Amends the Counties Code. In provisions concerning the Home Rule County Use Tax Law, provides that, if a home rule county imposes a tax under the Home Rule County Use Tax Law, then the tax shall be collected by the Department of Revenue if the property is purchased at retail from a retailer in any county in this State other than the home rule county imposing the tax. Provides that the tax shall be remitted to the State or an exemption determination must be obtained from the Department before the title or certificate of registration for the property may be issued. Provides that the Department shall have full power to administer and enforce the Home Rule County Use Tax Law, to collect all taxes, penalties, and interest due under the Home Rule County Use Tax Law, to dispose of taxes, penalties, and interest collected under the Home Rule County Use Tax Law, and determine all rights to credit memoranda or refunds arising on account of the erroneous payment of tax, penalty, or interest. Provides that, if the Department determines that a refund shall be made under the Home Rule County Use Tax Law to a claimant instead of issuing a credit memorandum, then the Department shall notify the State Comptroller, who shall cause the order to be drawn for the amount specified, and to the person named, in the notification from the Department. Provides that, as soon as practicable, the Department shall pay over to the State Treasurer, ex officio, as trustee, for deposit into the Home Rule County Retailers' Occupation Tax Fund, all taxes, penalties, and interest collected under the Home Rule County Use Tax Law. Provides that a certified copy of an ordinance imposing or discontinuing the tax to be collected and enforced by the Department under the Home Rule County Use Tax Law shall be adopted and filed with the Department before the Department shall begin to collect the tax. Provides that the Department shall not begin collection and enforcement under the Home Rule County Use Tax Law before January 1, 2027. Provides that the home rule county that imposed the tax may collect a tax that the Department does not collect.

Amends the Illinois Pesticide Act. Provides that, except as expressly authorized under specific provisions of the Act, no person shall distribute, sell, offer for sale, or use in the State any herbicide product containing paraquat dichloride or any other chemical form of paraquat. Requires all persons that use, distribute, or sell paraquat in this State to report certain information to the Department of Agriculture. Directs the Department of Agriculture to adopt any rules necessary to implement and administer these provisions. Effective immediately.
Amends the School Code. In provisions concerning a school board's suspension or expulsion of pupils, provides that a student who is determined to have initiated sexual activity with another individual without that individual's consent, a sexual assault, or an attempted sexual assault at a school, a school-sponsored activity or event, or an activity or event that bears a reasonable relationship to school shall be expelled for a period of not less than one year. Provides that (i) a student initiates sexual activity with another individual without that individual's consent if the student uses force or a threat of force to make the other individual perform a nonconsensual sexual act; (ii) a student initiates a sexual assault if the student commits an act of sexual penetration and uses force or a threat of force; and (iii) a student initiates an attempted sexual assault if, with the intent to commit a sexual assault, the student commits an act that constitutes a substantial step toward the commission of a sexual assault. Allows the expulsion requirement to be modified by the superintendent of the school district and the superintendent's determination to be modified by the school board on a case-by-case basis. Provides that the expulsion shall be construed in a manner consistent with the federal Individuals with Disabilities Education Act and a student who is subject to expulsion may be eligible for a transfer to an alternative school program. Effective immediately.
Creates the Certified Anesthesiologist Assistant Practice Act. Provides for the licensure of certified anesthesiologist assistants by the Department of Financial and Professional Regulation. Sets forth provisions concerning: email address and address of record for all applicants and licensees; the function, powers, and duties of the Department; supervision requirements; applications for licensure; qualifications for licensure; endorsement by the Department of certified anesthesiologist assistants from another jurisdictions; criminal history records background checks; and other specified requirements. Amends the Regulatory Sunset Act to repeal the Certified Anesthesiologist Assistant Practice Act on January 1, 2030. Amends the Ambulatory Surgical Treatment Center Act and the Hospital Licensing Act. Provides that, in addition to the specified professionals, a licensed certified anesthesiologist assistant may assist a licensed physician, dentist, or podiatric physician. Provides that, in addition to the specified professionals, a licensed anesthesiologist assistant under the supervision of an anesthesiologist is an individual who, with clinical privileges granted at the hospital, may administer anesthesia services. Amends the Medical Practice Act of 1987. Provides that one member of the Illinois State Medical Board shall be a certified anesthesiologist assistant licensed to practice in Illinois. Establishes delegation of authority from a supervising anesthesiologist to a certified anesthesiologist assistant. Provides that the Act does not preclude a certified anesthesiologist assistant from performing specified actions.
