he or she intentionally lures or attempts to lure a child under the age of 16 into a motor vehicle, building, housetrailer, or dwelling place without the consent of the parent or lawful custodian of the child for other than a lawful purpose. Creates the offense of luring a minor. Provides that a person commits the offense when he or she is 18 years of age or older and is a stranger to a person under 15 years of age and knowingly contacts or communicates electronically to the person who is under 15 years of age, for the purpose of persuading and luring or transporting or attempting to persuade and lure, or transport, that person under 15 years of age away from the person's home, or from any location known by the person's parent, legal guardian, or custodian, to be the place where the person under 15 years of age is located, for any purpose without the express consent of the person's parent or legal guardian, and with the intent to avoid the consent of the person's parent or legal guardian. Establishes penalties. Amends the Unified Code of Corrections to provide that a person convicted of a second or subsequent offense of luring a minor shall receive no more than 4.5 days of good conduct credit for each month of his or her sentence of imprisonment. Amends the Sex Offender Registration Act. Provides that a person convicted of a second or subsequent offense of luring a minor shall register as a sexual predator.
Amends the State Finance Act. Creates the Sex Offender Investigation Fund in the State treasury. Amends the Clerks of Courts Act and the Unified Code of Corrections. Provides that there shall be added to every penalty imposed in sentencing for a sex offense as defined in the Sex Offender Registration Act an additional fine in the amount of $500 to be imposed upon a plea of guilty, stipulation of facts or finding of guilty resulting in a judgment of conviction or order of supervision. Provides that the additional fines shall be deposited into the Sex Offender Investigation Fund. Provides that subject to appropriation, moneys in the Sex Offender Investigation Fund shall be used by the Department of State Police to investigate alleged sex offenses and to make grants to local law enforcement agencies to investigate alleged sex offenses as such grants are awarded by the Director of State Police under rules established by the Director of State Police.
Amends the Rights of Crime Victims and Witnesses Act. Provides that "crime victim" includes both parents, legal guardians, and foster parents of a child killed as a result of a violent crime perpetrated against the child or both parents, legal guardians, and foster parents of a child victim who is physically or mentally incapable of exercising rights under the Act. Provides that the Act applies to proceedings under the Juvenile Court Act of 1987. Provides that a victim-witness specialist may be present at the court proceedings. Provides that support persons of the victim are subject to the admonition of the rules of confidentiality.
