Amends the State Finance Act. Excludes moneys received by the Department of Financial and Professional Regulation under the Illinois Credit Union Act from those moneys required to be deposited into the Financial Institution Fund. Makes certain provisions concerning transfers to the General Revenue Fund inapplicable to (i) any fund established under the Illinois Credit Union Act, the Illinois Banking Act, the Illinois Savings and Loan Act of 1985, or the Savings Bank Act and (ii) the Professions Indirect Cost Fund. Limits transfers and expenditures from those funds to specified purposes. Prohibits the allocation or transfer of additional amounts generated by certain fee increases with respect to or from the Credit Union Fund. Amends the Illinois Banking Act, the Illinois Savings and Loan Act of 1985, and the Savings Bank Act. With respect to the moneys in each of the Bank and Trust Company Fund, the Savings and Residential Finance Regulatory Fund, and the Credit Union Fund, (i) exempts those moneys from assignment or transfer except for unappropriated administrative expenses and (ii) provides that the moneys remain the property of and must be held in trust for the financial institutions from which they were collected. For FY08, requires the Commissioner of Banks and Real Estate (now, the Director of the Division of Banks and Real Estate) to adopt rules to adjust regulatory fee rates in the specified manner. Amends the Illinois Credit Union Act. Provides that the regulatory fee paid by a credit union to the Department of Financial and Professional Regulation shall be the lesser of (i) the rate pursuant to the regulatory fee schedule or (ii) a rate established in a manner proportionately consistent with the rates in the regulatory fee schedule and that would fund the actual administrative and operational expenses of the Credit Union Section. Increases rates in the regulatory fee schedule for credit unions with total assets over $5,000,000. Requires the Director of Financial and Professional Regulation to adjust the fee schedule for the next fiscal year. Provides that the fee schedule may be increased by no more than 5% annually if necessary to defray the actual (now, estimated) administrative and operational expenses of the Credit Union Section (now, the Department). Prohibits any increase in the fee schedule if the amount remaining in the Credit Union Fund at the end of the fiscal year is equal to or greater than 25% of the actual administrative and operational expenses for the preceding fiscal year. Requires the Director to base the regulatory fee for the next fiscal year on the credit union's total assets as of December 31 of the preceding calendar year. Beginning on July 1, 2005, requires a credit union to pay the regulatory fee in quarterly installments due and payable on the due date for the call report for the preceding quarter (now, a credit union is required to pay the regulatory fee in full no later than March 1 of each calendar year). Provides for a regulatory fee cap of $125,000 (now, $187,500). Effective immediately.

Amends the Counties Code. Provides that if human remains are unclaimed by family or friends, the coroner may bury or, at his or her option, cremate the remains (now, the coroner may only bury). Provides that cremation shall not be utilized if the preservation of the body is necessary or desirable for law enforcement purposes or if information about the deceased indicates that cremation is inconsistent with the religious beliefs of the deceased. Effective immediately.
Amends the Clinical Social Work and Social Work Practice Act. Makes a technical change in a Section concerning the powers and duties of the Department.
Amends the Regional Transportation Authority Act. Makes a technical change in a Section concerning the short title.
Amends the Counties Code. Makes a technical change in a Section concerning setting restrictions on the reduction of the size of a county.
Amends the Uniform Disposition of Unclaimed Property Act. Provides that funds and stock distributable in the course of a demutualization, rehabilitation, or related reorganization of an insurance company shall be deemed abandoned in the listed time frames. Provides that funds and stock deemed abandoned in the course of a demutualization, rehabilitation, or related reorganization of an insurance company shall be held in the Demutualization Trust Fund. Provides that the State Treasurer shall set a date that the required report and remittance of the funds and stock deemed abandoned in the course of a demutualization, rehabilitation, or related reorganization of an insurance company shall be filed. Provides that the names of owners that are identified and contacted directly by the State Treasurer do not have to be published as required under the notice requirements. Amends the State Finance Act. Creates the Demutualization Trust Fund. Exempts the Demutualization Trust Fund from transfers to the General Revenue Fund. Effective immediately.
Amends the Disabilities Services Act of 2003. Provides that the purpose of the Act is to further develop and implement (rather than create an advisory committee to develop and implement) a Disability Services Plan that ensures compliance by the State of Illinois with the Americans with Disabilities Act and the Olmstead decision. Sets forth that services to persons with disabilities shall be provided in the most integrated setting appropriate to the needs and choices of the person with the disability and his or her guardian in accordance with an individual service or treatment plan developed with the person with the disability. Defines "most integrated setting" to mean the setting that enables a person with a disability to interact with nondisabled persons to the fullest extent possible and that is appropriate to meet the needs and choices of the person with the disability and his or her guardian. Requires the comprehensive evaluation and diagnosis of a person determined probably eligible for disability services to include an assessment of skills, abilities, and potential for community residential placement from among a full array of residential options, including in-home supports, job training, and work placement (now, potential for residential and work placement). Changes the requirements for the services provided to persons with disabilities including: family or individual support services, residential services, education, vocational habilitation and rehabilitation, employment, independent service coordination, mental health supports, and assistive technology devices and services for persons with disabilities. Authorizes the advisory committee to consult with other State officials when their expertise and resources are relevant to the resolution of a particular issue. Sets forth that the Governor, with the assistance of the advisory committee and the Secretary of Human Services, shall submit the Disability Services Plan to the General Assembly by March 31, 2006 (now, Governor responsible for the completion of the plan). Provides for annual reports of changes to the Plan to the General Assembly. Sets forth certain requirements for the Disability Services Plan. Provides due process protections for a person claiming to be aggrieved by a determination of an agency regarding eligibility for a disability service, the provision of a disability service, or a change in or termination of a disability service under the Act. Sets forth that a person with a disability shall not be denied a disability service because of sex, race, religion, ethnic origin, marital status, ability to pay (except where contrary to law), or criminal record. Makes other changes. Effective immediately.
Amends the Illinois Banking Act, the Illinois Savings and Loan Act of 1985, the Savings Bank Act, and the Illinois Credit Union Act. Makes a technical change in the short title provision of each of those Acts.
Amends the Liquor Control Act of 1934. Provides that the storage of alcoholic liquors by distributors at certain locations are subject to (i) approval by the Illinois Liquor Control Commission, (ii) the distributor complying with the Federal Alcohol Administration Act, (iii) the requirement that no alcohol be sold from the storage location, and (iv) compliance by the storage location with the provisions of any agreement between the distributor and manufacturers supplying alcoholic liquor for storage. Effective immediately.
Amends the Illinois Clean Indoor Air Act. Makes a technical change in a Section concerning definitions.
