HEALTH FACILITIES PERMITS

Amends the Illinois Health Facilities Planning Act. Provides that members of the Health Facilities and Services Review Board shall receive compensation for duties related to all attended, scheduled meetings of the full Board. Provides that the Chairman of the Board shall receive additional compensation for duties specific to the Chairmanship. Sets forth the requirements for the review of a permit application to establish, construct, or modify a health care facility. Sets forth the requirements for post-permit reports. Provides that a person whose application for a permit has been denied or whose permit has been revoked shall be afforded an opportunity for a hearing before an administrative law judge (now, a hearing officer) appointed by the Chairman of the Board (now, the Director of the Illinois Department of Public Health). Provides that a permit holder must submit the final completion and cost report within 90 days after the approved project completion date and submit annual progress reports. Provides that annual progress reports shall include information regarding the committed funds expended toward the approved project. Extends the deadline for the Board to establish certain rules concerning long-term care to September 30, 2011. Provides that a permit holder who fails to comply with certain post-permit and reporting requirements shall be fined an amount not to exceed $10,000 plus an additional $10,000 for each 30-day period, or fraction thereof, that the violation continues. Makes other changes. Effective immediately.

SCH CD-VEH CD-DRIVER EDUCATION

Amends the School Code and the Illinois Vehicle Code. Makes changes concerning notification of the public hearing on a waiver or modification of a mandate within the School Code or administrative rules and waivers and modifications for contracting with a commercial driver training school. Makes changes concerning driver education course reimbursement, the adoption of standards for driver education and driver education course content, a report on the per capita driver education cost for school districts, and the safety testing of motor vehicles used for driver education training. Effective January 1, 2013.

HUMAN TRAFFICKING LIMITATIONS

Amends the Criminal Code of 1961. Provides that the statute of limitations for a prosecution for involuntary servitude, involuntary sexual servitude of a minor, or trafficking in persons for forced labor or services may be commenced within one year of the victim attaining the age of 18 years. Provides that in no case shall the time period for prosecution of those offenses expire sooner than 3 years after the commission of the offense. Includes in the offense of involuntary servitude using a scheme, plan, or pattern intended to cause the person to believe that, if the person did not perform that labor or services, that person or another person would suffer serious harm or physical restraint. Amends the Code of Criminal Procedure of 1963. Provides that in prosecutions for involuntary servitude, involuntary sexual servitude of a minor, and trafficking in persons, when the offense involves sexual activity, the prior sexual activity or the reputation of the alleged victim or corroborating witness is inadmissible except under certain circumstances. Amends the Sex Offender Registration Act. Includes in the definition of "sex offense" trafficking in persons, involuntary servitude, and related offenses, provided the offense involved commercial sexual activity, a sexually-explicit performance, or the production of pornography. Also includes in the definition of "sex offense", involuntary sexual servitude of a minor.

COUNTIES CD-WAIVE JUROR FEES

Amends the Counties Code. Provides that a juror may elect to waive any fees paid for service, transportation, or day care, or any combination thereof, as well as the fees paid for attending an inquest.

VEH CD-WORK ZONES-CELL USE BAN

Amends the Illinois Vehicle Code. Provides that no person may use a wireless telephone at any time while operating a motor vehicle on any section of a highway that is undergoing a construction or maintenance project (instead of on a highway in a construction or maintenance speed zone).

CRIME VICTIMS RIGHTS

Proposes to amend the Bill of Rights Article of the Illinois Constitution concerning crime victim's rights. Provides that in addition to other rights provided in the Constitutional provision, a crime victim has the right to: (1) be free from harassment, intimidation, and abuse; (2) refuse to disclose information that is privileged or confidential by law; (3) timely notification of post-trial proceedings; (4) be heard in person or in any other reasonable manner the victim chooses at any proceeding involving a post-arraignment release decision, plea, sentencing, post-conviction or post-adjudication release decision, or any proceeding in which a right of the victim is at issue; (5) receive a report prepared for sentencing, reduction in sentence, parole, early release, or clemency, when available to the accused; and (6) have the safety of the victim and the victim's family considered in denying or fixing the amount of bail, determining whether to release the defendant, and setting conditions of release after arrest and conviction. Provides that nothing in this Constitutional provision creates any cause of action for compensation or damages against the State, any political subdivision of the State, any officer, employee, or agent of the State or of any of its political subdivisions, or any officer or employee of the court. Effective upon being declared adopted.
