Amends the Water Use Act of 1983. Provides that the Department of Agriculture shall consider water quantity in its procedures for restricting groundwater withdrawal under the Act and rules adopted under the Act. Requires the Department to adopt rules. Amends the Illinois Groundwater Protection Act to direct the Interagency Coordinating Committee on Groundwater to submit a report to the Governor and the General Assembly on or before January 1, 2028, on the unsustainable depletion of aquifers in the State with a legislative proposal to remedy the problem.

Amends the Environmental Protection Act. Provides that owners and operators of CCR surface impoundments at electric generating plants that are within 4,000 feet of Lake Michigan shall close the CCR surface impoundment by removal and off-site disposal, pursuant to specified provisions and requirements. In additional provisions, requires an owner or operator of an electric generating plant located within 4,000 feet of Lake Michigan that generates or has generated CCR that is not disposed of, treated, stored, or abandoned in a CCR surface impoundment to remove from the owner's or operator's site, for off-site disposal, all CCR generated by the facility that is not disposed of, treated, stored, or abandoned in a CCR surface impoundment and remediate all soil and groundwater impacted by the CCR, in accordance with specified requirements. Requires owners or operators to submit specified plans and reports to the Environmental Protection Agency. Provides that an owner or operator shall post with the Agency a performance bond or other security for the purpose of ensuring removal and remediation in accordance with the provisions. Provides that the Agency may enter into such contracts and agreements as it deems necessary to carry out the purposes of the provisions. Provides that neither the State, nor the Director of the Agency, nor any State employee shall be liable for any damages or injuries arising out of or resulting from any action taken under the provisions. Contains other provisions. Contains a severability provision. Effective immediately.
Amends the Prior Authorization Reform Act. Provides that a health insurance issuer may not require prior authorization for: a prescription drug prescribed to a patient by a health care professional for 6 or more consecutive months, regardless of whether the prescription drug is a non-preferred medication pursuant to the patient's health insurance coverage; the following prescription drugs or the therapeutic equivalent approved by the United States Food and Drug Administration: insulin; human immunodeficiency virus prevention medication; human immunodeficiency virus treatment medication; viral hepatitis medication; estrogen; and progesterone; or human immunodeficiency virus pre-exposure prophylaxis and post-exposure prophylaxis drugs approved by the United States Food and Drug Administration; Truvada; Harvoni; Descovy; and Apretude.
Creates the Compassionate Use and Research of Entheogens Act. Establishes the Illinois Psilocybin Advisory Board within the Department of Financial and Professional Regulation for the purpose of advising and making recommendations to the Department regarding the provision of psilocybin and psilocybin services. Provides that the Department shall begin receiving applications for the licensing of persons to manufacture or test psilocybin products, operate service centers, or facilitate psilocybin services. Contains licensure requirements and prohibitions. Provides that a licensee or licensee representative may manufacture, deliver, or possess a psilocybin product. Provides that a licensee or licensee representative may not sell or deliver a psilocybin product to a person under 21 years of age. Provides that a person may not sell, give, or otherwise make available a psilocybin product to a person who is visibly intoxicated. Creates the Psilocybin Control and Regulation Fund and the Illinois Psilocybin Fund and makes conforming changes in the State Finance Act. Requires the Department of Agriculture, the Department of Financial and Professional Regulation, and the Department of Revenue to perform specified duties. Contains provisions concerning rulemaking, taxes, fees, zoning, labeling, and penalties. Provides that beginning January 1, 2026, a tax is imposed upon purchasers for the privilege of using psilocybin at a rate of 15% of the purchase price. Preempts home rule powers. Contains other provisions. Amends the Illinois Vehicle Code. Provides that a person shall not drive or be in actual physical control of any vehicle within the State while there is any amount of a drug, substance, or compound in the person's breath, blood, other bodily substance, or urine resulting from the unlawful use or consumption of psilocybin as defined in the Compassionate Use and Research of Entheogens Act. Amends the Illinois Controlled Substances Act. Removes psilocybin and psilocin from the list of Schedule I controlled substances. Amends the Illinois Independent Tax Tribunal Act of 2012. Provides that the Tax Tribunal shall have original jurisdiction over all determinations of the Department of Revenue reflected on specified notices issued under the Compassionate Use and Research of Entheogens Act. Amends the Freedom of Information Act to exempt specific records from disclosure. Effective immediately.
