AI PRODUCT LIABILITY ACT

Creates the Artificial Intelligence Design Requirements Act. Sets forth provisions concerning product liability actions brought against a developer of an artificial intelligence system for defective design, failure to contain adequate instructions or warnings, and failure to conform to an express warranty. Provides that a deployer of an artificial intelligence system shall be deemed to be liable as a developer for harm caused by a product if: (1) the deployer makes material and substantial change to the product or (2) the deployer intentionally misuses the product contrary to the express warranty and that use was the proximate cause of harm to the plaintiff. Sets forth provisions concerning applicability and enforcement.

FOID-MENTAL HEALTH

Amends the Firearm Owners Identification Card Act. Provides that a person who has had the person's Firearm Owner's Identification Card revoked or denied under certain provisions because the person was a patient in a mental health facility shall not be permitted to obtain a Firearm Owner's Identification Card, after the 5-year period has lapsed, unless the person has received a mental health evaluation by a licensed clinical mental health professional (rather than a physician, clinical psychologist, or qualified examiner as those terms are defined in the Mental Health and Developmental Disabilities Code). Provides that the person receiving a mental health evaluation shall share all collateral records with the licensed clinical mental health professional making the certification and shall attest that all collateral records have been provided before the evaluation. Provides that the licensed clinical mental health professional shall attest that the licensed clinical mental health professional has requested, received, reviewed, and considered all of the person's collateral records in making the licensed clinical mental health professional's determination that the person is not a clear and present danger to self or others. Provides that the licensed clinical mental health professional shall identify the types of collateral records received. Requires the licensed clinical mental health professional to make all reasonable attempts to obtain collateral records, and, if no collateral records are obtained, requires the licensed clinical mental health professional to document the efforts used to obtain such collateral records. Provides that the results of the mental health evaluations that are performed on or after the effective date of the amendatory Act shall be transmitted to the Illinois State Police. Defines terms.

MEDICAID-SNF-MIUR/LOW VOL EXT

Amends the Hospital Services Trust Fund Article of the Illinois Public Aid Code. In provisions requiring the Department of Healthcare and Family Services to (i) pay safety-net hospitals a health care equity add-on payment that is based on such hospitals' Medicaid inpatient utilization rate and (ii) pay safety-net hospitals a low volume add-on payment of $200 for each inpatient General Acute and Psychiatric day of care, removes the December 31, 2026 sunset dates for such add-on payments. Effective immediately.

EVICTION-IMPOUND RECORDS

Amends the Landlord and Tenant Act. Provides that in any eviction proceeding in which the trier of fact determines that the tenant has complied with the terms of the last written and signed lease as to the amount and timeliness of rent payments, the proceedings shall be sealed.

REVENUE-AFFORDABLE HOUSING

Amends the Illinois Housing Development Act and the Illinois Income Tax Act. Provides that the amount of credits awarded under the affordable housing tax donation program is limited to $41,831,227 in State fiscal year 2027 and shall increase by 10% each fiscal year thereafter (currently, $32,850,352 in State fiscal years 2022 and 2023 increased by 5% each fiscal year thereafter). Provides that the affordable housing donation income tax credit applies through the taxable year ending on December 31, 2036 (currently, December 31, 2026). Effective immediately.

ED TASK FORCE-HISPANIC-SERVING

Creates the Hispanic-Serving Institutions Task Force Act. Creates the Hispanic-Serving Institutions Task Force. Sets forth provisions regarding administrative support, membership, compensation, meetings, and hearings. Requires the Task Force to assess the current landscape of Hispanic-serving institutions and emerging Hispanic-serving institutions in the State; identify barriers to student access, retention, and completion; review existing State policies and accountability frameworks to determine their impact on Hispanic-serving institutions and their students' success; examine best practices from other states related to supporting Hispanic-serving institutions; develop recommendations to improve access to and success in higher education for students, strengthen institutional capacity, improve coordination between State agencies and Hispanic-serving institutions, align Hispanic-serving institutions' efforts with State workforce and economic development priorities, and consider the feasibility of creating a permanent State initiative, designation, or funding mechanism to support Hispanic-serving institutions. Requires the Task Force to submit a written report to the Governor and the General Assembly on the Task Force's findings and recommendations for legislative, administrative, or budgetary action. Requires the Board of Higher Education and the Illinois Community College Board to each post the report on their respective public websites. Dissolves the Task Force upon the submission of its report to the Governor and General Assembly. Repeals the Act on January 1, 2029. Effective immediately.

MEDICAID-READMISSION DATA

Amends the Medical Assistance Article of the Illinois Public Aid Code. Removes provisions requiring the Department of Healthcare and Family Services to: (i) establish benchmarks for hospitals to measure and align payments to reduce potentially preventable hospital readmissions, inpatient complications, and unnecessary emergency room visits; (ii) publish provider-specific historical readmission data and anticipated potentially preventable targets 60 days prior to the start of the program; and (iii) adopt policies and rates of reimbursement for readmission services and other payments.

MENTAL HLTH WORKFORCE-ACT RATE

Amends the Rebuild Illinois Mental Health Workforce Act. Provides that, subject to federal approval, for dates of service on and after July 1, 2026, the Medicaid reimbursement rates for Assertive Community Treatment and Community Support Team services shall be increased by an amount appropriated for the purposes enumerated in the Act. Effective July 1, 2026.

IDHR PROCEDURAL CHANGES

Amends the Illinois Human Rights Act. Provides that for charges alleging violations under the Equal Employment Opportunity Commission or the Illinois Human Rights Act, if the EEOC issues a right to sue, the Department will issue a Departmental right to sue. Provides that if the complainant does not file a written request with the Department to review the EEOC's determination within 35 days after receipt of the Department's notice, the Department shall issue to the complainant, within 10 business days after the expiration of the 35-day period, a Departmental right to sue notice stating that the complainant has the right, within 90 days after receipt of the Department's notice, to either file the complainant's own complaint with the Human Rights Commission or commence a civil action in the appropriate circuit court. Requires the Department, within 10 days of the date on which the charge was filed, to serve a copy of the charge on the respondent and provide all parties with a notice of the complainant's right to opt out of the investigation within 60 days to commence an action in circuit court and the complainant's right to request a Departmental right to sue notice after 60 days has elapsed to file in the Human Rights Commission or commence a civil action in circuit court. Provides that within 10 business days of receipt of the complainant's request to opt out of the investigation, the Director shall issue an opt out notice to commence an action in circuit court to the parties. Provides that a Departmental right to sue notice does not constitute a finding of substantial evidence or of a lack of substantial evidence. Requires that any Departmental right to sue notice to state that the complainant shall have 90 days from the date of receipt of the notice to either file the complainant's own complaint with the Human Rights Commission or commence a civil action in the appropriate circuit court.

FOREST/RIVER DIST-BIDS

Amends the Cook County Forest Preserve District Act and the River Conservancy Districts Act. Makes changes to the competitive bidding thresholds for contracts entered into by River Conservancy Districts or the Cook County Forest Preserve District for supplies, materials, or work. Changes the bid threshold to $60,000 for contracts related to supplies or materials, $30,000 for contracts involving work, or a lower amount for any contract for supplies, materials, or work, if required by board policy. Effective immediately.
