CRIM CD-CHILD PORNOGRAPHY

Amends the Criminal Code of 1961. Repeals provision creating the offense of aggravated child pornography. In the statute creating child pornography, provides for enhanced penalties if the child depicted is under the age of 13. Provides that the issue of whether the child depicted is under the age of 13 is an element of the offense to be resolved by the trier of fact.

PREVAIL WAGE REVISION NOTICE

Amends the Prevailing Wage Act. Provides that a public body may make required notifications regarding revisions in the prevailing rate of hourly wages by publishing an ordinance or resolution stating the public body's adherence to the prevailing wage requirements and posting a link with the revised rate schedule on the public body's official website.

RES BUILD CODE RADON

Amends the Illinois Residential Building Code Act. Provides that a contract to build a home must contain, in addition to the adoption of a referenced building code, a provision requiring that a radon mitigation system be included in the construction. Effective immediately.

SCH CD-HS GRAD ACHIEVEMENT

HUMAN TRAFFICKING LIMITATIONS

Amends the Criminal Code of 1961. Provides that the statute of limitations for a prosecution for involuntary servitude, involuntary sexual servitude of a minor, or trafficking in persons for forced labor or services may be commenced within one year of the victim attaining the age of 18 years. Provides that in no case shall the time period for prosecution of those offenses expire sooner than 3 years after the commission of the offense. Includes in the offense of involuntary servitude using a scheme, plan, or pattern intended to cause the person to believe that, if the person did not perform that labor or services, that person or another person would suffer serious harm or physical restraint. Amends the Code of Criminal Procedure of 1963. Provides that in prosecutions for involuntary servitude, involuntary sexual servitude of a minor, and trafficking in persons, when the offense involves sexual activity, the prior sexual activity or the reputation of the alleged victim or corroborating witness is inadmissible except under certain circumstances. Amends the Sex Offender Registration Act. Includes in the definition of "sex offense" trafficking in persons, involuntary servitude, and related offenses, provided the offense involved commercial sexual activity, a sexually-explicit performance, or the production of pornography. Also includes in the definition of "sex offense", involuntary sexual servitude of a minor.

OPEN MTGS-PREPAID TUITION FUND

Amends the Open Meetings Act. Provides that the provision that authorizes closed meetings to be held to consider the sale or purchase of securities, investments, or investment contracts does not apply to meetings held to consider the investment of assets or income of funds deposited into the Illinois Prepaid Tuition Trust Fund. Effective immediately.

RIGHT TO PRIVACY-SOCIAL NET

Amends the Right to Privacy in the Workplace Act. Provides that it shall be unlawful for any employer to ask any prospective employee to provide any username, password, or other related account information in order to gain access to a social networking website where that prospective employee maintains an account or profile.

CHARGES ON PHONE BILLS

Amends the Consumer Fraud and Deceptive Business Practices Act concerning product and services charges billed on telephone bills. Provides that a third-party vendor shall not bill a consumer for goods or services that will appear as a charge on a consumer's telephone bill. Effective immediately.

VICTIMS RIGHTS&NOTICE

Amends the Illinois Police Training Act. Provides that the curriculum for probationary police officers shall include training in techniques designed to promote effective communication at the initial contact with crime victims and ways to comprehensively explain to victims and witnesses their rights under the Rights of Crime Victims and Witnesses Act and the Crime Victims Compensation Act. Amends the Rights of Crime Victims and Witnesses Act. Provides that any law enforcement agency that investigates an offense committed in the State shall provide a crime victim with a written statement and explanation of the rights of crime victims within 48 hours of law enforcement's initial contact with a victim. Provides that the Clerk of the Circuit Court shall post the rights of crime victims set forth in the Illinois Constitution and the Act within 3 feet of the door to any courtroom where criminal proceedings are conducted. Provides that the clerk may also post the rights in other locations in the courthouse. Provides that when the defendant has been committed to the Department of Human Services, the victim may request to be notified by the releasing authority of the approval by the court of an on-grounds pass, a supervised off-grounds pass, an unsupervised off-grounds pass, or conditional release; the release on an off-grounds pass; the return from an off-grounds pass; transfer to another facility; conditional release; escape; death; or final discharge from State custody.
