$OAKBROOK TERRACE FLOOD CONTRO

Appropriates $217,300, or so much of that amount as may be necessary, from the General Revenue Fund to the Department of Commerce and Economic Opportunity for grant payments under grant agreement No. 01-128508 to the City of Oakbrook Terrace for flood control. Effective July 1, 2005.

IDENTITY THEFT NOTIFY ACT

Creates the Identity Theft Notification Act. Requires any agency, person, or business that conducts business in Illinois and owns or licenses data that includes personal information concerning an Illinois resident to notify the resident that there has been a breach of the security of that data following discovery or notification of the breach. Requires any agency, person, or business that maintains data that includes personal information concerning an Illinois resident and that the agency, person, or business does not own to notify the owner or licensee of the information of any breach of the security of the data immediately following discovery, if the personal information was, or is reasonably believed to have been acquired by an unauthorized person. Provides that notice may be provided in one of the following ways: (1) written notice; (2) electronic notice; or (3) substitute notice if the agency, person, or business demonstrates that the cost of providing notice would exceed $250,000, or the affected class of persons to be notified exceeds 500,000, or the agency, person, or business does not have sufficient contact information.

INC TX-EDUCATION EXPENSE CR

Amends the Illinois Income Tax Act. Provides that for taxable years ending on or after December 31, 2005, the education expense credit may not exceed $1,000 (now, $500). Effective immediately.

SCH CD-PSYCHOLOGIST-MASTR CERT

Amends the School Code. Provides that persons who are certified school psychologists and who have successfully achieved National Board certification through the National School Psychology Certification System shall be issued a Master School Service Personnel Certificate, valid for 10 years and renewable thereafter every 10 years through compliance with requirements set forth by the State Board of Education, in consultation with the State Teacher Certification Board. Under the Illinois Teaching Excellence Program, provides for an annual payment of $3,000 to be paid to each school psychologist who successfully completes the program leading to and who receives a Master Certificate and is employed as a school psychologist by a school district. Effective immediately.

SCH CD-ACAD WARN/WATCH STATUS

Amends the School Code. Provides that placing a school or school district on academic early warning status for not meeting adequate yearly progress criteria for 2 consecutive annual calculations shall not begin until the 2005-2006 school year. Removes the requirement that the adequate yearly progress criteria be specified by the State Board of Education. Provides instead that the criteria must not be met in the same subgroup and in the same subject or in the school's or school district's participation rate, attendance rate, or graduation rate in order for the school or school district to be placed on academic early warning or watch status. Provides that a school or school district on academic early warning or watch status that meets adequate yearly progress criteria for one annual calculation (instead of 2 consecutive annual calculations) shall be considered as having met expectations and shall be removed from any status designation. Effective immediately.

SCHOOL CD-DISABLED STDNT PRGRS

Amends the School Code. Provides that, for students with disabilities, the indicators to determine their adequate yearly progress shall be based on their Individualized Education Plans. Effective immediately.

SCH CD-CHARTER SCH DISTRICT

Amends the Charter Schools Law of the School Code. Provides that a charter school district may be established, in compliance with referendum provisions, by converting an existing school district to charter school district status. Provides that an intergovernmental agreement must be made with a contiguous school district to accept pupils who choose not to attend the charter school district. Provides that the charter school district shall be administered by its elected school board and may have more than one campus. Provides that a charter school district and its school board have all of the rights and duties and are subject to the same limitations as are provided in the Charter Schools Law for charter schools and their governing bodies. Effective immediately.

VEH CD-EXCESSIVE IDLING

Amends the Illinois Vehicle Code. Provides that a vehicle using diesel fuel with a Gross Vehicle Weight Rating of more than 8,000 pounds may not have its engine idling for more than 5 minutes within any 60 minute period. Creates exemptions. Provides that a person who operates a vehicle in violation of the provision is guilty of a petty offense punishable by a fine of $50 for a first offense and $150 for a second or subsequent offense within any 12 month period.

GOOD SAMARITAN-1ST RESPONDERS

Amends the Good Samaritan Act. Provides immunity against criminal liability, civil damages, or medical malpractice damages for any acts or omissions, for any physician licensed under the Medical Practice Act of 1987 to practice medicine in all its branches or licensed to practice the treatment of human ailments in any other state or territory of the United States; any dental emergency responder; any licensed nurse; any licensed physicians assistant; any licensed EMT-Basic, EMT-Intermediate, or EMT-Paramedic; and any First Responder who provides volunteer Tactical Emergency Medical Support (TEMS) services to any person or animal in any law enforcement incident or training situation, or any other law enforcement related situation, including disasters, in civil unrest, or methamphetamine lab interdiction.
