SCH CD-COMMUNITY SCH-GRANTS

Amends the School Code. Subject to an appropriation or the availability of funding for such purposes, requires the State Board of Education to make grants available to fund community schools (which are traditional schools that actively partner with their community to leverage existing resources and identify new resources to support the transformation of the school to provide enrichment and additional life skill opportunities for students, parents, and community members at-large) and to enhance programs at community schools. Requires a request-for-proposal process to be used in awarding grants. Provides that proposals may be submitted on behalf of a school, a school district, or a consortium of 2 or more schools or school districts. Requires a school to have certain components in order to qualify for a grant. Requires the State Superintendent of Education to appoint a 9-member Advisory Council on Community Schools. Effective immediately.

DCEO-LOANS/EX-OFFENDERS

Amends the Department of Economic Opportunity Law of the Civil Administrative Code of Illinois. Creates a loan program for ex-offenders to plan and start their own businesses. Defines terms and sets requirements for loans. Amends the State Finance Act to create the Ex-Offender Fund. Effective January 1, 2010.

DHS-DRUG OVERDOSE PREVENTION

Amends the Alcoholism and Other Drug Abuse and Dependency Act. Provides that the Director of the Division of Alcoholism and Substance Abuse within the Department of Human Services may publish an annual report on statewide drug overdose trends, may establish a program to provide for the publication of drug overdose prevention, recognition, and response literature, may provide advice to State and local officials concerning drug overdose problems, and may award grants to create or support local drug overdose prevention, recognition, and response projects. Requires a health care professional prescribing an opioid antidote to a patient to ensure that the patient receives certain patient information; provides for immunity from disciplinary or other adverse administrative action; and provides for administration of an opioid antidote in an emergency. Requires the Director of the Division of Alcoholism and Substance Abuse, in consultation with statewide organizations, to develop and disseminate to health care professionals, community-based organizations, substance abuse programs, and other organizations training materials in video, electronic, or other formats to facilitate the provision of the required patient information. Effective January 1, 2010.

PATERNITY-DNA TEST REQUIRED

Amends the Illinois Public Aid Code, the Vital Records Act, the Criminal Code of 1961, the Illinois Marriage and Dissolution of Marriage Act, and the Illinois Parentage Act of 1984. Provides that the Department of Healthcare and Family Services' form for voluntary acknowledgement of paternity in connection with child support collection shall be the same form prepared by the Department and distributed to county clerks and registrars under the Vital Records Act. Provides that an acknowledgement of paternity and denial of paternity form shall include a statement informing the mother, the alleged father, and the presumed father, if any, that they have the right to request DNA tests regarding the issue of the child's paternity and that by signing the form, they expressly waive such tests. Requires that the statement on the acknowledgement and denial of paternity form concerning the right to request DNA tests be set forth in bold-face capital letters not less than 0.25 inches in height. Provides that in an action brought under the Illinois Parentage Act of 1984 to determine the existence of the father and child relationship or to declare the non-existence of the parent and child relationship, the court or Administrative Hearing Officer in an Expedited Child Support System shall, prior to the entry of a judgment in the case, advise the respondent who appears of the right to request an order that the parties and the child submit to DNA tests to determine inherited characteristics; provides that the advisement shall be noted in the record. Changes the name of the offense "unlawful visitation interference" to "unlawful visitation or parenting time interference" in the Criminal Code of 1961 and the Illinois Marriage and Dissolution of Marriage Act. Effective immediately.

ENERGY ASST-SUBSIDIZED HOUSING

Amends the Energy Assistance Act. Provides that if a participant in the energy assistance program resides in publicly supported housing, the compensation paid under the Act to the energy provider who supplied winter energy to the participant shall be paid on behalf of the owner of that publicly supported housing. Provides that "publicly supported housing" includes housing subsidized or developed with public funds provided under the Rental Housing Support Program Act. Effective immediately.

INCOME WITHHLDG-PROCESS SERVER

Amends the Income Withholding for Support Act. Provides that a finding of a payor's nonperformance within the time required under the Act must be documented by a certified mail return receipt or a sheriff's or private process server's proof of service (instead of by a certified mail return receipt) showing the date the income withholding notice was served on the payor.

GREEN INFRASTRUCTURE ACT

Creates the Green Infrastructure for Clean Water Act. Requires the Illinois Environmental Protection Agency to adopt comprehensive storm water management rules that meet certain requirements by July 1, 2012. Requires the Agency, beginning in 2010, to implement a storm water permit fee program adequate to support the adoption and implementation of State storm water regulations as required by the Act. Requires the Agency to establish a Statewide standard for storm water management programs in order to transition toward the use of green infrastructure as the predominant storm water management strategy. Requires the Agency to review its rules on the distribution of money from the Water Revolving Fund and to endeavor to establish new criteria which prioritize the use of green infrastructure in all projects involving storm water management and water efficiency.
