Amends the Senior Citizens Real Estate Tax Deferral Act. Provides that the term "taxpayer" means an individual whose household income for the year is no greater than $45,000 (now, $40,000). Effective immediately.

Amends the Criminal Code of 1961. Provides that obstructing justice also consists of destroying, altering, concealing, disguising, or otherwise tampering with DNA fingerprinting evidence. Provides that the penalty is a Class 3 felony. Amends the Code of Criminal Procedure of 1963 and the Unified Code of Corrections. Provides that every person arrested for committing a felony shall have a sample of his or her saliva or tissue taken for DNA fingerprinting analysis, at the time of booking, for the purpose of determining identity and for certain other specified purposes. Provides that subject to appropriation, the Department of State Police shall implement this provision. Provides that this provision becomes operative no later than the earliest of the following: (1) two years after the effective date of this amendatory Act; (2) the date on which the Department of State Police informs law enforcement agencies that the Department is ready to collect samples; or (3) January 1, 2009.
Amends the Private Sewage Disposal Licensing Act. Makes a technical change to a Section concerning the short title.
Amends the Environmental Protection Act. In a definitions Section, provides that the term "waste" does not include discarded materials that are: (i) collected for recycling; (ii) processed for recycling; or (iii) recovered for reuse (now, waste includes all discarded material). Defines "reclamation", "recycling", and "reuse" as individual terms (now, single definition for recycling, reclamation, or reuse). Amends the Solid Waste Planning and Recycling Act and the Solid Waste Management Act to make corresponding changes. Effective immediately.
Amends the State Finance Act. Deletes any authority to make transfers in FY07 from the Grade Crossing Protection Fund (misdesignated as the Grade Crossing Prevention Fund) to the General Revenue Fund. Requires any transfers that have been made to be retransferred. Effective immediately.
Amends the Illinois Enterprise Zone Act. Makes a technical change in a Section concerning the short title.
Amends the Illinois Endangered Species Protection Act. In a Section requiring units of local government and State agencies (now, agencies and local governments) to consult with the Department as to whether actions authorized, funded, or carried out by them are likely to jeopardize the continued existence of Illinois listed endangered and threatened species or are likely to result in the destruction or adverse modification of the essential habitat of such species, authorizes any party seeking authorization or funding to initiate the consultation process on behalf of the State agency or unit of local government from which the authorization or funding is sought. Provides that, if a unit of local government or State agency is diligently proceeding with the consultation process in accordance with this Act, the unit of local government or State agency shall not be subject to any claim of inverse condemnation. Requires the Department to assign an expiration date to each individual compliance consultation. Adds certain definitions. Amends the Illinois Natural Areas Preservation Act to make corresponding changes. Makes other changes. Effective immediately.
Amends the Illinois Vehicle Code and the Criminal Code of 1961. Provides that the vehicle of a person who is involved in an accident while driving without liability insurance coverage is subject to seizure and forfeiture, regardless of whether or not the person was at fault. Provides that the vehicle may be forfeited to the spouse of the owner, or to a properly licensed family member, if the spouse can show that the seized vehicle is the only source of transportation for the family and its forfeiture would cause undue hardship. Effective immediately.
Amends the Department of Commerce and Economic Opportunity Law of the Civil Administrative Code of Illinois. Makes a technical change in a Section concerning the short title of the law.
Amends the Open Meetings Act. Redefines "meeting" to include gatherings, whether in person or by telephone call, electronic means, or other means of contemporaneous interactive communication, of a majority of a quorum of the members of a public body held for the purpose of discussing public business (now, a gathering of a majority of a quorum of the members of a public body held for the purpose of discussing public business). Provides that if a majority of a quorum of the members of a public body are physically present at a meeting, then a majority of a quorum may allow a member of that body to attend a meeting by other means, subject to certain limitations. Defines "other means" as by telephone call, electronic means, or other means of contemporaneous interactive communication. Provides that a quorum of the members must be physically present for the public body to vote on the issuance of bonds. Provides that transmissions by other means made during a meeting by a member who is in attendance shall be made available to the public contemporaneously with the transmission and in such a manner or format that the public body and the public may contemporaneously hear or observe the transmission. Allows a public body to adopt rules concerning attendance at meetings by electronic means. Requires the agenda to disclose all locations at which members of the public may attend a meeting at which one or more members are present by a means other than physical presence. Requires the physical presence of the person testifying in any contested case, as defined in the Illinois Administrative Procedure Act, unless all parties waive the requirement of physical presence. Requires minutes of all public bodies to reflect whether members were physically present or present by other means. Makes other changes.
