Sen. Don Harmon

Amends the Perinatal HIV Prevention Act. Provides that every health care professional who provides health care services to a pregnant woman shall provide the woman with HIV counseling and perform (instead of recommend) HIV testing in accordance with the Centers for Disease Control and Prevention's Revised Recommendations for HIV Testing of Adults, Adolescents, and Pregnant Women in Health-Care Settings, unless she has already received an HIV test during pregnancy or she refuses in writing to take the test. Provides that every health care professional who provides health care services to a pregnant women, prior to providing an HIV test, must provide the pregnant woman with oral or written information and inform the woman of her right to refuse the test, and, upon request, provide the woman with the necessary forms to register her refusal. Provides that every health care professional who provides health care services to a pregnant woman shall not perform HIV testing on that woman after she has refused the test in writing, unless she withdraws her refusal in writing. Provides that for women at continued risk of exposure to HIV infection in the judgment of the health care professional, a repeat test should be provided (instead of recommended) late in pregnancy or at the time of labor and delivery, unless the woman refuses to the test in writing. Provides that the provision of pre-test information or refusal of testing shall be documented in the woman's medical record. Provides that any testing, provision of pre-test information, and prenatal information must be in accordance with the Centers for Disease Control and Prevention recommendations. Makes other changes.

Amends the Public Utilities Act. Includes in the criteria for a utility to obtain a certificate of public conveyance and necessity that it may demonstrate to the Illinois Commerce Commission that the proposed construction is required to promote the development of an effectively competitive electricity market. Includes the promotion of the development of an effectively competitive electricity market within the criteria for authorizing additions, extensions, repairs, or improvements to, or changes in, the existing plant, equipment, apparatus, facilities, or other physical property of any public utility or of any 2 or more public utilities.

Mourns the death of Dick Glennie of Oak Park.

Amends the Criminal Code of 1961. Provides that a prosecution for criminal sexual assault, aggravated criminal sexual assault, or aggravated criminal sexual abuse may be commenced at any time if the victim submitted to an evidentiary medical examination within 72 hours after the commission of the offense, and reported the offense to law enforcement authorities within 120 hours after the commission of the offense. Provides that evidentiary examinations performed under this provision, together with the preservation of evidence and information derived therefrom, shall be performed according to procedures and standards that the Department of State Police shall by rule create. Provides that the Director of State Police shall promulgate all rules necessary to carry out the purposes of this provision.

Mourns the death of William Hugh Davis of Oak Park.

Creates the National Guard Veterans Exposure to Hazardous Materials Act. Provides that on and after October 1, 2007, the Adjutant General shall assist any member of the Illinois National Guard who served in the Persian Gulf War or in an area designated as a combat zone by the President of the United States during Operation Enduring Freedom or Operation Iraqi Freedom who (i) has been assigned a risk level I, II, or III for depleted uranium exposure by his or her branch of service, (ii) is referred by a military physician, or (iii) has reason to believe that he or she was exposed to depleted uranium during such service, in obtaining federal treatment services, including a best practice health screening test for exposure to depleted uranium. Provides that no State funds shall be used to pay for such tests or other federal treatment services. Requires the Adjutant General to submit a report to the General Assembly by October 1, 2007. Creates a task force to: (1) initiate a health registry for veterans and military personnel returning from Afghanistan, Iraq, or other countries in which depleted uranium or other hazardous materials may be found; (2) develop a plan for outreach to and follow-up of military personnel; (3) prepare a report for service members concerning potential exposure to depleted uranium and other toxic chemical substances and the precautions recommended under combat and noncombat conditions while in a combat zone; and (4) make other recommendations. Requires the task force to submit a report to the General Assembly by January 31, 2008, and terminates the task force on the date that it submits the report or on January 31, 2008, whichever is earlier. Effective immediately.

Amends the Public Building Commission Act. Provides that the Commission may acquire fee simple title or a lesser interest in real property located within the District (now, fee simple only). Provides that the Commission may rent all or part of its buildings to certain entities for any period of time (now, for a period not to exceed 30 years). Increases the maximum moving allowance and the maximum optional fixed relocation payment for displaced persons. Increases to $10,000 (now, $5,000) the minimum dollar amount of contracts that must be let for open competitive bidding. Requires public advertisement of contracts let for open competitive bidding at least once (now, at least once in each week for 3 consecutive weeks prior to the opening of bids) in a daily newspaper of general circulation in the county where the commission is located. Provides an emergency situation exception to the publication requirement for contracts subject to open competitive bidding. Requires all bids to be open to public inspection after an award or final selection has been made (now, for a period of at least 48 hours before an award is made). Deletes a requirement that a copy of every contract entered into by the public building commission shall be executed in duplicate. Effective immediately.

Amends the School Code. Makes a technical change in a Section concerning school energy conservation.

Amends the Probate Act of 1975. Provides that the term "developmental disability" includes a disability that is attributable to "fetal alcohol syndrome" or "fetal alcohol effects" (in addition to mental retardation, cerebral palsy, epilepsy, or autism). Effective January 1, 2008.

Amends the Illinois Vehicle Code and the State Finance Act. Creates the Sheet Metal Workers International Association of Illinois Fund as a special fund in the State treasury. Provides for the issuance of Sheet Metal Workers International Association license plates. Provides that in addition to the appropriate registration fees, an applicant for the special plate shall be charged a fee of $25 at original issuance and at renewal. Provides that $10 of the additional original issuance fee and $23 of the renewal fee shall be deposited into the Sheet Metal Workers International Association of Illinois Fund. Provides that $15 of the original issuance fee and $2 of the renewal fee shall be deposited into the Secretary of State Special License Plate Fund. Provides that, subject to appropriation by the General Assembly and approval by the Secretary of State, the moneys in the Sheet Metal Workers International Association of Illinois Fund shall be paid as grants for charitable purposes sponsored by Illinois local chapters of the Sheet Metal Workers International Association.