Creates the Warehouse Pollution Reduction Act. Requires the Environmental Protection Agency to propose and the Pollution Control Board to adopt rules establishing a qualifying warehouse review program. Provides for reporting, recordkeeping, and notice requirements; annual emissions-reduction targets; and a system of points for air-pollution mitigation measures. Requires construction permits for new or modified qualifying warehouses and sets conditions for permit issuance, including zero-emission readiness and buffer requirements near sensitive receptors. Establishes a qualifying warehouse registry and requires public access to reports, notices, and permitting records. Provides for mitigation fees and directs their use in the same geographic area as the site of the qualifying warehouse. Requires the Agency to develop an air-quality modeling program and publish results annually. Creates the Warehouse Pollution Management Fund and provides for fee collection and deposit. Prohibits certain acts, provides civil penalties, authorizes enforcement and citizen suits, and allows recovery of attorney's fees. Limits home rule powers. Amends the State Finance Act to make a conforming change.
Amends the Consumer Fraud and Deceptive Business Practices Act. In provisions concerning medical debt, provides that it is an unlawful practice within the meaning of the Act for any person: (1) to use a medical debt listed on a consumer credit report as a negative or adverse factor when making a credit decision; or (2) to furnish information regarding a medical debt to a consumer reporting agency. Provides that a medical debt is void and unenforceable if a person to whom a medical debt is owed or an agent of that person knowingly furnishes information regarding the medical debt to a consumer reporting agency.
Amends the Illinois Insurance Code. Provides that a group or individual policy of accident and health insurance or a managed care plan that is amended, issued, delivered, or renewed on or after January 1, 2028 shall provide coverage for medically necessary epinephrine delivery systems. Removes language providing that "epinephrine injector" has the meaning set forth in the Epinephrine Injector Act. Provides that "epinephrine injector" includes an auto-injector approved by the United States Food and Drug Administration for the administration of epinephrine and a pre-filled syringe approved by the United States Food and Drug Administration and used for the administration of epinephrine that contains a pre-measured dose of epinephrine that is equivalent to the dosages used in an auto-injector. Includes epinephrine delivery systems in provisions concerning cost limitations for medically necessary epinephrine injectors.
Amends the School Code. Creates the Out-of-School Time (OST) Advisory Council for the purpose of providing information and advice to the Governor and State agencies regarding State and federal policy and funding issues affecting out of school time programs. Sets forth membership, co-chairperson's and meetings. Provides that the OST Advisory Council shall: (1) provide information on the status of funding provided for OST programs in each fiscal year; (2) provide recommendations on legislative and administrative action needed to ensure that funding for before and after school programs is allocated promptly to qualified providers of OST programs; (3) provide information on the quality of services and accountability measures that are appropriate for school-age children and youth; (4) provide information regarding challenges faced by OST programs that impede the provision of the best possible services; (5) provide recommendations on the equitable reach of OST programs to ensure that the State has policies in place that promote access to the children and youth most in need of services; (6) make recommendations to the Governor and State agencies on reporting requirements, priority points, statewide evaluation, and licensure for OST programs; and (7) create and deliver to the Governor and General Assembly an annual report on statewide successes in OST and areas of growth for the future. Effective July 1, 2025.
Proposes to amend the General Provisions Article of the Illinois Constitution. Clarifies that artificial persons exist only by grant of the State and shall have no powers or privileges except those expressly provided by the Illinois Constitution or the laws of the State. Revokes all powers previously granted to any artificial person under the laws of the State. Re-grants powers to artificial persons, to the extent that those powers do not include the power to conduct any election activity or ballot-issue activity. Provides that any election activity or ballot-issue activity conducted by an artificial person is ultra vires and void. Effective upon being declared adopted.
Amends the Criminal Code of 2012 and the Unified Code of Corrections. Eliminates felony murder as an element of first degree murder. Creates felony murder as a separate class of felony. Provides that a person commits felony murder when he or she, acting alone or with one or more participants, commits or attempts to commit a forcible felony, other than second degree murder, and in the course of or in furtherance of that crime or flight from that crime, he or she or another participant causes the death of a person, other than one of the participants. Provides that the sentence of imprisonment for felony murder shall be a determinate sentence of not less than 8 years and not more than 40 year, subject to the parole review provisions for persons who committed the offense when under 21 years of age. Provides that an extended term sentence for felony murder shall be not less than 16 years and not more than 80 years. Amends various Acts to make conforming changes.
