Amends the Illinois Municipal Retirement Fund Article of the Illinois Pension Code. Defines "omitted service". Deletes a provision concerning the transfer of credits and creditable service from downstate police pension funds. Provides that for omitted service, any employee who was employed by a participating employer in a position that required participation, but who was not enrolled in the Fund, may establish such credits under certain conditions. In the Section concerning Board elections, provides that if only one candidate is properly nominated in petitions received by the Board, that candidate shall be deemed the winner; in the case of 2 employee trustees elected to a full term in the same year, if only 2 candidates are properly nominated in petitions received by the Board, those 2 candidates shall both be deemed the winner. Makes related changes. Repeals provisions concerning transfers of creditable service to and from downstate police pension funds. Contains a nonacceleration provision. Effective immediately.

Amends the Children and Family Services Act. Provides that when a child is voluntarily placed in out-of-home care funded by the Department of Children and Family Services for the purpose of obtaining mental health treatment for the child or treatment for the child's developmental disability, the Department is prohibited from requesting, recommending, or requiring that a parent terminate his or her parental rights with respect to the child or that a parent or legal guardian transfer legal custody of the child to the Department. Provides that a child voluntarily placed in out-of-home care shall be placed pursuant to a voluntary placement agreement voluntarily entered into by the parents or legal guardian of the child. Provides that for a child to remain in out-of-home care for longer than 180 days, a juvenile court must make a judicial determination within the first 180 days of the placement that the placement is in the best interests of the child. Requires the Department to report annually to the General Assembly concerning (i) the number of children who were voluntarily placed in out-of-home care funded by the Department and (ii) the number of parents or legal guardians who relinquished custody of their child for the purpose of seeking mental health treatment for the child or treatment for the child's developmental disability. Contains provisions concerning: an interagency agreement between specified State agencies to prevent children from becoming wards of the State and entering the child welfare system solely for purpose of treatment of a child's serious mental illness, serious emotional disturbance, or developmental disability; certain protocols that must be included in the interagency agreement; and additional reporting requirements. Effective immediately.
Amends the State Comptroller Act. Creates the Illinois Gives Initiative, whereby an employee or annuitant may authorize the withholding of a portion of his or her salary, wages, or annuity for payment to Illinois chapters of the American Red Cross whose territories include areas affected by a declaration of disaster. Authorizes the State Comptroller to develop an electronic mechanism whereby an employee or annuitant may register with the Office of the Comptroller for the withholding to be deducted from the next available scheduled pay period, develop policies and procedures necessary for the efficient transmission of the notification of the withholding to the employee's Payroll Officer or the annuitant's Retirement Agency, and develop policies and procedures necessary for the efficient distribution of the withholdings to designated Illinois chapters of the American Red Cross. Makes corresponding changes in the State Salary and Annuity Withholding Act. Effective immediately.
Amends the Property Tax Code. Creates an abatement for property that (i) is used exclusively for commercial or industrial purposes and (ii) has been rebuilt following a natural disaster occurring in taxable year 2013 or any taxable year thereafter. Effective immediately.
Amends the Food Handling Regulation Enforcement Act. Provides that regulation of farmers' markets by local authorities may be no more stringent than the regulation established by the Department of Public Health. Establishes a framework for the regulation of food samples. Makes a corresponding change in the Sanitary Food Preparation Act. Imposes requirements for disclosure of product origin with respect to specialty crops and raw agricultural commodities. Authorizes a State-certified local public health department to impose a fee in connection with the registration of a cottage food operation. Effective immediately.
Amends the Environmental Protection Act. Provides that, on or before January 1, 2015, the owner or operator of each tire storage site that contains used tires totaling more than 10,000 passenger tire equivalents, or at which more than 500 tons of used tires are processed in a calendar year, shall submit documentation demonstrating its compliance with the Pollution Control Board rules adopted under the Act. Provides that, beginning July 1, 2016, no person shall cause or allow the operation of a tire storage site that contains used tires totaling more than 10,000 passenger tire equivalents, or at which more than 500 tons of used tires are processed in a calendar year, without a permit granted by the Illinois Environmental Protection Agency or in violation of any conditions imposed by that permit. Provides specified exemptions to the permit requirement. Requires the Agency to propose and the Board to adopt, revisions to the rules adopted under the Act that are necessary to conform those rules to the requirements of this amendatory Act of the 98th General Assembly. Provides that the State's Attorney or Attorney General, upon request of the Agency or upon his or her own motion, may institute a civil action for an immediate injunction to halt storage or processing of used tires at a site if a person who is required to comply with the financial assurance rules established by the Board fails to comply with those rules with respect to that tire storage site. Provides that specified monies in the Used Tire Management Fund shall be used to provide financial assistance to units of local government and private industry for specified purposes. Effective immediately.

Amends the Illinois Vehicle Code. Provides that insurers shall collect a $1 surcharge upon each vehicle covered by a liability insurance policy. Provides that of the moneys collected by this surcharge, 72% shall be used for homeland security initiatives established by the Illinois Law Enforcement Alarm System (ILEAS) Governing Board, 25% shall be used for airborne operations, and 3% shall be retained by the Illinois Emergency Management Agency to be used to administer the Illinois Law Enforcement Alarm Systems Fund. Provides that the Illinois Emergency Management Agency shall establish guidelines for the expenditure of collected moneys to enhance local law enforcement homeland security and local law enforcement mutual aid activities in this State and to support public safety airborne operations. Provides that the ILEAS Governing Board shall annually supply the Director of the Illinois Emergency Management Agency with a report of the use of the surcharges. Amends the Intergovernmental Cooperation Act to provide that the Illinois Law Enforcement Alarm System shall be considered a public agency for purposes of the Act.
