Amends the Southeastern Illinois Economic Development Authority Act. Makes a technical change in a Section concerning the short title.
Amends the Disabled Persons Rehabilitation Act. Removes persons with Alzheimer's disease and related disorders from the list of persons receiving services under the Act. Changes the type of preventive services the Department may establish to prevent the unnecessary institutionalization of persons in need of long term care who meet the criteria for blindness or disability as defined under the Social Security Act. Removes language allowing the Department to base eligibility standards on the recipient's ability to pay. Removes language concerning the Department's authority to establish a system of recipient cost sharing; provider vouchers; interest payments to providers of chore and housekeeping services; and other matters. Effective immediately.
Amends the Illinois Vehicle Code. Provides that a Section concerning accident counseling shall apply to Class I and Class II (instead of only Class I) rail carriers. Provides that each Class I and Class II rail carrier must review and update its accident counseling or trauma program filing on an annual basis. Provides that programs may be filed either by mail or electronically via an email address designated by the Illinois Commerce Commission. Effective immediately.
Amends the Criminal Code of 1961. Creates the offense of failure to report the disappearance of a child to a law enforcement agency. Provides that a person commits the offense when he or she, as a parent, guardian, or other person having physical custody or control of a child under 13 years of age, knowingly or recklessly fails to immediately report the child as missing to a law enforcement agency after a 24-hour period expires in which he or she failed to make contact with or otherwise verify the whereabouts and safety of that child. Provides that a person does not commit the offense of failure to report the disappearance of a child to a law enforcement agency when the failure to report is due to an act of God, act of war, or inability of a law enforcement agency to receive a report of the disappearance of a child. Provides that a violation is a Class 4 felony. Provides that a parent, guardian, or other person having physical custody or control of a child under 18 years of age must report: (1) the child's death to a law enforcement agency within one hour after learning about the child's death or (2) the location of the child's corpse to a law enforcement agency within one hour after learning the location of the corpse. Provides that a person does not violate this provision when he or she fails to report due to an act of God, act of war, or inability of a law enforcement agency to receive a report of a child's death or the location of a child's corpse. Provides that a violation is a Class 4 felony.
Amends the Criminal Code of 1961. Provides that the statute of limitations for a prosecution for involuntary servitude, involuntary sexual servitude of a minor, or trafficking in persons for forced labor or services may be commenced within one year of the victim attaining the age of 18 years. Provides that in no case shall the time period for prosecution of those offenses expire sooner than 3 years after the commission of the offense. Includes in the offense of involuntary servitude using a scheme, plan, or pattern intended to cause the person to believe that, if the person did not perform that labor or services, that person or another person would suffer serious harm or physical restraint. Amends the Code of Criminal Procedure of 1963. Provides that in prosecutions for involuntary servitude, involuntary sexual servitude of a minor, and trafficking in persons, when the offense involves sexual activity, the prior sexual activity or the reputation of the alleged victim or corroborating witness is inadmissible except under certain circumstances. Amends the Sex Offender Registration Act. Includes in the definition of "sex offense" trafficking in persons, involuntary servitude, and related offenses, provided the offense involved commercial sexual activity, a sexually-explicit performance, or the production of pornography. Also includes in the definition of "sex offense", involuntary sexual servitude of a minor.
Amends the Criminal Code of 1961 concerning financial exploitation of an elderly person or a person with a disability. Includes in the definition of intimidation, criminal intimidation. Includes in the definition of a person who stands in a position of trust and confidence with an elderly person or person with a disability, a paid or unpaid caregiver for the elderly person or person with a disability. Provides that if a person is charged with financial exploitation of an elderly person or a person with a disability that involves the taking or loss of more than $5,000, a prosecuting attorney may file a petition with the circuit court of the county in which the defendant has been charged to freeze the assets of the defendant for purposes of restitution to the victim. Provides that the burden of proof that the defendant unlawfully obtained the victim's property shall be by a preponderance of the evidence. Provides that this provision is operative whether or not the defendant has been convicted of the offense.
Amends the Illinois Police Training Act. Provides that the curriculum for probationary police officers shall include courses pertaining to the recognition of elder abuse and neglect and crimes against the elderly. Effective January 1, 2013.
Amends the Illinois Credit Union Act. Changes the definition of "common bond" to include relatives by civil union. Provides that if a member fails to maintain one fully paid share, the credit union may permit the member to re-subscribe within 30 days after the member failed to maintain one fully paid share. Provides that, if the board of directors of a credit union has adopted a policy addressing age eligibility standards, then the credit union may require that members be at least 18 years of age by the date of the meeting in order to vote at meetings, sign nominating petitions, or sign petitions requesting special meetings and at least 18 years of age by the date of the election or appointment in order to hold elective or appointive office. Provides that a resulting credit union shall be considered the same business and corporate entity as each merging or consolidating credit union or as the converting credit union. Defines "resulting credit union". Effective immediately.
Amends the School Code. Provides that after June 1, 2012 persons may not be nominated for General Assembly scholarships and that General Assembly scholarships may not be awarded after that date unless the nomination is made prior to that date. Prevents both second nominations for any lapsed General Assembly scholarship and nominating persons to the unused or unexpired parts of any vacated General Assembly scholarship after June 1, 2012. Effective immediately.
