Amends the Illinois Insurance Code. Makes a technical change in a Section concerning the short title.
Amends the Illinois Income Tax Act. Sets forth procedures for calculating the deduction for the depreciation of property for which a bonus depreciation deduction was taken from the taxpayer's federal adjusted gross income. Effective immediately.
Amends the Environmental Protection Act. Provides that the limits of the federal Standards of Performance for Small Industrial-Commercial-Institutional Steam Generating Units (40 CFR 60, Subpart Dc) establish the emissions limits for non-hazardous air pollutants applicable to certain greenhouse boilers. Effective immediately.
Amends the Illinois Vehicle Code. Provides that registration plates for farm trucks and trailers may, at the vehicle owner's option, be issued for periods of 4 months, rather than one year. Provides that the Secretary of State shall provide by rule for the issuance and display of distinctive decals for each of the 4-month periods of the year. Provides that the owner of a truck or trailer registered under these provisions must affix the proper decal to the truck or trailer's registration plate in the manner prescribed by the Secretary. Effective January 1, 2006.
Amends the Illinois Pension Code. Authorizes the General Assembly Retirement System, the State Employees' Retirement System of Illinois, the Teachers' Retirement System of the State of Illinois, and the Judges Retirement System of Illinois to offer its employees the option to participate in a self-managed program of retirement benefits instead of the program of retirement benefits currently offered. Provides that a self-managed plan shall authorize a participating employee to accumulate assets for retirement through a combination of employer and employee contributions that may be invested at the employee's direction in mutual funds, collective investment funds, or other investment products and used to purchase annuity contracts. Provides that, to the extent that the changes made by this amendatory Act are determined to be a new benefit increase, the changes are exempt from the 5-year expiration provision. Effective immediately.
Disapproves the 2006 report of the Compensation Review Board.
Amends the Public Library District Act of 1991. Provides that the Sections in the Act that authorize the annexation of territory are each an independent authorization for the annexation of contiguous territory. Provides that a library district may annex territory by ordinance if that territory is located within the boundaries of a municipality or school district that is included within the district (now, the district may annex the territory if the municipality or school district has annexed or otherwise includes the territory within its boundaries). Deletes a provision that the annexation ordinance must recite the prior annexation or other inclusion of the territory by the municipality or school district. Provides that if, before the effective date of this amendatory Act, a district has annexed territory and that annexation complies with the statutory requirements, as changed by this amendatory Act, then, for all purposes, that annexation is validated, ratified, and declared to be in full force and effect from the date on which the district completed its annexation of the territory. Makes technical changes. Effective immediately.
Amends the State Finance Act. Makes a technical change in a Section concerning the State Pensions Fund.
Amends the Statute on Statutes. Defines the terms "person", "human being", "child", and "individual" to include every infant member of the species homo sapiens who is born alive at any stage of development. Defines "born alive" to mean the complete expulsion or extraction from the mother of an infant, at any stage of development, who after such expulsion or extraction breathes or has a beating heart, pulsation of the umbilical cord, or definite movement of voluntary muscles, regardless of whether the umbilical cord has been cut and regardless of whether the expulsion or extraction occurs as a result of natural or induced labor, cesarean section, or induced abortion. Provides that nothing in these definitions shall be construed to affirm, deny, expand, or contract any legal status or legal right applicable to any member of the species homo sapiens at any point prior to being born alive.
