UTIL-GAS-PURCHASE RECEIVABLES

Amends the Alternative Gas Supplier Law in the Public Utilities Act. Provides that a gas utility with more than 100,000 customers that offers transportation service to residential and small commercial customers shall file a tariff with the Illinois Commerce Commission pursuant to specified provisions within 6 months after the date of the amendatory Act that provides alternative gas suppliers with the option to have the gas utility purchase their receivables for gas supply service provided to residential retail customers and small commercial customers. Contains provisions concerning the purchase of receivables.

PUBLIC BUILD COMM-DESIGN-BUILD

Amends the Public Building Commission Act. Sets forth the procedure for selecting a successful design-build entity. Provides that the Commission may award a design-build contract to a qualified design-build entity that offers the best value in terms of quality, cost, and proposed time of completion. Authorizes the Commission to enter into competitive negotiations with qualified design-build entities. Contains other provisions. Effective immediately.

CIV-SUPERSEDEAS BOND

Amends the Code of Civil Procedure by adding a new Section. Provides that in civil litigation under any legal theory, execution of the judgment shall be stayed during appellate review upon the posting of a supersedeas bond set in accordance with law or court rules, except that the total supersedeas bond that is required of all appellants collectively shall not exceed $75,000,000, regardless of the judgment amount. Provides that if an appellee proves that an appellant is dissipating assets outside the ordinary course of business to avoid payment of a judgment, a court may require the appellant to post a supersedeas bond in an amount up to the total judgment amount. Effective immediately.

CMS-COMPUTER DATA SECURITY

Amends the Data Security on State Computers Act. Requires overwriting of data on State electronic data processing equipment at least 3 times (now, at least 10 times) before the equipment is sold, donated, transferred, or relinquished. Effective immediately.

FOREST PRESERVE DIST-ELECTIONS

Amends the Downstate Forest Preserve District Act. Provides that, beginning with the general election in 2012 and each succeeding general election, a forest preserve district shall be divided into 6 districts and one commissioner of the forest preserve district shall be elected from each district that is co-extensive with a county with a population of more than 800,000 but less than 3,000,000 (now, commissioners of the forest preserve district are elected from the same districts as members of the county board). Provides that by July 1, 2011 and each 10 years thereafter, the board of commissioners of a forest preserve district shall develop an apportionment plan for the district. Sets forth the requirements for the apportionment plan. Provides that, if any forest preserve district fails to complete the reapportionment of its district by July 1 in 2011 or any 10 years thereafter, the county clerk of that county shall convene the county apportionment commission to develop the apportionment plan. Sets forth the requirements for filing an apportionment plan. Provides that, if no apportionment plan is filed, then the commissioners of the forest preserve district shall be elected at large in the district. Effective immediately.

PEN CD-FUND-OF-FUND MANAGEMT

Amends the Illinois Pension Code. Requires that a description of every contract for qualified fund-of-fund management services must be posted in a conspicuous manner on the web site of the retirement system, pension fund, or investment board and must include the name of the fund-of-funds, the name of its investment adviser, the total investment commitment of the retirement system, pension fund, or investment board to invest in such fund-of-funds, and a disclosure approved by the board describing the factors that contributed to the investment in such fund-of-funds. Effective immediately.

ADMIN HEARINGS OFFICE

Amends the Illinois Administrative Procedure Act to create the Office of Administrative Hearings. Provides that the Office shall conduct administrative hearings for agencies under the jurisdiction of the Governor, except for the Illinois Public Labor Relations Board, the Illinois Educational Labor Relations Board, the Illinois Commerce Commission, the Illinois Workers' Compensation Commission, the Civil Service Commission, the Pollution Control Board, the Illinois State Police Merit Board, the Property Tax Appeal Board, the Human Rights Commission, and the State Board of Elections. Provides for the appointment of a Chief Administrative Law Judge by the Governor with the advice and consent of the Senate. Sets the powers and duties of the Chief Administrative Law Judge. Sets qualifications for administrative law judges employed by the Office. Sets out procedures for the conduct of administrative hearings by the Office. Provides for the transfer of personnel and property to the Office from State agencies. Amends the Personnel Code to exempt employees of the Office from the provisions of the Code. Effective immediately.
