INTERPRETER FOR DEAF-SUNSET

Amends the Regulatory Sunset Act. Removes the Interpreter for the Deaf Licensure Act of 2007 from provisions setting a repeal date of January 1, 2018 for certain regulatory Acts. Effective immediately.

UTILITIES-EXPEDITED PROCEDURES

Amends the Public Utilities Act. Provides that a public utility may apply for expedited review for a certificate of public convenience and necessity for the construction of any new high voltage service line that does not exceed 25 miles in length across privately owned real estate (instead of any new high voltage electric service line). Provides that "privately owned real estate" does not include a right-of-way owned in fee simple, subject to an easement, or controlled by a public utility. Provides that the changes shall apply to applications filed on or after the amendatory Act's effective date. Provides that if a public utility seeks to exercise its eminent domain powers after the Illinois Commerce Commission has issued an order regarding a certificate of public convenience and necessity, then the Commission must issue its order regarding eminent domain within 365 days (instead of 45 days) after the public utility files its petition. Effective immediately.

MANDATORY SENTENCE ALTERNATIVE

Amends the Counties Code. Provides in a county with a service-intensive probation program, such as pre-trial, DUI court, veteran's court, drug court, mental health court, or domestic violence court, the county may adopt a $25 fee to be paid by a defendant convicted of an offense. Amends the Unified Code of Corrections. Notwithstanding any other law to the contrary, when the offender is to be sentenced for a non-violent non-probationable offense, the court may sentence the offender to a term of imprisonment in the Department of Corrections or county jail in combination with a consecutive term of service-intensive probation if the court makes certain findings. If the court elects to sentence an offender to a combination sentence, the court must order the defendant to complete any indicated treatment for substance abuse or mental illness in an outpatient, inpatient, residential, or jail-based custodial treatment program, and include a regimen of graduated requirements and rewards and sanctions, including but not limited to: fines, fees, costs, restitution, additional incarceration, individual and group therapy, drug testing, close monitoring by the court and supervision of progress, educational or vocational counseling as appropriate, and other requirements necessary to fulfill the sentence. Provides that the court may structure its sentence without regard to mandatory minimum imprisonment requirements if the combination of imprisonment and the term of probation equals or exceeds the minimum sentence for the offense.

IL PWR AGCY-SOURCING AGREEMENT

Amends the Illinois Power Agency Act. Provides that the Illinois Power Agency and Illinois Commerce Commission shall include sourcing agreements covering power produced by clean coal and other facilities. Provides that utilities and alternative retail electric supplies shall enter into sourcing agreements as part of the annual power procurement process. Provides that the Agency and Commission shall establish competitive bidding procedures for sourcing terms. Sets the requirements of the sourcing agreements. Makes technical changes. Effective immediately.

FINANCE

Creates the Unbalanced Budget Response Act. Provides authority and procedures for the Governor to transfer previously appropriated funds between programs, purposes, accounts, agencies, or appropriation line items, and to transfer balances between special funds in the State treasury and the General Revenue Fund. Describes the agencies and programs subject to this authority. Provides that designated agencies may adopt emergency rules to carry out the purposes of the Act. Defines terms. Provides that the Act is repealed on July 1, 2017. Amends the Illinois Administrative Procedure Act to make conforming changes. Amends the Illinois Public Aid Code. Adds actions taken under the Unbalanced Budget Response Act to a Section relating to applicability. Amends the State Mandates Act to require implementation without reimbursement by the State. Effective immediately.

LOCAL GOV-UNFUNDED MANDATES

Creates the Local Unfunded Mandate Exemption Act. Provides that all units of local government, school districts, and public colleges and universities may, by a majority vote of the governing body, exempt themselves from specified mandates that are unfunded if it is determined that it is not economically feasible to comply with the unfunded mandate. Provides for notice, public hearing, and other requirements in order for a governing body to exempt itself from any mandate. Prohibits exemption from federally required mandates, mandates pertaining to health and public safety, mandates pertaining to civil rights, and instructional mandates for school districts. Provides for appeal procedures by State agencies affected by exempted mandates. Amends the State Mandate Act. Provides that the Department of Commerce and Economic Opportunity shall submit yearly to the Governor and the General Assembly a review and report on mandates remaining in effect at the time of submittal of the report.

CONCEALED CARRY-OBJECTIONS

Amends the Firearm Concealed Carry Act. Provides that a law enforcement agency objection to a license applicant based upon information in an arrest or incident report must be based upon information from an investigation of the objecting law enforcement agency and not an investigation of another law enforcement agency. Provides that nothing in the Act prohibits the law enforcement agency from contacting the investigating law enforcement agency regarding the license applicant. Provides that a law enforcement agency that submits an objection to a license applicant may withdraw that objection before its submission to the Concealed Carry Licensing Review Board. Provides that the Department of State Police may review a law enforcement agency objection to a license applicant before the Department's submission of the objection to the Board. Provides that the verification shall determine: (i) if the criteria under this Act for the submission of an objection by the law enforcement agency has been met, (ii) that the objection is against the proper person, and (iii) that information relevant to the objection has been included as required by the Act. Provides that an objection failing verification shall be returned to the objecting agency and that agency shall have 10 calendar days after receiving notification from the Department that the objection failed verification to submit to the Department the required information, a response, or withdrawal of the objection. Provides that if the objecting agency fails to act on the notification within the 10 calendar days, the Department may reject the objection and process the application in accordance with the Act.
