RESOLVED, BY THE SENATE OF THE NINETY-THIRD GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, THE HOUSE OF REPRESENTATIVES CONCURRING HEREIN, that when the two Houses adjourn on Friday, July 02, 2004, the Senate stands adjourned until Tuesday, July 06, 2004 at 2:00 o'clock p.m.; and the House of Representatives stands adjourned until Monday, July 05, 2004, at 9:16 o'clock a.m.

Creates the Dog and Cat Overpopulation Control Act. Establishes the Dog and Cat Population Control Program to reduce the population of unwanted and stray dogs and cats by encouraging the owners of dogs and cats to have them sexually sterilized. Provides guidelines for participation in the Program by dog and cat owners and veterinarians. Grants rulemaking power to the Department of Agriculture. Provides that violation of any provision of this Act may result in an administrative fine not to exceed $1,000 for each violation. Creates the Dog and Cat Animal Population Control Fund. Provides that each county board shall, in addition to the individual animal and litter registration fee, impose a $2 dog and cat population control fee on each registered dog and cat beginning January 1, 2005. Preempts home rule powers. Amends the State Mandates Act to require implementation without reimbursement. Effective immediately.
Creates the Displaced Building Service Workers Protection Act. Provides protections to building service employees who are regularly assigned to a covered building on a full or part-time basis for at least 90 days immediately preceding a transition in employment and who perform work in connection with the care or maintenance of an existing building. Provides that a successor building owner, manager, or contractor shall be required to offer employment to the predecessor employer's incumbent building service employees, subject to the existence of cause, for a period of 90 days following the transition at the affected building. Provides that at the end of the 90 day transition period, the successor employer perform written performance evaluations and offer continued employment to all covered building service employees who receive satisfactory ratings. Excludes from coverage employees who earn more than $25 per hour, work less than 6 hours per week, or serve in a managerial, supervisory, or confidential capacity. Exempts from coverage those successor employers who are already or agree to become bound by the terms of a collective bargaining agreement that includes provisions that address the discharge or lay off of building service employees. Exempts any predecessor employer that obtains a written commitment from a successor employer providing that the successor employer's building service employees will be covered by a collective bargaining agreement that addresses the discharge or layoff of employees. Effective immediately.
Amends the School Code. Provides that if a proposition to increase the educational purposes tax rate of a school district (other than the Chicago school district) is approved at any election held prior to March 19, 2004 and that proposition sets forth the tax rate most recently extended for educational purposes as the existing maximum authorized educational purposes tax rate of the district, then the maximum-authorized educational purposes tax rate of the district shall be calculated as follows: (i) for the first tax year affected by the results of the referendum, the district's tax rates shall be calculated based on the rates set forth in the proposition, and (ii) for each tax year thereafter, the district's maximum-authorized educational purposes tax rate approved at the referendum shall be equal to the sum of the district's maximum-authorized educational purposes tax rate immediately preceding the referendum plus the difference between the rates set forth in the proposition submitted to the voters of the district at the referendum. Allows the school board, within 10 days after the effective date of the amendatory Act, to amend its certificate of tax levy for any year for which its equalized assessed valuation has not yet been certified by the county clerk. Effective immediately.

Creates the Uniform Limited Partnership Act (2001). Provides procedures for the formation, operation, and regulation of limited partnerships. Repeals the Revised Uniform Limited Partnership Act. Amends other Acts to make conforming changes.
Creates the Right to Breastfeed Act. Contains only a short title provision.
Creates the Energy Efficient Commercial Building Act. Establishes an Energy Efficient Commercial Building Code that applies to commercial buildings in this State. Provides for technical assistance to certain design professions to explain the requirements of the Code. Preempts home rule powers. Effective one year after becoming law.
Amends the Illinois Securities Law of 1953. Removes from the definition of security, a certificate of deposit. Effective immediately.
Amends the Illinois Insurance Code in relation to surplus line insurance. Provides that surplus line insurance may be procured from unauthorized insurers or domestic surplus line insurers as defined. Requires each surplus line insurance policy or contract for insurance have stamped or imprinted on the first page of the policy or contract a notice to the policyholder that the issuing company is not covered by the Illinois Insurance Guaranty Fund because the issuing company is either (i) not authorized and licensed to transact business in Illinois or (ii) a domestic surplus line insurer. Effective immediately.
