MEDICARE/MEDICAID DUAL ELIGIBL

Amends the Medicare-Medicaid Alignment Initiative (MMAI) Nursing Home Residents' Managed Care Rights Law of the Illinois Public Aid Code. Provides that the Article applies to a fully integrated dual eligible special needs plan and any managed care plan for persons who are dually eligible for Medicare and Medicaid. Adds to the definition of "Demonstration Project", a fully integrated dual eligible special needs plan and any managed care plan for persons who are dually eligible for Medicare and Medicaid. Provides that the Department of Healthcare and Family Services shall provide each managed care organization with the quarterly facility-specific nursing component (instead of RUG-IV nursing component) per diem along with any add-ons for enhanced care services, support component per diem, and capital component per diem effective for each nursing home under contract with the managed care organization. Effective immediately.

PEN CD-TEACHERS-RE-EMPLOYMENT

Amends the Downstate Teacher Article of the Illinois Pension Code. Provides that, through June 30, 2029 (instead of June 30, 2026), an annuitant may accept employment as a teacher without impairing his or her retirement status if that employment is not within the school year during which service was terminated and does not exceed 120 paid days or 600 paid hours in each school year, but not more than 100 paid days in the same classroom. Makes a conforming change. Effective immediately.

PROHIBITED FOOD ADDITIVES

Amends the Illinois Food, Drug and Cosmetic Act. Provides that, beginning January 1, 2027, a person or entity shall not manufacture a food product for human consumption that contains brominated vegetable oil, potassium bromate, propylparaben, or red dye 3. Provides that, beginning January 1, 2028, a person or entity shall not sell, deliver, distribute, hold, or offer for sale a food product for human consumption that contains any of those substances. Provides that a person or entity that violates the prohibition shall be liable for a civil penalty not to exceed $5,000 for a first violation and not to exceed $10,000 for each subsequent violation, with enforcement by the Attorney General or a State's Attorney. Makes a conforming change.

DISPOSABLE FOOD CONTAINER ACT

Creates the Disposable Food Service Container Act. Provides that, beginning January 1, 2030, a person may not sell or distribute in this State a disposable food service container that is composed in whole or in part of polystyrene foam. Specifies that the prohibition does not apply to any activity authorized under an ordinance or resolution adopted by a unit of local government on or before January 1, 2024 or with respect to sales made to a unit of local government for use by the unit of local government for its internal operations. Sets forth penalties for violations of the Act. Limits home rule powers. Effective immediately.

HIGHER ED-PREVENT SEX VIOLENCE

Amends the Preventing Sexual Violence in Higher Education Act. Makes changes concerning definitions. Requires a higher education institution's comprehensive policy to include sexual harassment. Provides that a confidential advisor is separate from a complaint advisor, unless a complainant chooses to have the confidential advisor also serve as the complaint advisor. Makes changes to the complaint resolution procedure, including the timeline of the complaint resolution procedure, protective measures and accommodations, the distribution of evidence that includes a private or intentionally digitally altered sexual image, the direct questioning of either party, support persons for survivors and respondents, and the notice of appeal. Provides that violations of the Act are actionable in civil court. Sets forth the relief a prevailing survivor is entitled to. Amends the Code of Civil Procedure to make changes concerning confidential advisors. Makes other changes. Effective July 1, 2027.

CORP OWNERSHIP REAL ESTATE

Creates the Restock the Block Act. Imposes on a "covered entity" an annual fee of 10% of the property value of each residential property owned by the covered entity in excess of 10 single family homes or 8 multi-family homes. Provides that this fee is to be deposited into the Illinois Affordable Housing Trust Fund with the purpose of funding public housing projects and developments and providing rental and mortgage assistance. Provides that a "covered entity" is an institutional real estate investor or an entity that receives funding from an institutional real estate investor for the purchase of a residential property. Makes exceptions. Provides that an "Institutional real estate investor" is an entity or combined group that, directly or indirectly (1) owns 10 or more single-family homes or 8 or more multi-family homes; (2) manages or receives funds pooled from investors and acts as a fiduciary one or more investors; and (3) has $30,000,000 or more in net value or assets under management on any day during the taxable year. Provides that it is unlawful for a covered entity to purchase, acquire, or offer to purchase or acquire any interest in residential property unless the residential property has been listed for sale to the general public for at least 90 days. Provides that a covered entity that violates these provisions may be subject to civil damages and penalties in an amount not to exceed $250,000. Requires that the covered entity is required to submit to the seller or anyone acting as an agent for the seller a form stating that the purchaser is a covered entity and file that form within 3 days with the Department of Human Services. Makes conforming changes to the Illinois Affordable Housing Act.

RENTAL PAYMENT INFO-REPORTING

Amends the Landlord and Tenant Act. Provides that any landlord of a dwelling unit of residential real property must offer any tenant the option of having the tenant's rental payment information reported to at least one nationwide consumer reporting agency as long as the consumer reporting agency resells or otherwise furnishes rental payment information to a nationwide consumer reporting agency. "Rental payment information" means information regarding a tenant's complete, timely payments of rent. Requires that before reporting a tenant's rental history information, the landlord must first provide written notice of the offer and obtain written authorization from the tenant electing to have the rent reported. Specifies what information the notice must contain. Provides that if a tenant elects to have that tenant's rental payment information reported to a consumer reporting agency, the landlord may require that the tenant pay a fee not to exceed the actual cost to the landlord to provide the service plus $5 per month. Provides that the payment or nonpayment of this fee by the tenant may not be reported to a consumer reporting agency. Exempts a landlord of a residential rental building that contains 15 or fewer dwelling units, unless the landlord: (1) owns more than one residential rental building, regardless of the number of units in each building; and (2) is a corporation, limited liability company in which at least one member is a corporation or a real estate investment trust. Makes other changes.