Amends the Illinois Administrative Procedure Act. In provisions regarding the second notice period for rulemaking, provides that the second notice period shall be extended for a period not to exceed an additional 45 days if the agency has received a statement of unresponsiveness from the Joint Committee on Administrative Rules. Lists the requirements for a statement of unresponsiveness. Provides that failure to provide a substantive response within 7 days after a statement of unresponsiveness is issued shall constitute a withdrawal of the rulemaking. In provisions regarding the contents of the written notice to the Joint Committee, requires a statement certifying that no procedure, policy, schedule, or other feature of the agency will prevent the agency from substantively engaging with the Joint Committee regarding suggestions made during the second notice period. Effective immediately.
Amends the Assisted Living and Shared Housing Act, the MC/DD Act, and the ID/DD Community Care Act. Provides that notice of closure of an establishment or facility licensed under those Acts shall be given to the Office of the State Long Term Care Ombudsman.
Creates the Statewide Guardian Ad Litem Training Act. Provides that, after July 1, 2027, a guardian ad litem may not continue to serve as a guardian ad litem or receive an appointment to serve in a family law case or juvenile case unless the guardian ad litem completes training as required under this Act. Provides that, beginning July 1, 2027, a guardian ad litem must complete training on medical literacy. Requires the training to include, at a minimum, the following: (1) information regarding chronic medical conditions; (2) a module covering distinguishing medical advocacy from parental conflict; (3) information regarding consulting treating medical professions; (4) a module covering treatment adherence and risk; and (4) a module covering the ethical limits of a guardian ad litem's medical opinion. Provides that the Act is subject to the supervisory authority of the Illinois Supreme Court.
Creates the Judicial Sexual Assault Training Act. Requires the Administrative Office of the Illinois Courts to develop and implement a sexual assault continuing education program for judges and relevant court personnel. Provides issues to be included in the program. Requires the program to be included in the New Judge Seminar curriculum and be a mandatory program at the biennial Judicial Education Conference. Requires the Administrative Office of the Illinois Courts to make a record of a judge's completion of the program after the New Judge Seminar and the Judicial Education Conference and make that record available to the public upon request.
Amends the Illinois Insurance Code. Requires an individual or group policy of accident and health insurance amended, delivered, issued, or renewed in the State after June 1, 2026 to provide coverage for expenses for standard fertility preservation services and follow-up services related to that coverage. Defines "standard fertility preservation services" as procedures based upon current evidence-based standards of care established by the American Society for Reproductive Medicine, the American Society of Clinical Oncology, or other national medical associations that follow current evidence-based standards of care. Makes conforming changes in the State Employees Group Insurance Act of 1971, the Counties Code, the Illinois Municipal Code, the School Code, the Health Maintenance Organization Act, the Limited Health Service Organization Act, and the Illinois Public Aid Code. Effective immediately.
Amends the Illinois Pension Code. In the Downstate Police Article, provides that, beginning July 1, 2025, any line-of-duty disability pension shall be at least $40,000 per year (instead of $400 per month), without regard to whether the disability or death of the police officer occurred before July 1, 2025. In provisions concerning an annual increase in the line-of-duty disability pension, removes requirements that an applicant must file an affidavit stating that the applicant has not earned any income from gainful employment during the most recently concluded tax year; have service credit in the Fund for at least 7 years of active duty; and have been receiving a line-of-duty disability pension for a period which, when added to the officer's total service credit in the Fund, equals at least 20 years. In the Downstate Firefighter Article, provides that the minimum line-of-duty disability pension shall be at least $40,000 per year. Amends the State Mandates Act to require implementation without reimbursement. Effective immediately.
